07-25-1951 Special Meeting (2)At a special meeting of the Mayor and Council of bm prna held at seven o'clock P, M. on Wednesday, July 25, 1951, at the City Hall, the following ordinance was introduced by Councilman John Collier and seconded by Councilman Howard Hames. WHEREAS, Section 64 of the new charter of the City of Smyrna (Georgia Laws 1931 - pages 982 and 983) which section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in part, "that no sidewalk, street, alley, or other place shall be paved, repaved, or improved, until the passage of an ordinance authorizing the same, and no such ordinance shall be passed unless the mayor and council shall have first been petitioned in writing to pave, repave, or otherwise improve the same, by a majority of the persons, companies, or corporations, 'or the owner or owners of a majority of the front footage of abutting property' subject to assess- ment for the cost of paving, repaving, or otherwise improving the sidewalk, street, avenue, public alley, public place or portion thereof proposed to be paved or repaved;" and WHEREAS, at a special meeting of the Council held at seven o'clock P. M, on the 25th day of July, 1951, a petition was presented to the Mayor and signed by four (4) property owners of the city residing on Grady Street in said City, being a majority of the owners of property on Grady Street, or owning a majority of the front footage of property in the City abutting on Grady Street; and WHEREAS, in said petition the Mayor and Council are requested to pass an ordinance requiring the paving of Grady Street in the City of Smyrna,,to advertise the introduction of said ordinance and to mail notices of the same to all persons owning property fronting on either side of Grady Street, to set a date for hearing objections to such ordinance, to subsequently pass an assessment ordinance giving the requisite statement to abutting owners on said street and to do any and all things necessary as required by law and by the charter of said city to legally accomplish the paving of said street; NOR.. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by authority of same: 1. That Grady Street in the City of Smyrna, being a distance of approximately 370 lineal feet from the southern intersection of Powder Springs Street with Grady Street to the northern intersection of Grady Street with the city limits, be paved in a uniform width of sixteen (16) feet of asphalt Paving with clay bound base, with one -and -one-half to two inches of No. 2 rock penetrated with 0.75 gallons of asphalt per square yard, choked with No. 1 stone and shot again with 0,25 gallons of asphalt per square yard and sealed with No. 1 stone and properly rolled throughout operations. 2. That the Mayor of said City is authorized and empowered to engage an engineer to prepare the proper plans and specifications of the above improvements herein proposed to be made, and that said Mayor be authorized after legal and proper advertising of same, to let a contract for and in behalf of the City for the erection of such proposed improvements. 3. That the Mayor and Council estimate the cost of such improvements fran the best information available at this time based on various discussions with contractors and others having technical knowledge of the cost involved to be approximately $1.30 per lineal foot of such improvements and being as above set forth approximately 370 feet of paving to be erected, the total estimated cost therefore for the complete job, being $481.00. Such estimated costs as above set forth being estimated to, be $0,65 per front foot of property in said city abutting on Grady Street, on the east and west sides thereof. 4. That when said improvements are completed an ordinance shall be passed assessing the total cost of same including engineering and supervision expenses against the owners of the property on said street, as provided in Section 66, et seq. of the new charter of said City (Georgia Laws 1931, page 983, et seq.). -a, - "oI rt , 5. That before the passage of this ordinance a public hearing regarding same shall be held at a meeting of said mayor and Council; ,and it is hereby ordered that such :said public hearing shall be held before said Mayor and Council on the 23rd'day of August, 1951, at se en -thirty ot.clock P. M: That all property owners and other persons interested therein are directed and notified to appear at such hearing and make any objection. they may desire to urge against the passage of this drdinance. 6. That pending the consideration of this ordinance by the Mayor and Council, an advertisement shall be posted in three (3) public,places in said City, to -wit: the City Hall, the Post Office and the Bank of Smyrna, the City Hall and Bank of Smyrna being located on Atlanta Street in the City of Smyrna, and the Post Office being located on West Spring Street in the City of Smyrna, giving notice of the introduction and pendency,of this ordinance. Said proposed ordinance_prorides that Pickens Street in the City of Smyrna, being a distance of approx3.n:ately 459 lineal feet from the northern intersection of Pickens and Medlin Streets to the southern intersection of Pickens and Nichols Streets, in the City of Smyrna, be paved, 3. Copy of said ordinance is hereto attached and made a part hereof. 2. That the street proposed to be paved in said proposed ordinance is Stephens Street in the City of Smyrna. Copy of said ordinance is hereto attached and made a part hereof. 2. That the street proposed to be paved in said proposed ordinance is Hawthorne Street in the City of Smyrna. Said proposed ordinance provides that Hawthorne Street in the City of Smyrna, being a distance,of approximately 1,735 lineal feet from the western intersection of Hawthorne Street with the N. C. and St. L. Railway to the eastern intersection of Hawthorne Street with the city limits in -the City of Smyrna, be paved. 3. That said proposed ordinance provides that Hawthorne Street in said City, as above described, be paved in a uniform width of thirty (30) feet of asphalt paving v&th clay bound base, with one -and -one-half to two inches of No. 2 rock penetrated with 0.75 gallons of asphalt per squire yard choked with No.1 stone and shot again with 0.25 gallons of asphalt per square yard and sealed with No. 1 stone and properly rolled throughout operations. 4. An ordinance introduced for the paving of Foster Street by Council- man John Collier seconded by Stanley McCalla. Copy of said ordin- ance fittached to these minutes and made a part thereof. Move for adoption of section 5, 6 and 7 of ordinance for the paving of Foster Street by John Collier seconded by Stanley McCalla. Voted unanimous. Motion by Stanley !McCalla seconded by John Collier to fullfill con- tract accoring to origional specifications for the paving of Hamby Street. Voted unanimous. City Engineer, M. J. Hensley reported to the Council on the progress and cost up to date on the Construction work now under way. Motion by H. L. McEntyre seconded by Stanley McCalla to give $100.00 as an initial donation to the Kindergarten being sponsored by the Pre - School Association and $20.00 monthly.�,_.Voted unanimous. Howard Hermes reported pump repaired. Also need for traffic light at Church and Atlanta Sts. Motion by H. L. McEntyre seconded by John Collier to install signal light at Church and Atlanta Sts. Voted unanimous. Mr. Jones reported 18 fire registrations outside the city and 9 paid. Mr. Jones resigned as chaiman of police committee. John Collier app- ointed to•f ill this place. Motion by Stanley McCalla seconded by Howard Hames to give police committee authority to purchase a new police car, car to,�eh.alf black and half white, and to get best trade in value on old police car after Insurance company repairs old police car which was wrec}aed. Voted unanimous. Motion by Howard Hames seconded by Stanley McCalla to pay City Attorney if of $175,000,00 Waterworks and Sewerage Revenue Anticipation Certifi- cates, legal fee, $1,750.00.
