08-23-1951 Special MeetingA special meeting of the Mayor and Council was held at the City Hall
August 23, 1951 at 7:30 P.M. Mayor J. M. Gibson, presiding with the
following Councilmen present: H. L. McEntyre, C. W, Jones, Howard
Haines, Stanley McCalla and John Collier. Ralph Lewis, Jr., assistant -
to City Engineer present.
Purpose of meeting for the formal hearing of streets to be paved.
Pursuant to advertising as required by the Charter a public hearing
was held on the ordinance to pave Marston Street introduced by Council-
man John Collier and seconded by Howard Hames at the July 25, 1951
meeting of the Mayor and Council. After public hearing, motion was
made by Councilman John Collier and seconded by C. W, Jones that the
ordinance for the paving of Marston Street be passed as introduced.
Motion unanimously carried and such ordinance was adopted.
Pursuant to'advertising as required by the Charter a public hearing
wasrhe.ld on the ordinance to pave Nichols Street introduced by Council-
man John Collier and seconded by Stanley McCalla at the Au%itst 61 1951
meeting of the Mayor and Council. After public hearing, motion was
made by Councilman John Collier and seconded by Stanley McCalla that
the ordinance for,the paving of Nicholb Street be passed as introduced.
Motion unanimously carried and such ordinance was adopted.
Pursuant to advertising as required.by the Charter a public hearing
was held on the ordinance.to pave Pickens Street introduced by Council-
man John Collier and seconded by Councilman Howard Haines at the July
25, 1951 meeting of the Mayor and Council. After public hearing, motion
was made by Councilman John Collier and seconded by Stanley McCalla
that the ordinance for the paving of Pickens Street be passed as intro-
duced. Motion unanimously carried and such ordinance was adopted.
Pursuant to advertising as required by the Charter a public hearing
was held on the ordinance to pave Stephens Street introduced by Council-
man John Collier and seconded by Councilman Howard Haines at the July
25, 1951 meeting of the Mayor and Council. After public hearing, motion
was made by Councilman John Collier and seconded by Stanley McCalla that
the ordinance for the paving of Stephens Street be passed as introduced.
Motion unanimously carried and such ordinance was adopted.
Pursuant to advertising as required by the Charter a public hearing
was held on the ordinance to pave Grady Street introduced by Council-
man John Collier and seconded by Councilman Howard Haines at the July
25, 1951 meeting of the Mayor and Council. After public hearing,
with "'the objection of Mr. Mark Turner, Mayor ask MIr, Lewis, engineer,
to recheck this street as to majority of foot frontage wanting or not
wanting Grady Street paved.
Pursuant to advertising as required by the Charter a public hearing
was held on -the ordinance to pave Foster Street introduced by Council-
man John Collier and seconded by Councilman Stanley McCalla at the
August 6, 1951 meeting of the Mayor and Council. After public hearing
motion was made by Councilman John Collier and seconded by Stanley
McCalla that the ordingnce-for the paving of Stephens Street be passed
as introduced. Motion unanimously carried and such ordinance was a-
dopted.
Pursuant to advertising as required by the Charter a public hearing
was held on the ordinace to pave Havithorne Street introduced by Council-
man John Collier and seconded by Councilman Howard Haines at the July
25, 1951 meeting of the Mayor and Council. After public rearing,
motion was made by Councilman John Collier and Seconded by Councilman
Stanley McCalla that the ordinance for the paving of Havithorne Street
be passed as introduced. Ylotion unanimously carried and such ordinance
was adopted.
An ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley McCalla providing that West side Marston Street
in the City of Smyrna, shall be paved. Copy of said ordinance attach-
ed to these minutes and made a part thereof. `
Move for adoption of sections 5, 6 and 7 of*ordinance for the paving
of West side of Marston Street by Councilman John Collier seconded by
Stanley McCalla. Voted unanimous.
An ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley McCalla providing that Anderson Circle, in'.
the City of Smyrna, shall be paved. Copy of said ordinance attached
to these minutes and made a part thereof.
Move for adoption of sections 5, 6 and 7 of ordinance for the paving
of Anderson Circle by Councilman John Collier and seconded by Stanley
McCalla. Voted unanimous.
Mr. A. bT. Aiken appeared before the Council stating he was paying
business license which he felt was unfair.
After a discussion was held it was revealed through error Mr. Aiken
was not paying the full amount he should be paying to do the several
business he was engaged in. .A
Motion made by H. L. YcBntyre,yseconded: by Stanley McCalla to let
Mr. Aikens licenses remain as1%for the remainder of the year. Voted
unanimous.
Beer license refussed to applicant for a proposed club to be located
over Bt6p, Shop, Save Store on Atlanta Street.
Motion by Howard Hal-�qes seconded by John Collier to give Mayor authority
to have Southern T+anor Apts. disposal pump placed in sanitary condition
immediately by the owners of the apts. Voted unanimous.
Motion by Stanley McCalla seconded by John Collier that in considerg.tion
of B. L. Walker giving easement to go through his property that.city
grgde creek bed around Talker property. Voted unanimous.

THE MAYOR AND COUNCIL OF THE CITY OF SLMNA AUTHORIZING
THE PAVING OF ANDER.SON CIRCLE IN SAID CITY

NOTICE IS HERESY GIVEN:
1. That at a special meeting of the Mayor and Council of the City of
Smyrna, held at seven -thirty o'clock P. M. on Thursday, August 23, 1951, at the
City Hall, an ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley MoCalla, providing that Anderson Circle in the City of
Smyrna, shall be paved. Copy of said ordinance is hereto attached and made a
part hereof.
2. That the -street proposed to be paved in said proposed ordinance is
Anderson Circle in the City of Smyrna. Said proposed ordinance provides that
Anderson Circle in the City of Smyrna, being a distance of approximately 1,000
lineal feet from the northern intersection of Spring Street and Anderson Circle
in the City of'Smyrna, to the southern intersection of Anderson Circle and Corn
Road, be paved.
3. That said proposed ordinance provides that Anderson Circle in said
city, as above described, be paved in a uniform width of eighteen (18) feet of
asphalt paving with clay ound base, with one -and -one-half to two inches of No.
2 rock penetrated with 01 gallons of asphalt per square yard, choked with No.
1 stone and shot again with 0.25 gallons of asphalt per square yard and sealed
with No. 1 stone and properly rolled throughout operations•:
,�. That the estimated cost per front foot for such contemplated im-
provements as above described is $0.65 per front foot of property in the City of
Smyrna, abutting on ,gpn,.e,on the east and west sides thereof.
5. That it such contemplated improvements as herein described are
erected all persons owning property on Anderson Circle in said City,0 shall be
subject to a pro rata assessment of the cost of said improvements against their
properties.
6. That all persons -owning property fronting or abutting on said street
in the City of Smyrna, and all other persons interested in any way in subject
-matter., are hereby notified and directed to appear,at a meeting of the Mayor and
Council of the City of Smyrna, to be held on the 1st day of October 1951, at
seven -thirty -o'clock P. Mo in the City Hall of said City, then and there to make
any objections that they may desire to urge against the passage of the proposed
ordinance herein described, copy of which is hereto attached and made a part
hereof.

At a special meeting of the Mayor and Council. of Smyrna held at 7:30
o'clock P.M. on the 23rd day of August, 1951, at the City Hall, the following
ordinance was introduced by Councilman John Collier and seconded by Councilman
Stanley McCalla.
WHEREAS, Section 64 of the new charter of the City of Smyrna (Georgia
Laws 1931 - pages 982 and 983) which section has not been altered, amended or
repealed in any manner and is now in full force and effect, provides in part,
nthat no sidewalk, street, alley, or other place shall be paved, repaved, or
improved, until the passage of an ordinance authorizing the same, and no such
ordinance shall be passed unless the mayor and council shall have first been
petitioned in writing to pave, repave, or otherwise improve the same, by a
majority of the persons, companies, or corporations, for the owner or owners of
a majority of the front footage of abutting propertyi subject to assessment for
the cost of paving, repaving, or otherwise improving the sidewalk, street,
avenue, public; alley, public place or portion thereof proposed to be paved or
repaved; tr and
WHEREZ, at a special meeting of the Council held at 7:30 P. id. on the
23rd day of August 1951, a petition was presented to the Mayor and Council
signed by ten (10) property omers of the city residing on Anderson Circle in
said city, being a majority of the owners of property on linderson Circle, or
omning a majority of the front footage of property in the city abutting on
Anderson Circle; and
WHEREO, in said petition the Mayor and Council are requested to pass
an ordinance requiring the paving of Anderson Circle in the City of Smyrna, to
advertise the introduction of said ordinance and to mail notices of the same to
all persons owning property fronting on either side of Anderson Circle, to set
a date for hearing objections to such ordinance, to subsequently pass an assess-
ment ordinance giving the requisite statement to abutting owners on said street
and to do any and all things necessary as required by law and by the charter of
said city to legally accomplish the paving of said street;
NOW, THEREFME, be it ordained by the Mayor and Council of the City of
Smyrna, and it is hereby ordained by the authority of same:
1. That Anderson Circle in the City of Smyrna, being a distance of
approximately 1,000 lineal feet from the northern intersection of Anderson Circle
and Spring Street in the City of Smyrna, to the southern intersection of Anderson
Circle and Corn Road in the City of Smyrna, be paved in a uniform width of
eighteen (18) feet of asphalt paving with clay bound base, with one -and -one-half
to two inches of No. 2 rock penetrated with 0.75 gallons of asphalt per square
yard, choked with No. 1 stone and shot again with 0.25 gallons of asphalt per
square yard and sealed with No. 1 stone and properly rolled throughout operations,
2. That the Mayor of said City is authorized and empowered to engage
an engineer to prepare the proper plans and specifications of the above improve-
ments herein proposed to be made, and that said Mayor be authorized after legal
and proper advertising of same, to let a contract for and in behalf of the City
for the erection of such proposed improvements,
3.- That the Mayor and Council estimate the cost of such improvements
from the best information available at this time based on various discussions
with contractors and others having technical knowledge of the cost involved to
be approximately One & 30/100 ($1.30) Dollars per lineal foot of such improve-
ments and being as above set forth approximately 1,000 feet of paving to be
erected, the total estimated cost therefore for the complete ,job, being
$I,300.00. Such estimated costs as above set forth being 'estimated to be $0.65
per front foot of property in said city abutting on Anderson Circle, on the east
and west sides thereof.
lc. That when said improvements are completed an ordinance shall be
passed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as provided in Sec-
tion 66 et seq. of the new charter of said city (Georgia Laws 1931, page 983, et
seq,.).
5.. That before the passage of this ordinance a public hearing regarding
same shall be held at a meeting of said Mayor and Council; and it is hereby
ordered that such said public hearing shall be held before said Mayor and Council
on the 1st day of October, 1951, at seven -thirty o'clock P. M& That all property
ov+ners and other persons interested therein are directed and notified to appear
at such hearing and make any objection they may desire to urge against the
passage of this ordinance.
6. That pending the consideration of this ordinance by the Mayor and
Councils an advertisement shall be posted in three (3) public places in said
City, to -wit: the City Hall, the Post Office and the Bank of Smyrna, the City
Hall and Bank of Smyrna being located on L*Alanta Street in the City of Smyrna,
and the Post Office being located on West Spring Street in the City of Smyrna,
giving notice of the introduction and pendency of this ordinance. Such adver-
tisement shall state the name of the street to be improved and paved, the nature
of such contemplated improvements and the estimated cost per front foot of same.
Such advertisement shall further set forth that the property owners or others
interested are notified to appear at a meeting of the said Mayor and Council to
be held on the lst day of October, 1951, 'in the City Hal] of said City at seven -
thirty ofelock P. M., and make any objection that they may desire to urge
against the passage of this ordinance.

1. That at a regular meeting of the Mayor and Council of the City of
Smyrna, held at seven -thirty o'clock P. K. on Tuasday, September 4, 1951, at
the City Hall, an ordinance was introduced by Councilman John Collier and
seconded by Councilman Stanley 14cCalla, providing that a portion of Marston
Street in the City of Smyrna, shall be paved. Copy of said proposed ordinance
1 is hereto attached and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance is
Marston Sheet in the City of Smyrna. Said proposed ordinance provides that a
portion of Marston Street in the City of Smyrna, being a distance of approxi-
mately 400 lineal feet from the intersection of Marston Street and Gilbert
Street in a westerly direction to the right of way of the Western & Atlantic
Railroad in the City of Smyrna, be paved.
3. That said proposed ordinance provides that Marston Street in said
city, as above described, be paved in a uniform width of eighteen (18) feet of
asphalt paving with clay bound base, with one -and -one-half to two inches of No.
2 rock penetrated with 0.75 gallons of asphalt per square yard, choked with No.
1 stone and shot again with 0.25 gallons of asphalt per square yard and sealed
with No. 1 stone and properly rolled throughout operations.
4. That the estimated cost per front foot for such contemplated im-
provements as above described, is $0.65 per front foot of property in the City
