09-02-1952 Regular MeetingThe regular meeting of the Mayor an d Council was held at the City Hall, Sept. 21 19522 7:45 p.m. Mayor J. M. Gibson, presiding at i the meeting with the following Councilmen present, G.'R. Yarbrough, Eugene Rice, C. M. Hamby and Harry Mitchell, Jr. City Engineer, M. J. Hensley and City Attorney, Harold Willingham present. Minutes of regular and special meetings of August read. Motion by, C. M. Hamby seconded by Eugene Rice to approve minutes of meetings as read. Voted unanimous. .; Councilman Yarbrough gave report of inventory of tools belonging to the City, on hand. Each Councilman was given a copy of report. Mr. Yarbrough recommended that standing committees have more than one member of Council serving. , A letter from Mr. H. B. McIntosh read asking .that the 10% .penalty charge for failure to make tax return be refunded to him as he be- lieved that he had made his return. Motion by C. M. Hamby to refund the $2.20 charge -to Mr. McIntosh; there being no second, motion loss. Mayor ask clerk to write Mr. McIntosh a letter in regard to same. . A letter read from Attorney Plum Swan, stating the City was liable for damages done to the Floy Peeler property, which was turned over to City Attorney to handle. Motion by C. M. Hamby seconded by Harry Mitchell to adopt Plumbing Ordinance for City of Smyrna (1952 Edition) . Copy of ordinance r attached :to these minutes and made a pant thereof. Voted unanimous. Motion byC fir,. I�, _ru, seconded byto elect Mr. Ray Fain to serve on plumbing board replacing Mr. Mines. Voted unanimous. -Motion by Eugene Rice seconded by G. R. Yarbrough to place Mrs. Louise Logan,aassistant clerk and H. P. McCollum, supt. of water dept. under- ,000.00 bond each, to be insured with Fidelity and Casualty' Co., of N. Y. (W. F. Stewart Ins.. Co., Agency) and. also. not permit- ting anyone not bonded to collect any money for the City. Voted u- nanimous. . Attending the meeting were representatives and builders of Wayland Park (Mangham); Cheney Woods (Hall and Roberts); Belmont Hills (Ward and Lavander) and Mountain View (B: L. Walker). After a lengthly discussion of the positions of the City and the builders, motion made by Councilman Yarbrough to give water and sewerage services to Mr. Manghamts sub -division known as Wayland Park, and Road #5 in Belmont Hills Subdivision at $175.00 per unit tape seconded by Harry Mitchell. Voting for G. R. Yarbrough and Harry s Mitchell. Voting against, Eugene Rice. Mr. Hamby had left meeting to go to work.and did not vote. Motion carried. Motion by G. R. Yarbrough seconded by Harry Mitchell authorizing City Attorney to draft Ordinance for issuing 065,000.00 water and sewerage revenue certificates. Voting for Harry Mitchell and do R. Yarbrough. Voting against, Eugene Rice. ,Motion carried. Motion by G. R. Yarbrough seconded by Harry Mitchell that cost of water tap be minimum 075.00 and sewer tap minimum $150.00 excluding Wayland Park and Road #5 Belmont Hills and Unit #3 Belmont Hills. Voting for G. R. Yarbrough and Harry Mitchell. Voting against, Eug- ene Rice. Motion'carried. Motion by -Harry Mitchell seconded by Eugene Rice to elect Mr. J. M. Motion by Eugene Rice seconded by Harry Mitchell to send Mr. Ernest Jones, to Tax Assessors convention to be held three days in Athens, expense not to exceed $40.00. Voted unanimous. Several persons attended meeting in regards to storm sewer not taking care of,drainage from Dell to Concord Rd. Councilmen Rice and Yarbrough ask to contact Bennett as to what procedure to take in this matter. Motion by Harry Mitchell seconded by Eugene Rice to aband parkin; at G. B.ts Place on Spring St., from Atlanta St. to R. R., allow- ing for loading zone only. Voted unanimous. Councilmen Terrell and Rice appointed to investigate building line of building located on Spring St. and Atlanta Street. Motion by C. M. Hamby seconded by Eugene Rice to notify all peoplosoutside City limits garbage service discontinued`effect- ive Oct.%lst. Voted unanimous. - . Motion by Eugene Rice seconded by C. M. Hamby to appoint Mr. T. J. Peck supt. of sanitation and streets and to furnish Mr. Peck with a pick up truck and minimum of one laborer. Voted unanimous. Upon motion of Eugene Rice and seconded by C. C. Terrell the follow - in ordinance was unanimously adopted: TO ESTABLISH RULES AND REGULATIONS FOR THE ELECTION TO ELECT ONE MAYOR AND TWO COUNCILMEN WHOSE TERMS EXPIRE DECEMBER 31, 1954: Upon motion by Councilman Rice seconded by Councilman Terrell, that the following three men be appointed as election managers for the regular City election to be held.November 1, 1952. E:.eB.. AWTRY, RAY -EULTCIk HENRY KONIGS11AR$ all freeholders in said town. Said managers shall be paid the sum of $8.00 each for services as election managers. Voted unanimous. The following rules and regulations for the coming election were adopted aadprovided by the Charter: Election of One Mayor and Two Councilmen for term beginning Jan- uary 5, 1953, will be held November 10 1952, asrprovided by the Charter of the City of Smyrna. Hours. of election -shall be from 1 p.m. to 7 p.m. Deadline for registration of voters shall be the 16th day of October 1952, as provided by the Charter of said City. Deadline fQr qualification of Councilman shall be the 16th day of October,4 as, provided by the charter of said city. - On or before such date all persons offering themselves• a•s candidates shall file a written notice with the Clerk of said City setting forth their date and place of birth, period of residence in the City of Smyrna, real property owned bythem, and a statement that they possess all the qualifications required by said Charter for Mayor or Council- man of said City.
