The regular meeting of the Mayor and Council was held at the City
Hall, August 6, 1951, 7:30 P. M. Mayor J. M. Gibson, presiding,
with the following Councilmen present: H. L. McEntyre, Howard
Hanes; Stanley TvIcCalla, C. W. Jones and John Collier, M. J. Hensley
City Engineer and Harold Willingham, City Attorney present.
Minutes of regular previous meeting and two special meetings read
and approved as read.
An ordinance introduced for the paving of Foster Street by Council-
man John Collier seconded by Stanley McCalla. Copy of said ordin-
ance fittached to these minutes and made a part thereof.
Move for adoption of section 5, 6 and 7 of ordinance for the paving
of Foster Street by John Collier seconded by Stanley McCalla.
Voted unanimous.
Motion by Stanley !McCalla seconded by John Collier to fullfill con-
tract accoring to origional specifications for the paving of Hamby
Street. Voted unanimous.
City Engineer, M. J. Hensley reported to the Council on the progress
and cost up to date on the Construction work now under way.
Motion by H. L. McEntyre seconded by Stanley McCalla to give $100.00
as an initial donation to the Kindergarten being sponsored by the Pre -
School Association and $20.00 monthly.�,_.Voted unanimous.
Howard Hermes reported pump repaired. Also need for traffic light at
Church and Atlanta Sts.
Motion by H. L. McEntyre seconded by John Collier to install signal
light at Church and Atlanta Sts. Voted unanimous.
Mr. Jones reported 18 fire registrations outside the city and 9 paid.
Mr. Jones resigned as chaiman of police committee. John Collier app-
ointed to•f ill this place.
Motion by Stanley McCalla seconded by Howard Hames to give police
committee authority to purchase a new police car, car to,�eh.alf black
and half white, and to get best trade in value on old police car
after Insurance company repairs old police car which was wrec}aed.
Voted unanimous.
Motion by Howard Hames seconded by Stanley McCalla to pay City Attorney
if of $175,000,00 Waterworks and Sewerage Revenue Anticipation Certifi-
cates, legal fee, $1,750.00. Voted unanimous.
Bills read by the Mayor. Motion by ii. L. McEntyre seconded by Howard
Hanes to pay bills as read. Voted unanimous.
Motion by John Collier seconded by H. L. McEntyre to pave sidewalk
on Atlanta St., from:_Dati.s Dept. Store to parking lot on Atlanta St.;
repair driveway back of Davis Dept. Store to depot on Spring St.,
voted unanimous.
Motion by John Collier seconded by H. L. McEntyre to round off
and lower curb at Atlanta and Spring St:, back of Davis Dept. Store.
Repair sidewalk on Atlanta Street from Texaco Station to Theatre.on
Sunset Ave. Voted unanimous.
Mayor Gibson appointed Howard McCollum, C. 71, Jones and Howard Hermes
to serve on committee to investigate needs for upkeep of the present
eater tank.
Motion by Howard Hames seconded by H. L. Mcrntyre authorizing Mayor
Gibson spending up to $150.00 to be used for cleaning off the old
cemetary located in the center of Smyrna. Voted uma.nimous.

THE PAVING OF FOSTER STREET IN SAID CITY

Notice is hereby given:
1. That at a regular meeting of the Mayor and Council of the City of
Smyrna, held'at seven -thirty o'clock P: M. on Monday, August 6, 1951, at the
City Hall, an ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley McCalla, providing that Foster Street in the City of
Smyrna, shall be paved. Copy of. said proposed ordinance is hereto attached
and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance is
;foster Street in the City of Smyrna. Said proposed ordinance provides that
Foster Street in the City of Smyrna, being a distance of approximately 400
lineal feet from the northern intersection of Foster.Street and Spring Street
to the end of Foster Street, which is a dead end, in the City of Smyrna, be
paved.
3.. That said proposed ordinance provides that Foster Street in said
City, as above described, be paved in a uniform width of fourteen (14) feet
of asphalt paving with clay bound base, with one--and-one-half to two inches of
No. 2 rock penetrated rui.th 0.75 gallons of asphalt per square yard, choked
with No. 1 stone and shot again with 0.25 gallons of asphalt per square yard
and sealed with No. 1 stone and properly rolled throughout operations.
4. That thepestimated cost per front foot for such contemplated
improvements as above described is W.65 per front foot of property in the City
of Smyrna, abutting on Foster Street, on the east and west sides thereof.
4 5. That if such contemplated improvements as herein described are
erected all persons owning property on Foster Street in said City, shall be
L subject to a pro rata assessment of the cost of said improvements against
their properties.
6. That all persons owning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way in
subject matter, are hereby notified and directed to appear at a meeting of
the Mayor and Council of the City of Smyrna, to be held on the 23rd day of
August, 1951, at seven -thirty o'clock P. i. in the City Hall of said City,
'then and there to make any objections that they may desire to urge against the
passage of the proposed ordinance herein described, copy of which is hereto
attached and made a part hereof.

At a regular meeting of the Mayor and Council of Smyr is held at seven -
thirty o'clock P. M. on the 6th day of August, 1951, at the City Hall, the
following ordinance was introduced by Councilman John Collier and seconded by
Councilman Stanley McCalla,
IMMEAS, Section 64 of the new charter of the City of Smyrna (Georgia
Laws 1931 - pages 982 and 983) which section has not been altered, amended or
repealed in any manner and is now in full force and effect, provides in part,
"that no sidewalk, street, alley, or other place,', shall be paved, repaved, or
improved, until the mayor and council shall have.first been petitioned in
writing to pave, repave, or otherwise improve the same, by a majority of the
persons, companies, or corporat,ions,� or the owner or owners of a majority of
the front footage of abutting property' subject to assessment for the cost of
paving, repaving, or otherwise improving the sidewalk, street, avenue, public
alley, public place or portion thereof proposed to&be paved or repaved;" and
WHEREAS, at a special meeting of the Council held at seven -thirty P. M.
an the 6th day of August, 1951, a petition was presented to the Mayor and
Council signed.by five (5) property owners of the city residing on Foster
Street in said City, being a majority of the owners of property on Foster
Street, or owning a majority of the front footage of property in the City, abut-
ting on Foster Street; and
MEREAS, in said petition the Mayor and Council are requested to pass
an ordinance requiring the paving of Foster Street in the City of SmFM, to
advertise the introduction of said ordinance and to mail notices of the same
to all persons owning property fronting on either side of Foster Street, to set
a date for hearing objections to such ordinance, to subsequently pass an
assessment ordinance giving the requisite statement to abutting owners on said
street and to do any and all things necessary as required by law and by the
charter of said city to legally accomplish the paving of said street;
NOW, THEREFORE, be it ordained by the Mayor and Council of the City of
Smyrna., and it is hereby ordained by authority of same:
1. That Foster Street in the City of Smyrna, being a distance of 1
approximately 400 lineal feet from the northern intersection of Foster Street
and Spring Street to the end of Foster Street, which is a dead end, in the
City of Smyrna, be paved in a uniform width of fourteen (14) feet of asphalt
paving with clay bound base, with one -and -one-half to two inches of No. 2 rock
penetrated with 0.75 gallons of asphalt per square yard, choked with No. 1
stone and shot again with'0.25 gallons of asphalt per square yard and sealed
with No. 1 stone and properly rolled throughout operations.
2. That the Mayor of said City is authorized and empowered to engage
an engineer to prepare the proper plans and specifications of the above im-
provements herein proposed to be made, and that said Mayor be authorized after
legal and proper advertising of same, to let a contract for and in behalf of
the City for the erection of such proposed improvements.
3. That the Mayor and Council estimate the cost of such improvements
from the best information available at this time based on various discussions
with contractors and others having technical knowledge of the cost involved
to'be'approximately One & 30/100 MOO Dollars per lineal foot of such
improvements and being as above set forth approximately 400 feet of paving to
be erected, the total estimated cost therefore for the complete job, being
$520.00: Such estimated costs as above set forth being estimated to be $0.65
per front foot of property in said City abutting on Foster Street, on the east
and west sides thereof.
4. That when said improvements are completed an ordinance shall be
passed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as provided in
Section 66,et seq. of the new charter of said City (Georgia Laws 1931, page 983,,
et seq.).

5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said Mayor and Council; and
it is hereby ordered that such said public hearing shall be held before
said Mayor and Council on the 23rd day of August, 1951, at seven -thirty
o'clock P. M, That all property owners and other persons interested therein
are directed and notified to appear at such hearing and make any objection
they may desire to urge against the passage of this ordinance.
6. That pending the consideration of this ordinance by the Mayor
and Council, an advertisement shall be posted in three (3) public places in
said City, to -wit: the City Hall, the Post Office and the Bank of Smyrna,
the City Hall and Bank of Smyrna being located on Atlanta Street in the City
of Smyrna, and the Post Office being located on West Spring Street in the City
of Smyrna, giving notice of the introduction and pendency of this ordinance.
Such advertisement shall state the name of tho street to be improved and paved,
the nature of such contemplated improvements and the estimated cost per front
foot of same. Such advertisement shall further set forth that the property
owners or others interested are notified to appear at a meeting of the said

Notice is hereby given:
1. That at a regular meeting of the Mayor and Council of the City of
Smyrna, held at seven -thirty o'clock P. M. on Monday, August 6, 1951, at the
City Hall, an ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley McCalla, providing that Nichols Street in the City of
Smyrna, shall be paved. Copy of said proposed ordinance is hereto attached
and made a part hereof.

Nichols Street in the City of Smyrna. Said proposed ordinance provides that

asphalt paving with clay bound base, with one -and -one-half to two inches of
No. 2 rock penetrated with 0.75 gallons of asphalt per square yard, choked with
No. 1 stone and shot again with 0.25 gallons of asphalt per square yard and
sealed with No.s1 stone and properly rolled throughout operations.
4. That the estimated cost per front foot for such contemplated
improvements as above described, is $0.65 per front foot of property in the
City of Smyrna, abutting on Nichols Street, on the north and south sides
thereof.

WHEREAS, Section 64 of the new charter of the City of Smyrna (Georgia

Council signed by five (5) property owners of the City residing on Nichols
Street in said City, being a majority of the owners of property on Nichols
Street, or ovating a majority of the front footage of property in the City abut-
ting on Nichols Street; and
WHEREAS, in said petition the Mayor and Council are requested to pass
an ordinance requiring the paving of Nichols Street in the 'City of Smyrna, to
advertise the introduction of said ordinance and to mail notices of the same
to all persons owning property fronting on either side of Nichols Street, to
set a date for hearing objections to such ordinance, to subsequently pass an
assessment ordinance giving the requisite statement to abutting owners on said
street and to do any and all things necessary as required by law and by the
charter of said City to legally accomplish the paving of said street;
NOW, THEREFORE, be it ordained by the Mayor and Council of the City of

choked with No. 1 stone and shot again with 0.25 gallons of asphalt per square
yard and sealed with No. 1 stone and properly rolled throughout operations.
2. That the Mayor of said City is authorized and empowered to engage
