Continuation of regular meeting Sept 9, 1952, 7:45 pm.at the City
Hall. Mayor J. M. Gibson, pre8iding with the following Council-
men- present, Glenn Yarbrough, . M. Hamby, Eugene Rice, C. C. Ter-
rell and Harry Mitchell. City Attorney, Harold Willingham present.
Motion by Eugene Rice seconded by Harry Mitchell to send Mr. Ernest
Jones, to Tax Assessors convention to be held three days in Athens,
expense not to exceed $40.00. Voted unanimous.
Several persons attended meeting in regards to storm sewer not
taking care of,drainage from Dell to Concord Rd. Councilmen Rice
and Yarbrough ask to contact Bennett as to what procedure to take
in this matter.
Motion by Harry Mitchell seconded by Eugene Rice to aband parkin;
at G. B.ts Place on Spring St., from Atlanta St. to R. R., allow-
ing for loading zone only. Voted unanimous.
Councilmen Terrell and Rice appointed to investigate building line
of building located on Spring St. and Atlanta Street.
Motion by C. M. Hamby seconded by Eugene Rice to notify all
peoplosoutside City limits garbage service discontinued`effect-
ive Oct.%lst. Voted unanimous. - .
Motion by Eugene Rice seconded by C. M. Hamby to appoint Mr. T. J.
Peck supt. of sanitation and streets and to furnish Mr. Peck with
a pick up truck and minimum of one laborer. Voted unanimous.
Upon motion of Eugene Rice and seconded by C. C. Terrell the follow -
in ordinance was unanimously adopted:
TO ESTABLISH RULES AND REGULATIONS FOR THE ELECTION TO ELECT ONE
MAYOR AND TWO COUNCILMEN WHOSE TERMS EXPIRE DECEMBER 31, 1954:
Upon motion by Councilman Rice seconded by Councilman Terrell, that
the following three men be appointed as election managers for the
regular City election to be held.November 1, 1952.

town. Said managers shall be paid the sum of $8.00 each for services
as election managers. Voted unanimous.
The following rules and regulations for the coming election were
adopted aadprovided by the Charter:
Election of One Mayor and Two Councilmen for term beginning Jan-
uary 5, 1953, will be held November 10 1952, asrprovided by the
Charter of the City of Smyrna. Hours. of election -shall be from
1 p.m. to 7 p.m. Deadline for registration of voters shall be
the 16th day of October 1952, as provided by the Charter of said
City. Deadline fQr qualification of Councilman shall be the 16th
day of October,4 as, provided by the charter of said city. -
On or before such date all persons offering themselves• a•s candidates
shall file a written notice with the Clerk of said City setting forth
their date and place of birth, period of residence in the City of
Smyrna, real property owned bythem, and a statement that they possess
all the qualifications required by said Charter for Mayor or Council-
man of said City.

We propose to have the attorneys prepare an ordinance covering a proposed
issue of $200,000.00 CITY OF SMYRNA, GEORGIA THIM LIEN WATER AND SEWER
REVENUE CERTIFICATES to bear interest at 4 1/4%, to be dated November 1,
1952, interest payable January 1 and July 1 with the first interest coupons
` to become due July 1, 19538 $1,000* denominations, to mature January lst as

(this will make the annual payments of principal and interest average close
to $13,000.). The certificates are to be callable on and after January 13,
1955 at 105 (the same as the 1950 and 1951 issues).
We agree to purchase at this time not less than $65,0000 and not more than
$100,000e at`,`a price of par and accrued interest; these certificates to
mature within the first twenty years of the proposed maturities. This agree-
ment to purchase the certificates is, of course, based on the certificates
being legally validated, issued and approved by the attorneys. This agree-
ment constitutes a firm commitment on our part for a period of 90 days.
Should the City, through no fault of ours, be unable to deliver the certifi-
cates and complete the transaction within that period we are to have no
h further liability and are to have an option for an additional 90 days to pur-
chase the certificates on the same basis.
We, will have. the ordinance provide that the City -can-pay-up-to-2%-of the face
value of the,ncertificates issued to cover attorneys' fees, printing of the
certificates 'an, other expenses should it be necessary -to -do -that -in -order
to sell the -certificates at the time they are ready to be issued• Should we
-be dble to selt-the -certificates at a price that mill -enable -us -to--absorb
these expenses and make a reasonable profit we will handle accordingly.
We will have a provision in the ordinance that mill enable "the City to pay
legal feesy printing, other expenses and a commission-Ul.-not-to-exceed 5%
on the certificates not to be issued at this time, should that be necessary
to market the remaining certificates when and if -the -City -receives -a grant
from a Federal Government agency and needs additional funds.
We understand the proceeds from the sale of the certificates to be sold at
this time are to be used to complete water and sewer installations and the
necessary lines to the.several housing.projects,now under way and that there
will be 'a material increase in the number of paying water and sewer connections
as soon as this can be accomplished.

It was further ordained that rules and regulations for contest-
ing election be the 'same as set forth in the Georgia Code for
State Elections.
Motion made by Eugene Rice and seconded by Glenn Yarbrough that
the following resolution and ordinance be adopted:
Be it ordained by the Mayor and Council of the City and it is here-
by ordained by the the authority of same:
That pursuant to authority contained in Sec. 9 of the Charter of the
r., City that Glenn Lewis, Jesse Henderson and Bill Reed be named desig-
nated, constituted and appointed as the t� registrars of said
City, to serve a term of one year, and until their successors are
duly chosen and qualified.
That said registrars shall examine the registration books of City
and purge from same names of" all persons not qualified to 'rote in
the Municipal election of'said City, such qualification being set
forth in detail in the Charter of the City.
That on, or before the hour fixed for the commencing'of the regular
election of said City to be held on November 1st, 1952 for One Mayor
and Two Councilmen of the City as provided by in the Charter of the
City, said registrars shall furnish to the managers duly selected to
hold such election three certified lists of the qualified voters of
the Town eligible to vote in said election.
That said registrars shall be entitled to a compensation of $8.00
each for certifying the lists of qualified voters for each election
held in the town. Voted unanimous.
Motion by C. M. Hamby seconded by Glenn Yarbrough to pay utilityo
bills due of City. Voted unanimous.
Motion by Glenn Yarbrough seconded by C. M. Hamby to pay $80.00 to
Georgia Tech ( in addition to sum previously paid) to reimburse
Prof. I. if." Saporta for money'used out of personal funds in recent
survey made of the City of Smyrna. Voted unanimous.
Motion by Glenn Yarbrough seconded by Eugene Rice that all sewer
taps which have been stubed out to property line remain $75,.000
and water meter $50.00. Voted unanimous.
City Attorney Harold Willingham read to the Council a contract between
City of Smyrna and Johnson, Lane, Space & Co., and motion was made by
Councilman Harry Mitchell and seconded by Councilman Glenn Yarbrough,
to accept contract dated'September 19, 1952. Contract attached to the
these minutes and made a part thereof. Voted unanimous.

CC A lengthly discussion between the Council and Police Dept., was
�, eld as to ways and means of improving the department to give
the bes'`t service to the citizens of Smyrna.
Motion by C. Co Terrell seconded by Harry Mitchell to resind
motion at act. 6, 1952 meeting pertaining to amendment added
to rules and regulations governing electrical wiring as adopt-
ed Feb. 1951,'said°amendment to read;
An electrical permit shall be issued to cover only one desig-
nated job. Each permit shall apply to only one building. Any
issuance of electrical permits shall be made only to a licensed
electrical contractor, or any person or individual doing work in
his own home; that person or individual to be approved by the
electrical board. Voted unanimous.
Motion by C. C. Terrell ,seconded by Harry Mitchell to raise the
salary of the assistant clerk from $36.00 to $40.00 per week,
effective this date`. Voted unanimous.
Motion by C. C. Terrell seconded by Harry Mitchell to install
pump now at spring (if adequate) at septic tank in Bennett pro-
ject; if not suitable'to purchase and install lift pump. Voted
unanimous.

A special meeting of the Mayor and Council was held at.the City
Hall, October 23, 19520 7:45 p.m. Maybr.J. M. Gibson presiding
with the following Councilmen present; C. C. Terrell, Eugene Rice,
C. M. Hamby, and Glenn Yarbrough. City Attorney, Harold Willing-
ham present.
Purpose of meeting to adopt ordinance for issuing Waterworks and
Sewerage Revenue Certificates.
Motion by C. M. Hamby seconded by C. C. Terrell instruction City
Attorney to include in ordinance that units where multiple f amilie-s,
are served by one water meter; each unit will pay a minimum water
bill each months, 'als'bsrhinimum•-,service charge $1.50 per month when
water meter is connected and water not on; Olf.= charge for turn-
ing water on and all.charges and bills to be paid before water to
be turned back on, effective November 1, 1952. Voted unanimous.
Motion by C. M. Hamby seconded by G. R. Yarbrough too adopt ord-
inance for issuing Waterworks & Sewerage Revenue Certificates.
