07-02-1951 Regular MeetingThe regular meeting of the Mayor and Council was held at the City
Hall, July 2, 1951, 7: 30 P. M. r.Tayor J. M, Gibson presiding, with
the following Councilmen present: Howard Hanes, C. W. Jones, H. L.
McEntyre, S. H. McCalla and John Collier. City Engineer M. J. Hensley
and City Attorney Harold Willingham present.
Minutes of previous regular meeting and two special meetings read and
approved as read.
An ordinance was introduced by Councilman John Collier and seconded
by Souncilman Stanley McCalla providing that Hunter Street in the City
of Smyrna, shall be paved. Copy of said ordinance is hereto attached
and made a part hereof these minutes.
Move for adoption of sections 5, 6 and 7 of ordinance for the paving
of Hunter Street by John Collier seconded by Stanley McCalla. Voted
unanimous.
Chief Walraven reported to the Council on the lot of H. J. Slate,
Foster Street as resembling a junk yard. Motion by Howard Hanes,
seconded by Stanley McCalla that Mr. Slate be notified to remove
all rubbish and clean up said premises. Voted unanimous.
Mayor Gibson appointed Councilman Jones and Councilman Collier to
investigate as to the possibility of using grounds in rear of Texaco
Station and Bob's Tavern as parking area.
Bills read by Mayor Gibson. Motion by Howard Hanes seconded by John
Collier to pay current bills due as read by Mayor. Voted unanimous.
Discussion of installation of three (3) storm sewers to solve water
problem on Concord Road, costing $918.00. Mr. Bennett of Bennett
any agrees to pay $318,00 if City would pay $600.00 for
t9e installation of the sewers.
Motion by Stanley McCalla seconded by John Collier to accept Mr.
Bennetts offer to pay $318.00 and city pay $600.00 for storm sewers
to be installed on Concord Road, provided this does not interfere
with sewer work. Voted unanimous.
Motion by Stanley McCalla seconded by Howard Hanes to purchase 33
acres of land ajoining present dumping grounds from H %0. Bray for
$1750.00 (2 down payment and 2 to be paid in December from General
Fund). Voted unanimous.
Motion by Howard Hanes seconded by John Collier that: both sides of
West Spring Street from traffic light to Post Office be yellow line,
allowing "No Parking." Voted unanimous.
Motion by C. W. Jones seconded by Stanley McCalla to give G. B. 's
Place one Parking -place from 7:00 A• M. to 9:00 A. M. and 5:00 P. M.
to 8:00 P. M., for 10 minutes parking on right hand side Spring St.,
coming from R. R. to Atlanta Street. Full time parking remainder of
day. Voted unanimous.
Motion by C. W. Jones seconded by John Collier to give two (2) places
10 minutes parking in front of Smyrna Dry Cleaners and Bobts Tavern.
Voting for Co W. Jones, John Collier, Howard Hanes. Voting against
Stanley McCalla and H. L. McEntyre. Vetoed by Mayor. Veto attached
to these minutes and made a part thereof. Motion not carried.
Councilman Jones, chmn.,Fire committee recommend a call fee of a mini-
mum of $25.00 for fire calls outside the city limits. Motion by
H. L. McEntyre seconded by Stanley McCalla to place a $25.00 call fee
for fire call answered outside the city by the city fire truck. Voted
unanimous.
The council agreeded that for the months July, August and September
r the policemen be allowed to wear light weight trousers, dress shirts
and black ties. c
Motion by Stanley McCalla seconded by John Collier to increase the
mayor's salary for the remainder of 1951, $75.00, total salary $135.00
per month. 'Voted unanimous.

Motion by John Collier seconded by Howard Hames to reactivate
contract between City of Smyrna and (formerly Grover and Alice
Patterson) J. M. Gibso4s and pumps on hand be overhauled and
installed and City of Smyrna to use water.
On motion by Councilman ��, , seconded by Councilman
the following ordinance was unanimously adopted:
AN ORDINANCE PROVIDING FOR FIRE PREVENTION AND
PROTECTION IN CONNECTION WITH HAZARDOUS MATERIALS
AND PROCESSES.
Be it ordained by the Mayor and Council of the City of Smyrna, and it is
hereby ordained by the authority of same:
Section 1.
Section 2.
Adoption of Fire Prevention Code.
There is hereby adopted by the City of Smyrna for the purpose of
providing for fireprevention and protection in connection with
hazardous materials and processes, that certain code know as the
Fire Prevention Code, Abbreviated Edition, recommended by the
National Board of Fire Underwriters of New York, being particu-
larly the 1949 edition thereof, save and except such portions
as are hereinafter deleted, modified ors amended, of which not
less than three (3) copies have been and now are filed in the
office of -the Clerk of City of Smyrna and the same are hereby
adopted and incorporated as fully as if set out at length
herein, and from the date on which this ordinance shall take
effect; the provisions thereof shall be controlling within the
`limits of the City of Smyrna.
Definitiona.
Wherever the word "Muni.cipality'is used in said code, it shall
be held to mean the City°of Smyrna,
Section 3. Establishment' of Limits -in which Bulk Storage of Flamable Liquids
is Prohibited: v
(1) the limits, in Section 312 of said code in which bulk storage
of flammable 'liquids in outsi:cle-aboveground tanks is.prohibited,
are hereby established as follows: Within two hundred (2001)
feet on either side of Atlanta Street in said City.
Section 4* Validity.
The invalidity of any section or provision of this ordinance or
of the code hereby adopted shall not invalidate other sections
or provisions thereof.
Section 5. Inconsistent Ordinances -Repealed.
Ordinances or parts thereof in force at -the time that this
ordinance shall take effect and inconsistent herewith, are
hereby repealed.
Section 6. Date of Effect.

its approval as required by law.

AUTHORIZING THE PAVING OF HUNTER STREET IN SAID CITY

1. That at a regular meeting of the Iayor and Council of the City
of Smyrna, held at seven -thirty o'clock P. H. on .-ionday.. July 2, 1951, at the
City Hall, an ordinance was introduced by Councilman John Collier and seconded
by Councilman Stanley icCalla, providing that Hunter Street in the City of
Smyrna, shall be paved. Copy of said ordinance is hereto attached and made a
part hereof.

5. That if such contemplated improvements as herein described are
erected all persons owning property on Hunter Street in said City, shall be
subject to a pro rata assessment of the cost of said improvements against their

6. That all persons owning property fronting or abutting on said
st:^eet in the City of Smyrna, and all other persons interested in any way in
subject matter, are hereby notified and directed to appear at a meeting of the

At a regular meeting of the Mayor and Council of Smyrna held at
700 P. M. on the 2nd day of July, 1951, at the City Hall, the following
ordinance was introduced by Councilman John Collier and seconded by Council-
man Stanley McCalla.
WHEREAS, Section 64 of the new charter of the City of Smyrna
(Georgia Laws 1931 - pages 982 and 983) which section has not been altered,
amended or repealed in any manner and is now in full force and effect,
provides in part, "that no sidewalk, street, alley, or other place shall be
paved, repaved, or improved, until the passage of an ordinance authorizing
the same, and no such ordinance shall be passed unless the mayor and council
shall have first been petitioned in writing to pave, repave, or otherwise
improve the same, by a majority of the persons, companies, or corporations,
'or the owner or owners of a majority of the front footage of abutting
property' subject to assessment for the cost of paving, repaving, or other-
wise improving the sidewalk, street, avenue, public alley, public place or
portion thereof proposed to be paved or repaved;" and
WHEREAS, at a special meeting of the Council held at 7:30 P. M. on
the 2nd day of July, 1951, a petition was presented to the Mayor and Council
signed by four (4) property owners of the city residing on Hunter Street in
said city, being a majority of the owners of property on Hunter Street, or
owning a majority of the front footage of property in the city abutting on
Hunter Street; and
WHEREAS, in said petition the Mayor and Council are requested to
pass an ordinance requiring the paving of Hunter Street in the City of Smyrna,
to advertise the introduction of said ordinance and to mail notices of the same
to all persons owning property fronting on either side of Hunter Street, to set
a date for hearing objections to such ordinance, to subsequently pass an assess-
ment ordinance giving the requisite statement to abutting 6wners on said street
and to do any and all things.necessary as required by law ind by the charter
of said city to legally accomplish the paving of said street;
NOW, THEREFORE, be it ordained by the Mayor and Council of the City
of Smyrna, and it is hereby ordained by authority of same:
I. That Hunter Street in the City of Smyrna, being a distance of
approximately 650 lineal feet from the eastern intersection of Hunter Street
and Dunn Street in the City of Smyrna, to the western intersection of Hunter
Street and Concord Road in the City of Smyrna, be paved in a uniform width of
eighteen (18) feet of aepbaalt paving with four (4) inch clay bound base, with
two (2) inches of prime and double surface treatment.
2. That the'Mayor of said City is authorized and empowered to engage
an engineer to prepare the proper plans and specifications of the above improve-
ments herein proposed to be made, and that said Mayor be authorized after legal
and proper advertising of same, to let a contract for and in behalf of the City
for the erection of such proposed improvements.
3• That the Mayor and Council estimate the cost of such Improve-
ments from the best information available at this time based on various discus-
sions with contractors and others having tedhnical knowledge of the cost
involved to be approximately Throo & 00/100 ($3.00) Dollars per lineal foot of
such improvements and being as above set forth approximately 650 feet of paving
to be erected, the total estimated cost therefore for the complete job being
$1,950.00. Such estimated costs as above set forth being estimated to be $1.50
per front foot of property in said city abutting on Hunter Street, on the north
and south sides'thereof.
4. That when said improvements are completed an ordinance shall be
Passed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as provided in
Section 66 et seq. of the new charter of said city (Georgia Laws 1931, page 983,
et seq.) .
5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said Mayor and Council; and it is

the City Hall and Bank of Smyrna being located on Atlanta Street in the City
of Smyrna, and the Post Office being located on West Spring Street in the City
of Smyrna; giving notice of the introduction and pendency of this ordinance

Gentlemen; I think the Police Committee is'doing a nice
job and their recommendations to help solve some of the
traffic problems are very fine but I cannot agree to keep
Atlanta Street open with no parking and our merchants
paging business licenses to do business in our City. I
have discussed fifteen minute parking space from Smyrna
Cafeteria to Bobs Tavern, which gives us a three car
parking space and this seems to satisfy the mwohants.
Therefore, I am compelled to v to the action of the
Council in this parking area I July 2 at the regular
Council Meeting.
