07-25-1951 Special Meetingno �r A special meeting of the Mayor and Council was held at the City Hall, July 25, 1951, 7:30 P. M. Mayor J. M. Gibson presiding, with the following Councilmen present; S. H. McCalla, Howard -Hermes and John Collier. City Engineer, M. J. Hensley and City Attorney, Harold Willingham present. I . Purpose of meeting for hearing on paving of Hunter Street. Motion by Stanley'P,RcCalla seconded by John Collier to pay County for paving of streets from General Fund. Voted unanimous. An ordinance was introduced by Councilman John,Collier and sec- onded by Councilman S. H. McCalla providing that Marston St., from Gilbert St., to dead end of Marston St., in the City of Smyrna, shall•be paved. Copy of said ordinance.is attached to these minutes and made a part thereof. Move for adoption .of sections 5, 6, and 7 of ordinance for the paving of Marston Street by John Collier seconded by Stanley Me - Calla. Voted unanimous. Voted unanimous. w An ordinate was introduced by Councilman John Collier, and sec- onded by Councilman S. H. McCalla providii that Stephens St., in the City of Smyrna, shall be paved. Copy of said ordinance attached to these minutes and made a part thereof. Motion by John Collier seconded by Stanley McCally to have County resurface the following streets; Mimosa, Highland, iNhitefield, and Roswell Streets. Voted unanimous. Councilman McCalla recommend to the council that minimum standard of street paving be adopted by the council for the paving of streets in the city. Pursuant to advertising as required by the Charter a public hear- ing was held on the.ordinance to pave Hunter Street introduced by Councilman John Collier and seconded by Councilman S. H. McCalla at the July 2, 1951 meeting of the Mayor and Council. After public hearing, motion was made by Councilman John Collier and seconded by S. H. McCalla that the ordinance for the paving of Huhter Street be passed as introduced. I a 3 NOTICE OF INTRODUCTION AND PENDENCY OF ORDINANCE BEFORE THE 1,AYOR AND COUNCIL OF THE CITY OF SMYRNA AUTHORIZING THE PAVING OF MARSTON STREET IN SAID CITY GEORGIA, COBB COUNTY: TO WHOM IT MAY CONCERN: Notice is hereby given: 1. That at a special meeting of the Mayor and Council of the City of Smyrna, held at seven o'clock P. 1M. on Wednesday, July 25, 1951, at the City Hall, an ordinance was introduced by Councilman John Collier and seconded by Councilman Howard Hames, providing that Marston Street in the City of Smyrna, shall be paved. Copy of said ordinance is hereto attached and made a part hereof. 2. That the street proposed to be paved in said proposed ordinance is Marston Street in the City of Smyrna. Said proposed ordinance provides that Xarston Street in said City of Smyrna., being a distance of approximately 441 lineal feet from the ea stern intersection of Marston Street with Gilbert Street to the end of Marston Street, which is a dead end, in the City of .Smyrna, be paved. 3- That said proposed ordinance provides that Marston Street in said City, as above described, be paved in a uniform width of eighteen (18) feet of asphalt paving with clay bound base, with one -and -one-half to two inches of No. 2 rock penetrated with 0.75 gallons of asphalt per square yard, choked with No. 1 stone and shot again with 0.25 gallons of asphalt per square yard and sealed veLth No. 1 stone and properly rolled throughout opera- tions. 4# That the estimated cost per front foot for such contemplated improvements as above described,i.s $0.65 Per front foot of property in the City of Smyrna, abutting on Marston Street,.on the north and south sides thereof. 5. That if such contemplated improvements as herein described are erected all persons owning property on Marston Street in said City, shall be subject to a pro rata assessment of the cost of said improvements against their properties. 6. That all persons owning property fronting or abutting on said street in the City of Smyrna, and all other persons interested in any way in subject matter, are hereby notified and directed to appear at a meeting of the Mayor and Council of the City of Smyrna, to be held on the 23rd day of August, 1951, at seven -thirty o'clock P. M. in the City Hall of said City, then and there to make any objections that they may desire to urge against the passage of the proposed ordinance herein described, copy of which is hereto attached and made a part hereof. SEAS, Section 64 of the new charter of the City of Smyrna (Georgia Laws 1931 - pages 982 and 983) which section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in part, "that no sidewalk,street, alley, or other place shall be paved, repaved, or improved, until the passage of an ordinance authorizing the same, and no L such ordinance shall be passed unless the mayor and council shall have first been petitioned in writing to pave, repave, or otherwise improve the same,�by a majority of the persons, companies, or corporations, !or the owner or owners of a majority of the front footage of abutting property' subject to assessment for the cost of paving, repaving, or otherwise improving the sidewalk, street avenue, public alley, public place or portion thereof proposed to be paved or repaved;'f and WHEREAS, at a special meeting of the Council held at seven o'clock P.M. on the 25th day of July, 1951, a petition was prosanted to the Mayor and Council signed by eleven (11) property owners of the City residing on Marston Street in said City, being a majority of the oviners of property on Marston Street, or owning a majority of the front footage of property in the City abutting on Marston Street; and WHEREAS, in said petition the Mayor and Council are requested to pass an crdinance regairi.ng the paving of Marston Street in the City of Smyrna, to advertise the introduction of said ordinance and to mail notices of the same to all persons owning property fronting on either side of Marston Street, to set a date for hearing objections to such ordinance, to subsequently pass an assessment ordinance giving the requisite statement to abutting owners on said street and to do any and all things necessary as required by law and by the charter of said city to legally accomplish the paving of said street; NOW, THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by authority of same: 1. That Marston Street in the City of Smyrna, being a distance of approximately 441 lineal feet from the eastern intersection of Marston and Gilbert Streets to the end of Marston Street, which is a dead end, in the City of Smyrna, be paved.in a uniform width of eighteen (18) feet of asphalt paving with clay bound base, with one -and --one-half to two inches of No. 2 rock penetrated with 0,75 gallons of asphalt per square yard, choked with No.l stone and shot again with 0.25 gallons of asphalt per square yard and sealed with No. 1 stone and properly rolled throughout operations. 2. That the Ilayor of said City is authorized and empowered to engage an engineer to prepare the proper plans and specifications of the above improvements herein proposed to be made, and that said Mayor be authorized after legal and proper advert_�ing of sa.ma, to let a contra -It for and in behalf of the City for the erectioli of such proposed Laprovements. 3. That the Mayor and Council estimate the cost of such improvements from the best information availabl at this time based on various discussions with contractors and others hay_rg `'oohnicai kn:mrledge of the cost involved to be approximately One & 30/100 (1,:;0) Dollars per lineal foot of s�.ch im- provements and being as above set forth approximately Ohl feet of paving to be erected, the total estimated cost therefore for the complete job, being $573.30. Such estimated costs as above set forth.being estimated to be $$0.65 per front foot of property in said city abutting on Marston Street, on the north and south sides thereof. 4. That when said improvements are completed an ordinance shall be passed assessing the total cost of same including engineering and supervision expenses against the owners of the property on said street,'as provided in Section 66, et seq. of the new charter of said city ( Georgia Laws 1931, page 983, et seq.). - 1 - 5. That before the passage of this ordinance a public hearing regarding same shall be held at a meeting of said mayor and Council; and it is hereby ordered that such said public hearing shall be held before said Mayor and Council on the 23rd day of August, 1951, at seven -thirty o'clock P. M. That all property owners and other persons interested therein are directed and notified to appear at such hearing and make any objection they may desire to urge against the passage of this ordinance. 6. That pending the consideration of this ordinance by the Mayor and Council, an advertisement shall be posted in three (3) public places in said City, to -wit: the City Hall, the Post Office and the Bank of Smyrna, the City Hall and Bank of Smyrna being located on Atlanta Street in the City of Smyrna, and the Post Office being located on West Spring Street in the City of Smyrna, giving notice of the introduction and pendency of this ordinance. Such advertisement shall state the name of thu street to be improved and paved, the nature of such contemplated improvements and the estimated cost per front foot of same. M. on Wednesday, July 25, 1951, at the City Mall, an ordinance was introduced by Councilman John Collier and seconded by Councilman Howard Hames, providing that Grady Street in the City of Smyrna, shall be paved.
