05-07-1951 Regular Meeting (2)At a regular meeting of the Mayor and Council of Smyrna held at
7:00 P. M, on the 7th day of May, 1951, at the City Hall., tho folloring
ordinance was introduced by Councilman P. P. Shaw and seconded by Council-
man H. L. McEntyre.
WHEREAS, Section 64 of the new charter of the City of Smyrna
(Georgia Laws 1931 - pages 982 and 983) which section has not been altered,
amended or repealed in any manner and is now in full force and effect,
provides in part, '?that no sidewalk, street, alley, or other place shall be
paved, repaved, or improved, until the passage of an ordinance authorizing
the same, and no such ordinance shall be passed unless the mayor and council
shall have first been petitioned in writing to pave, repave, or otherwise
improve the same, by a majority of the persons, companies, or corporations,
for the owner or owners of a majority of the front footage of abutting
property' subject to assessment for the cost of paving, repaving, or other-
wise improving the sidewalk, street, avenue, public alley, public place or
portion thereof proposed to be paved or repaved;I; and
WHEREAS, at a special. meeting of the Council held at 7:00 P. M-
on the 7th day of May, 1951, a petition was presented to the Mayor and
Council signed by twenty (2Q) property owners of the city residing on Gilbert
Street in said city, being a majority of the owners of the property on Gil-
bert Street, or owning a majority of the front footage of property in the
city abutting on Gilbert Street; and
WHEREAS, in said petition the Mayor and Council are requested to
pass an ordinance requiring the paving of Gilbert Street in the City of
Smyrna, to advertise the introduction of said ordinance and to mail notices
of the same to all persons owning property fronting on either side of
Gilbert Street, to set a date for hearing objections to such ordinance, to
subsequently pass an assessment ordinance giving the requisite statement to
abutting owners on said street and to do any and all things necessary as
required by law and by the charter of said city to legally accomplish the
paving of said street;
NOiV THEREFO?,, be it ordained by the Mayor and Council of the
City of Smyrna, and it is hereby ordained by authority of same:
1. That Gilbert Street in the City of Smyrna, being a distance of
approximately 1,785 lineal feet from the southern intersection of Gilbert
Street and Roswell Street in the City of SWna, to the northern intersection
of GilMert'Street and Hawthorne Street in the City of Smyrna, be paved in a
uniform width of sixteen (16) feet of asphalt paving with four (4) inch clay
bound base, with two (2) inches of prime and double surface treatment.
2. That the Mayor of said City is authorized and empowered to
engage an engineer to prep4re the proper plans and specifications of the
above improvements herein proposed to be made, and that said Mayor be
authorized after legal and proper advertising of same, to let a contract
for and in behalf of the City for the erection of such proposed improvements.
3. That the Mayor and Council estimate the cost of such improve-
ments from the best information available at this time based on variolas
discussions with contractors and others having technical knowledge of the
cost involved to be approximately Two & 70A00 (w2,70) Dollars per lineal
foot of such improvements and being as above set forth approximately 1,785
feet of paving to be erected, the total estimated cost therefore for the
complete job, being t4,819.50. Such estimated costs as above set forth
being estimated to be v1.35 per front foot of property in said city abutting
on Gilbert Street, on the east and west sides thereof. t
4. That when said improvements are completed an ordinance shall
be passed assessing the total cost of sane including engineering and super-
vision expenses against the owners of the property on said street, as
provided in Section 66 et seq. of the new charter of said city (Georgia Laws
1931, page 983, et seq.).
5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said mayor and Council; and
it is hereby ordered that such said public hearing shall be held before
said Mayor and Council on the 4th day of June, 1951, at seven o'clock P.M.
That all prcperty owners and other persons interested therein are directed

and notified to appear at such hearing and make any objection they may desire
to urge against the passage of this ordinance.
6. That pending the consideration of this ordinance by the Mayor
and Council, an advertisement shall be posted in three (3) public places in
said City, to -wit, the City Hall, the Post OffY ce and the Bank of Smyrna,
all being in the City of Smyrna and all being located on Atlanta Street in
said City, giving notice of the introduction and pendency of this ordinance.
Such advertisement shall state the name of the street to be improved and
paved, the nature of such contemplated improvements and the estimated cost
per front foot of same. Such advertisement shall further set forth that the -
property owners or others interested are notified to appear at a meeting of
the said Liayor and Council to be held on the lath day of June, 1951, in the
City Hall of said city at seven o'dlock P. 4., and make any objection that
they .may desire to urge against the passage of this ordinance.
7. That a copy of said advertisement described in Section 6 above
shall be mailed to each person, company or corporation, whose Post Office
address is known, that owns any property fronting or abutting on said street
within the city limits of the City of Smyrna.

is Hamby Street in the City of Smyrna. Said proposed ordinance provides
that Hamby Street in the City of Smyrna, being a distance of approximately
557 lineal feet from the northern intersection of Hamby Street and Powder
Springs Street in the City, of Smyrna, to the southern intersection of Hamby
Street and Bank Street in the City of Smyrna, be paved.

subject to a pro rata assessment of the cost of said improvements against
their properties.
6. That all persons owning property fronting or abutting on said
street in the City of Smyrns, and all other persons interested in any way
in subject matter, are hereby notified and directed to appear at a meeting
of the Mayor and Council of the City of Smyrna, to be held on the %th day
of June, 1951, at seven o'clock P. M. in the City Hall of said City, then

be passed assessing the total cost of same including engineering and super-
vision expenses against the owners of the property on said street, as
provided in Section 66 et seq. of the new charter of said city (Georgia IKiws

City of Smyrna, held at seven o'clock P. M. on Monday, May 7, 1951, at
the City Hall, an ordinance was introduced by Councilman P. P. Shaw and
seconded by Councilman H. L. McEntyre, providing that Medlin Street in
the City of Smyrna, shall be paved. Copy of said proposed ordinance is
hereto attached and made a part hereof.
2. That the street proposed to be paved in said ordinance is
Medlin Street in the City of Smyrna. Sdi.d proposed ordinance provides
that a portion of fledlin Street in the City of Smyrna, being a distance
of approximately 1,063 lineal feet from the eastern intersection of
Medlin Street and Concord Road in the City of Smyrna, to the western
intersection of Medlin Street with Dunton Street in the City of Smyrna,
be paved.
3. That said proposed ordinance provides that Medlin Street in
said city, as above described, be paved in a uniform width of eighteen
(18) feet of asphalt paving with four (4) inch dlay bound base, with two
(2) inches of prime and double surface treatment.
4* That the estimated cost per front foot for such contemplated
improvements as above described, is $1.50 per front foot of property in the
City of Smyrna, abutting on Medlin Street on the north and south sides
thereof.
5. That if such contemplated improvements as herein described
are erected all persons owning property on Medlin Street in said City, shall
be subject to a pro rata assessment of the cost of said improvements
against their properties.

the City Hall, an ordinance was introduced by Councilman P. P. Shaw and
seconded by Councilman H. L. McEntyre, providing that Pine Street in
the City of Smyrna, shall be paved. Copy of said proposed ordinance is
hereto attached and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance
is Pine Street in the City of Smyrna. Said proposed ordinance provides
that Pine Street in the City of Smyrna, being a distance of approximately 851
lineal feet from the eastern intersection of Pine Street and Dunn Street
in the City of Smyrna, to the western.interse_ction of Pine Street and Concord
Road in the City of Smyrna, be paved.
3. That said proposed ordinance provides that Pine Street in
said city, as above described, be paved in a uniform width of twenty—four
(24) feet of asphalt paving with four (4) inch clay bound bases with two (2)
inches of prime and double surface treatment.
4. That the estimated cost per front foot for such contemplated
improvements as above described is $2.00 per front foot of property in the
City of Smyrna, abutting on Pine Street, on the north and south sides
thereof.
5. That if such contemplated improvements as herein described
are erected all persons owning property on Pine Street in said City, shall
be subject to a pro rata assessment of the cost of said improvements
against their properties.
6. That all persons owning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way

Notice is hereby given:
1. That at a regular meeting of the Mayor and Council of the
City of Smyrna, held at seven o'clock P. V1. on Monday, May 7, 1951, at
the City Hall, an ordinance was introduced by Councilman P. P. Shaw and
seconded by Councilman H. L. McEntyre, providing that Walker Court in
the City of Smyrna, shall be paved. Copy of said proposed ordinance is
hereto attached and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance
is Walker Court in the City of Smyrna. Said proposed ordinance provides
that Walker Court in the City of Smyrna, being a distance of approximately
575 lineal feet from the southern intersection of Walker Court and Spring
Street, to the northern intersection of Walker Court and Walker Street in
the City of Smyrna, be paved.
3. That said proposed ordinance provides that Walker Court in
said city, as above described, be paved in a uniform width of sixteen (16)
feet of asphalt paving with four (4) inch clay bound base, with two (2)
inches of prime and double surface treatment.
4. That the estimated cost per front foot for such contemplated
improvements as above described, is $1.35 per front foot of property in the
City of Smyrna, abutting on Walker Court on the east and west sides thereof.
5. That if such contemplated improvements as herein described
are erected all persons owning property on Walker Court in said City, shall
be subject to a pro rata assessment of the cost of said improvements
against their properties.
6. -That all persons owning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way
in subject matter, are hereby notified and directed to appear at a meeting
of the rJayor and Council of the City of Smyrna, to be held on the 4th day
of Jude, 1951, at seven o'clock P. M. in the City Hall of said City, then
and there to make any objections that they my desire to urge against the
passage of the proposed ordinance herein described, copy of which is hereto
attached and made a part hereof.

At a regular meeting of the Mayor and Council of Smyrna held at
7:00 P. 141. on the 7th day of May, 1951, at the City Hall, the following
ordinance was introduced by Councilman P. P. Shaw and seconded by Councilman
H. L. McEntyre.
WHEREAS, Section 64 of the new charter of the City of Smyrna
(Georgia Laws 1931 - pages 982 and 983) which section has not been altered,
amended or repealed in any manner and is now in full force and effect,
provides in part, "that no sidewalk, street, alley, or other place shall be
payed, repaved, or improved, until the passage of an ordinance authorizing
the same, and no such ordinance shall be passed unless the mayor and council
shall have first been petitioned in writing to pave, repave, or otherwise
improve the same, by a majority of the persons, companies, or corporations,
for the owner or owners of a majority of the front footage of abutting
property' subject to assessment for the cost of paving, repaving, or other-
wise improving the sidewalk, street, avenue, public alley, public place or
portion thereof to be paved or repaved;II and
1+VHEREAS, at a special meeting of the Council held at 7:00 P. M.
on the 7th day of 1-4ay, 1951, a petition was presented to the Mayor and
Council signed by nine (9) property owners of the city residing on Walker
Court in said city, being a majority of the owners of property on Walker
Court, or owning a majority of the front footage of property in the city
abutting on Walker Court; and
in said petition the Mayor and Council are requested to
pass an ordinance requiring the paving of Walker Court in the City of Smyrna,
to advertise the introduction of said ordinance and to mail notices of the
same to all persons owning property fronting on either side of Walker Court,
to set a date for hearing objections to such ordinance, to subsequently pass
an assessment ordinance giving the requisite statement to abutting owners on
said street and to do any and all things necessary as required by law and
by the charter of said city to legally accomplish the paving of said street;
N071j, THEREFORE, be it ordained by the Mayor and Council of the
City of Smyrna, and it is hereby ordained by authority of same#
1. That Stalker Court in the City of Smyrna, being a distance of
approximately 575 lineal feet from the southern intersection of Walker Court
and Spring Street in the City of Smyrna] to the northern intersection of
Walker Court and Walker Street in the City of Smyrna, be paved in a uniform
width of sixteen (16) feet of asphalt paving with four (4) inch clay bound
base, with two (2) inches of prime and double surface treatment.
2. That the aayor of said City is authorized and empowered to
engage an engineer to prepare the proper plans and specifications of the
above improvements herein proposed to be made, and that said Mayor be
authorized after legal and proper advertising of same, to let a contract
for and in behalf of the City for the erection of such proposed improvements.
3: That the Mayor and Council estimate the cost of such improve-
ments from the best information available at this time based on various
discussions with contractors and others having technical knowledge of the
cost involved to be approximately Tito & 70/100 (v& 70) Dollars per lineal
foot of such improvements and being as above set forth approximately 575
feet of paving to be erected, the total estimated cost therefore .for the
complete job, being $1,552,50t Such estimated costs as above set forth
being estimated to be $1.35 per front foot of property in said city abutting
on Walker Court on the east and west sides thereof.
4. That when said improvements are completed an ordinance shall
be passed assessing the total cost of same including engineering and super-
vision expenses against the owners of the property on said street, as
provided in Section 66 et seq. of the new charter of said city (Georgia Laves
1931, page 983, et seq.).
5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said mayor and Courcil.;ard
it is hereby ordered that such said public hearing shall be held bcfnre
said May and Council on the 4th day of June, 1951, at seven n1clock P-M.

6. That pending the consideration of this ordinance by the Mayor
and Council, an advertisement shall be posted in three (3) public places in
said City, to-witi the City Hall, the Post Office and the Bank of Smyrna,
all being in the City of Smyrna and all being located on Atlanta Street in
said City, giving notice of the introduction and pendency of this ordinance.
Such advertisement shall state the name of the street to be improved and
paved, the nature of such contemplated improvements and the estimated cost
per front foot of same. Such advertisement shall further set forth that the,
property owners or others interested are notified to appear at a meeting of
the said Liayor and Council to be held on the 4th day of June, 1951, in the
City Hall of said city at seven o'clock P.,iii,, and make any objection that
they may desire to urge against the passage of this ordinance.
