Mr. Chuck Clayton explained to the Council the advantages of securing services of the City Planning Firm of which he represent; sented.' Motion by H. L. McEntyre seconded by Stanley McCalla to employ Branscome Concrete Co., Marietta, Georgia to lay side walk on W. Spring Street and King Street curb ,'nd gutter app. 6731 at a cbst of .38¢ per sq. ft. , total $1';864.21. Voting for H.-L. Mc- Entyre, John Collier and'Stanley McCallaq Voting against, C. Stephen Hall, Jr., as the owner of the following described property, namely: All that tract or parcel of land lying and being in the 17th District and 2nd Section of Cobb County, Georgia, and being what is known as the Judge John M. REPAIRS TO TANK OR TANK STRUCTURE Contractor agrees to make no repairs unless specific authoriza- tion to make same is given by- municipality. Contractor agrees, however, to point out necessary repairs to agent of Municipality and to make necessary repairs upon receipt of authorization from Municipality or its duly .au- thorized agent at rates or prices to be agreed upon at such time. MAINTENANCE OF WATER SUPPLY Contractor agrees, upon request of Municipality, to furnish, install and maintain an excess pressure relief valve so that water supply will not be shut down, provided, however, that water equipment of municipality is so constructed that such excess pressure relief valve can be used. Contractor agrees to remove same upon completion of work. i PAYMENT Municipality agrees that it shall pay contract price of this project in full upon completion of the work and submission of invoice unless other credit arrangements shall have been consummated with Contractor. In the event of any default in payment hereunder, Municipality agrees to pay Contractor legal rate of interest from date of billing to date of payment, plus any reasonable expenses incurred by Contractor by reason of such de- fault, and such reasonable expenses shall include attorney fees in the amount of 15% of any sum due. McEntyre the following ordinance was unanimously adopted: REED STREET - PAVING ASSESSMENT ORDINANCE J WHEREAS, the paving and improving of the who of Reed Street in the City of Smyrna, being a distance of approximately 300 lineal feet from the northern intersection of Reed Street with Church Street to the southern intersection of Reed Street and Love Street in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931; embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 270 1931 (Georgia Laws 1931, pages 955-988), and under and by virtue of the adoption of an ordin- ance intnnduced after the filing of a petition with the Mayor and ' Council for such paving and improvement, by a majority of the persons companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is ';531.24. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the authority of the same: That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of A531.24,. to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessment, determined under and by the pro- visions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improve- ment, and said lien is hereby declared from the date of sAid ordinance which was passed on the 1st day October, 1951.
