10-01-1951 Regular MeetingThe regular meeting of the Mayor and Council was held at,.the City Hall, October 10 1951, 7:30 P. M. Mayor J. M. Gibson, presiding, with the following Councilmen present: H. L. McEntyre, Howard Hames, John Collier, C. W. Jones and S. H. McCalla. City Attorney, Harold Willingham and City Engineer, 1. J. Hensley, present. Minutes of previous regular meeting read. Motion by Councilman Mc - Calla seconded by Councilman Hames to approve minutes of regular meeting as read. Minutes of special meeting September 259 1951 read. Motion by Councilman McCalla seconded by Councilman Collier to approve minutes of special meeting as read. Voted unanimous. The first five motions read of the September �5th special meeting With no objections. The following motion being a part of the September 25th minutes. was read as follows: Motion by S. H. McCalla seconded by John Collier to pay J. M. Gibson for full time supt. of Construction work until endbof this -year at a salary of $100.00 per week. This action effective October 1, 1951 and salary to be paid from Con- struction fund. C. W. Jones Walked out of meeting in protest of motion before vote is taken. Voting for: H. L. McEntyre, S. H. Mc - Calla and Howard Hames and John Collier. Motion carried. Motion by C. W. Jones to kill motion regarding mayor being employed dull time supt. of Construction work. Motion Councilman McCalla seconded Councilman-Hames to order motor for disposal plant from General Electric Co., $95.05. Voted unanimous. Councilman C. W. Jones reported nearest fire hydrant app. 583t on M6=kar Circle, by following the street. Water line not large enough for a fire hydrant. Motion by Howard Hames seconded by -Stanley McCalla to wait in regard to water -tank to see if some other company has steel. Meeting set to be held on Tuesday night of the following week. Voted unanimous. Motion by Howard Hames seconded by S. H. McCalla to purchase a filing cabinet with cards for water.department at a cost of app. $250.00. Voted unanimous. Motion by Stanley McCalla seconded by Howard -dames to install one 600 W. street light at corner King and Church in -front of Baptist Church.and one 600W. street light at Hill and Atlanta Sts. Voted unanimous. Recommendation traffic light, Love and Atlanta streets. Recommendation traffic light, Concord and Love streets, also to move caut&can light from upon hill.- Motion by S. H. McCalla;=McEntyre: Signal light Church and King Sts to be moved to -Love and Atlanta Street and new signal light Atlanta and Church; Atlanta andxPowder Springs. I -Pursuant to advertising as required by the Charter a public hearing was held on the ordinance to pave Anderson Circle, introduced by Councilman John Collier and seconded by Council- man Stanley McCalla, at the August 23, 1951 meeting of the Mayor 4nd Council. After public hearing, motion was made by Council- man John Collier and seconded by Councilman -Stanley McCalla that the ordinance for the paving of Anderson Circle be passed as in- troduced. Motion unanimously carrte-d--and such ordinance was a- dopted. Pursuant to advertising as required by the Charter a public hearing was held on the ordinance to pave Marston Street, in- troduced by Councilman John Coll-i"er and seconded by Councilman Stanley McCalla, at the September 4o 1951"meeting of the Mayor and Council. After public hearing, motion was -made by Council man John Collier and seconded by Councilman Stanley McCalla that the ordinance for the paving of Marston Street, be passed as in- troduced. Motion unanimously carried an ­such ordinance was a- dopted. After public hearing, motion was made by Councilman John Collier and seconded by Stanley McCalla that the ordinance for, the paving of Reed Street, be passed as introduced. Motion unanimously carried and such ordinance was adopted. Eleven property owners from Mimosa Circle came before the Council regarding the resurfacing of Mimosa Circle. Mayor Gibson reported to group, County Commissioner, Johnny Heck had promised to do work for city on Friday of this week, which in- cluded resurfacing of Mimosa Circle, if weather permitted. Miss Martha McCollum and Mr. Roark came before council in regard to portion of Marston Street not being paved. This portion being the part which.joins the R. R.. Mr. George Kreeger and Mr. Jack Colston came before Council from the Smyrna�School board of trustees asking as to the possibility of the new school being connected to city sewerage system. Harry Mitchell came before council regarding rock in gully joining property of C. M. Kelley, Bank St., which needs cutting away to keep from ruining paving. ' Motion by Councilman Stanley McCalla seconded by Councilman John Collier to.correct this condition just as soon as proper cutting tool is available to do this work. Voted unanimous. r� THE FOLLOWING RULES AND REGULATIONS FOR THE ELECTION TO ELECT THREE COUNCILMEN WHOSE TERMS EXPIRE DECEMBER 31, 1951 SET: >Motion made by Councilman H..L. McEntyre, seconded by Councilman Howard Hames, that the following three men be appointed as election managers for the regular City election to be held November 3rd, 1951. M. V. COBB, Ex-officio, Justice -of the Peace for the Militia District, in wh ch t e City of Smyrna is situated. E. B. Aw�try and Hoyt Lan s- tonvt'freeholders in said town. Said managers -shall be paid the sum oT` 8.00 each for services as election managers'. Voted unanimous. Motion by Councilman Stanley McCalla seconded by Councilman H. L. Me- Entyre, the following rules and regulations for the coming election were adopted as provided by the Charter: Election for Three Councilmen for term beginning January 1, 1951, will be held November 3, 1951, as provided by the Charter of the City of Smyrna. Hours of election shall be from 1:00 P-. M. to 7:00 P. M. Deadline for registration of voers shall be on the i'7th day of Octo'Ter 1951, as provided by the Charter of said city. Dea=ne for qualifi- cation of Councilman shall be the 19th day of October, as provided by the charter of said city. On or before such date all persons offering themselves as candi- dates shall file a written notice with the Clerk of said City se7 setting forth their date and place of birth, period of residence in the City of Smyrna, real property owned by them, and a state- ment that they possess all the qualifications required by said Charter for a councilman of said City. It was further ordained that rules and regulations for contesting an election be the same as set forth in the Georgia Code for State Elections. Unanimously adopted. Motion made by Councilman John Collier and seconded by Councilman McCalla that the following resolution and ordinance be adopted Be it ordained by the Mayor and Council of the City of Smyrna and it is hereby ordained by the authority of same: That pursuant to authority contained in Sec. 9 of the Charter of the City that G. R. Lewis , W. H. Col5uui_tttt and W. P. Cochran be named, designated, const to ed and appointed as the three registrars of said City, to serve a term of one-year, and until-tFiei'r successors are duly chosen and qualified. That said registrars shall examine the registration books of City purge from same names of all persons not qualified to vote in the Municipal election of said City, such qualification being set forth in detail in the Charter of the City. That on or before the hour fixed for the commencing of the regular election of said City to be held on November 3rd, 1951 for three Councilmen of the City as provided by in the Charter of the-=y, said registrars shall furnish to the managers duly selected to hold such election three certified Lists of the qualified voters of the City elegible to vote in said election. That said registrars shall be entitled to a compensation of,$8.00 each for certifying the lists of qualified voters for each elec.tTon held in the City. Voted unanimous. Motion by Councilman John Collier seconded by Councilman Stanley McCalla to purchase 1 Ton 8 Cylinder Ford truck from A. L. Burruss, paying $950.00 cash from Water Revenue Fund and 1940 Ford Tu-dor sedan (old police car) trade in. Voting for John Collier, Stanley McCalla, and H. L. McEntyre and -Howard Hames. Voting against, C. W. Jones. Motion carried. M. J. Hensley, City Engineer reported, -on survey made for disposal plants. One suitable site located near the four -lane highway to accomodaterproposed Wilson project. West side.projects would re- quire two small plants. App. one acre land, highest point needed for location. Councilman Howard Hames announces his resignation as councilman and Electrical Inspector. Bills read by Mayor. Motion by Councilman Stanley McCalla seconded by Councilman John Collier to pay bills asza d. Voted unanimous. On motion by'Councilman John Collier seconded by Councilman Stanley McCalla the following ordinance was unanimously adopted: FOSTER STREET - PAVING ASSESSMENT ORDINANCE Whereas, the paving and improving of the whole of Foster Street .' In the City of Smyrna, being a distance of approximately 471 lineal feet from the northern intersection of Foster Street and Spring Street to the endobf Foster Street, which is a dead end, in the City of Smyrna, has been completed pursuant to the Act of the Gen- eral Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988) and under and by virtue of the adoption of an ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, com- panies and corporations subject to assessment for the cost of such paving and improvement, and 41 WHEREAS, the cost,of such.paving and improvement to the abutters as provided in said Act. is $427.75. THEREFORE, be it ordained by.the Mayor and Council of the City of Smyrha, and it is hereby ordained by the authority of the same; that each abutting owner, subject to the cost of such pave- ment and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner,of said sum $427.75, to' be, determined by the amount of the frontage of such c• owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of rthe property abutting upon said street for the amount of, the assessment, determined.under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said pav- ing and improvement, and said lien is hereby declared from the,date of said ordinance which was passed on the 23rd day of August, 1951. C. And St.,L. Railway to the eastern intersection of Hawthorne Street with ,the City limits in the City of,Smyrna, has been completed pursuant to.the Act of the deneral Assembly of 1931" embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931s pages 955-988), and under and by virtue of the adoption of an ordinance introduced after the filing of a petition with the, Mayor and Council for such .paving and.improvement, by a majority of the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the -,cost of such paving and improvement to the abutters as provided in said Act, is $1,828.00. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna,,and it is hereby ordained by the authority of the same; That each abutting owner, subject to the cost of such pavement and improvement,under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of'said sum of $1,828.00, to be determined by. the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each protion of the property abutting upon said street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage.of the ordinance for said paving and improvement, and said lien is hereby declared from the date of said ordinance which was passed on the 23rd day of August, 1951. On -motion by Councilman John Collier seconded by Councilman Stanley McCalla the following ordinance was unanimously adopted: MARSTON STREET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of a portion of Marston Street in the -City of Smyrna, being a distance of approximately 435.75 lineal feet from the western intersection of Marston Street with Gilbert'Street to the end of Marston Street, which is a dead. end in the City of Smyrna, has been completed pursuant to the Act of the General -Assembly -of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna) approved,August 27, 1931 (Georgia Laws 1931, pages 955-088), and under and by virtue of the adoption of an,ordinance intro'after the filing of a petition with the Mayor and Counci-1 for suduce aving improvement, by a majority of the persons, Oompantes and corporations subject to assessment for the.cost of such paving and improvement, and 4 WHEREAS, the cost of such paving and improvement to the abutters as "provided in said Act, is W8.18. THEREFORE, be it ordained by the Mayor and Council of the City -of Smyrna, and it is•hereby ordained by the authority of the same; That each abutting Owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of'the pro rata part of such owner of said sum of $508.18, to be determined by the amount of the frontage of such owner on said street,and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of s said Act, against the owner thereof, to date back to the.approval of the passage of the ordinance for said paving and. improvement;,: and said 11-en•is hereby declared from -the date of said ordinance which was passed on the 23rd day of August, 1951. On motion by Councilman John Collier seconded by Councilman Stanley McCalla the following ordinance"was.unanimously adopted: NICHOLS:STR'EET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of the whole of Nichols Street in the City of Smyrna, being a distance of approximately 317 lineal,feet from the eastern intersection of Nichols Street and Pickens Street to the western intersection.of Nichols Street and Dunton Street in the City of Smyrna,.has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the'City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931s pages-955-988) and under and by virtue of the adoption,of an ordinance introduced after the filing of a peti- tion with the Mayor and Council for such paving and.improvement, by a majority of,the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $369.26. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the'suthority of the same; That each abutting -Owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby.assessed the amount of =.the pro rata ,part+ of such owner of said sum of $369.26, to be determined by the amount of the frontage of such owner on said street,.and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount,of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of'the passage of the ordinance for said paving and improvement, and said lien is hereby declared from the data of said ordinance which was passed on the 23rd day of August, 1951. On motion by Councilman John Collier seconded by Councilman Stanley McCalla the following ordinance was unanimously adopted•: PICKENS STREET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of -the whole of Pickens Street.in the City, bf Smyrna, being a distance of approximately 450.5 lineal feet from the northern intersection of Pickens and Medlin Streets to the southern intersection of Pickens and Nichols Streets in 'the City of Smyrna, -has been completed pursuant to the Act of the General 4ssembly of 1931; embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988), and under.and by virtue of the adoption of an ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assess- 48 ment for the cost of such paving and improvement, and WHEREAS, the cost of such pavin and improvement to th© abutters as provided'in said Act, is 15*22-#81. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the authority of the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Abt, is hereby assessed the amount of the pro rats part of such owner,of on 'said street, and by the provisions+of `said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessment, determined under and by the.provisions of said Act, against the owner thereof, to date,back to the approval of the passage of the ordinance for said paving and improvement, and said lien is hereby declared from the date of said ordinance which was passed on the 23rd day of August, 1951. An ordinance was introduced by Councilman John Collier and seconded by Councilman Stanley McCalla providing that Hickory Hill Drive, in the City of Smyrna, shall be paved. Copy of said ordinancea= ttached to these minutes and made a part thereof. Move for adoption of sections 5, 6, and 7 of ordinance for the paving.of Hi.hkory Hill Drive by Councilman John Collier and second- ed by Councilman Stanley McCalla. Voted unanimous. An ordinance was introduced by Councilman John Collier End second- ed by Councilman Stanley McCalla providing that Smith Street, in the City of Smyrna, shall be paved. C©py of said ordinance attach- ed to these minutes and made a part thereof. Move for adoption of sections 5, 6, and 7 of ordinance for the pav- ing of Smith Street by Councilman John Collier seconded by Council --- man Stanley McCalla. Voted unanimous. Police committee chairman, John Collier reported that the Police Committee recommend that policeman Ethridge be given a 30 day dis- missal notice from the police force. Councilman reported that D. n.
