R. Siddall and seconded by Councilman John Collier. I.OMS, Section bit of the ner► Charter of the City of Smyrna (Georgia haws 1931 - pages 982 and 983) Tihich section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in party "that no sidewalk, street, alley, or other place shall be paved, repaved, or im- proved, until the passage of an ordinance authorising the same, and no such ordinance shall be passed unless the 'Aiayor and Council shall have first been petitioned in writing to pave, repave, or otherwise improve the same, by a majority of the persons, companies, or corporations, soar the owner or owners of a majority of the front footage of abutting propertyt subject to assessment for the cost of paving, repaving or otherwise improving the sidewalk, street, avenue, public alley, public place or portion thereof proposed to be pave or repaved;" MI M EREAS, at a special meeting of the Council held at 7s45 P. -i. on the 2nd day of August, 1954.. a petition -was presented to the Mayor and Council, signed by thirteen (13) property owners of the city residing on Dell Avenue in said City, being a majority of the owners of property on Dell Avenue, and owning a majority of the front footage of property in the city abutting on Dell Avenue; 0 ".. EREAS, in said petition the Lkyor and Council are requested to pass an ordinance requiring the improvement by the construction on each side thereof of concrete curb and gutter of a portion of Dell Avenue in the City of Smyrna, to advertise the introduction of said ordinannce and to mail notices of the same to all persons owning property fronting on either side of Dell Avenue, to set a date for hearing objections to such ordinance, to subsequently pass an assessment ordinance giving the requisite statement to abutting owners on said street and to do any and all things necessary as required by law and by the charter of said city to legally accomplish the improvement by the construction on each side thereof of concrete curb and gutter; NCWs THEREFORE, be it ordained by the 1.4yor and Council of the City of &Wrna, and it is hereby ordained by authority of same; I% That a portion of Dell Avenue in the City of Smyrna, being a distance of approximately 720 lineal feet from the eastern intersection of —l— Dell Avenue with Evelyn Street•in the City of SMrna, to the western intersection of Dell Avenue with Hollis Street in the ; City of Smyrna, be improved by the construction on each side thereof of concrete curb and Cutter, said gutter to be eighteen (18n) inches Tide and six (611) inches thick with a curb erected thereon on the outside of said gutter on each side of said street six (6n) inches high. 2. That the .iVs or of said City is authorized and empowered to engage an engineer to prepare the proper plans and specifications of the above improve- ments herein proposed to be made, and that said 4:ayor be authorized to either, after legal and proper advertising of same, let a contract for and in behalf of the City for the erection of such proposed improvements, or to authorize the City's construction employees and forces to accomplish the work. 3. That the ayor and Council estimate the cost of such improvements to the abutting property owners from the best information available at this time based on various discussions with contractors and others having technical k=irledge of the cost involved to be approximately Two & 501100 (,,:)2.50) Dollars per lineal foot of such -improvements and being as above set forth approximately 720 feet of improvements by the construction on each side thereof of concrete curb and gutter, the total estimated cost therefore for the complete job being po.ob Such estimated costs as above .set forth being estimated to be ;;1.25 per front foot of property in said city abutting on Dell Avenue on the north and south sides thereof. 4. That when said improvements are completed an ordinance shall be passed assessing the total cost of same including engineering and supervision expenses against the owners of the property on said street, as provided in Section 66 et seq. of the new Charter of said City (Georgia Laws 1931, page 983, et seq.). 5. That before the passage of this ordinance a public hearing regarding same shall be held at a meeting of said :�ayor and Council; and it is hereby ordered that such said public hearing shall be held before said 1.4or and Council on the 7th day of September, 1954, at seven -forty-five o'clock P. 11. That all property owners and other persons interested therein are directed and notified to appear, at such hearing and make arW objection they may desire to urge against the passage of this ordinance. 6. That pending the consideration of this ordinance by the Mayor and Council, an advertisement shall be posted in three (3) public places in said City, to -wit, the City Hall, the Post Office and the Bank of Smyrna, all being in the City of Smyrna and all being located on Atlanta Street in said City, except 2- f/ the Post Office vrhich is located on Yest Spring. Street in said City giving notice of the introduction and pendency of this , ordinance. Such advertisement shall state the name of the street to be improved and paved., the nature of such eonten•► plated improvements and the estimated cost per front foot of same. Such adver- tisement shall further set froth that the property owners or others interested are notified to appear at a meeting of the said 1.4or and Council to be held on the 7th day of September, 1954t in the City Hall of said city at seven-forty-fiv3 o'clock P. 14, and make and objection that they may desire to urge against the passage of this ordinancee 7. That at a regular meeting of the ljaycr and Council of the City of Smyrna, had at seven -forty-five o'clock P. 110 on Lbnday, August 2, 1954, at the City Ha.l.l,,an ordinance was introduced by Councilman V. Siddall and seconded by Councilman John Collier, providing that hell Avenue in the City of Smyrna shall be improved by the construction on each side thereof of concrete Curb and gutter. 2a That the street proposed to be improved in said ordinance is Dell Avenue iri the City of Smyrna* Said -proposed ordinance .provides that a portion of Dell Avenm, being a distance of 720 lineal feet from the western intersection of Dell Avenue with Evelyn Street in the City of Smyrna, to the eastern intersection of Dell Avenue with Hollis Street in the City, of Smyrna., be improved by the construction on each side thereof of concrete curb and gutter. e 3. That said proposed ordinance provides that a portion of Dell Avenue in said City, as above described, be improved by the construction on each side thereof of concrete curb and gutter., said gutter to be eighteen (1811) wide and six (01) inches thick with a curb erected thereon on the outside of said gutter on each side of said street six (01) inches high, 4, That the estimated cost per front foot to the abutting pLgperty owners for such contemplated improvements as above described is tiJ&25 per .front foot of the property in the City of Smyrna, abutting on Dell Avenue on the north and south sides thereof. !* 5. That if such contemplated improvements as herein-debcribed are erected aTl persons ova ing property on the aforesaid designated portion of Dell Avenue in said City, shall be subject to a pro rata assessment of the cost oaf said improvements against their properties. 6. That all persons owning property fronting or abutting on said street in the CiTy of Smyrna, and all other persons interested in any way in subject matter, are hereby notified and directed to appear at a meeting of the i3ayor and Council of the City of Smyrna, to be held on the 7th day of September, 1954, at seven -forty-five o'clock P. Mo in the City Hall of said City., then and there to make any objections that they may desire to urge against the passage of the proposed ordinance herein described, copy of which is attached and made a part. hereof.
