The regular meeting of the Mayor and Council was held at the City
Hall, February 40 1952, 7:30 P.m. Mayor J. M. Gibson, presiding,
with the following Councilmen present, C. M. Hamby, Glenn Yarbrough,
-Jr., Harry Mitchell, Jr., C. C. Terrell and Eugene Rice. City At-
torney, Harold S. Willingham and City Engineers, M. J. Hensley and
Ralph Lewis, Jr. present.
Minutes of previous meeting read. -Motion by C. M. Hamby seconded by
Glenn Yarbrough to approve minutes of -meeting as read. Voted unani-
mous.
Minutes of special meeting January 23, 1952 read. Motion by C. C.
Terrell seconded by Eugene Rice to approve minutes of special meeting
as read. Voted unanimous.

Voted unanimous.
Motion by Eugene Rice seconded by C. M. Hamby to accept property of
Mrs. Ruth Dunton located on Hollis St., into city subject to suitable
contract. Voted unanimous.
Mr. Levi Day came before council asking permission to build a recreat-
ional hall including a skating rink to be located on two vacant lots on
Marston St. Mr. Day was advised by the council to 01ptain a petition
of joining property owners as to their opinion.
City Attorney Harold Willingham read prelimentary application for Fed-
eral Assistance for Construction of Improvements to the Waterworks and
Sewerage System of the City of Smyrna under public law 139 -82nd Con-
gress. Copy of letter attached to these minutes.
Motion by C. M. Hamby seconded by Eugene Rice to recess meeting until
Friday February 8, 1952 7:30 P.M. Voted unanimous.
Continutation of -regular meeting February 8, 1952 7:30 P.M. Mayor
J. M. Gibson, presiding with.the following Councilmen present;
C. M. Hamby, Glenn Yarbrough, Jr. Harry T,Ritchell, Jr., C. C. Terrell,
and Eugene Rice.
Minutes of previous -meeting read for information. Motion by Glenn
Yarbrough seconded by Harry Mitchell to pay bill to,Cobb County Times
provided the ad be run over with complete information of audit, if
additional cost ad not to be run.
Motion by Eugene Rice seconded by C. M. Hamby that all property claim-
ing in City of Smyrna by April_ lst of each year be suljject to tax for
the erisuing year and all property declaring thereafter be prorated for
rest of year. Voted unanimous.
Motion by C. M. Hamby seconded by Eugene Rice that Ruth Dunton property
have inserted into contract that property be subject to 1952 city tax.
Voted unanimous.
Motion by Eugene Rice seconded by Harry Mitchell, that City Attorney,
Harold Willingham draw up ordinance with specification for all new
streets in city will be type of'paving as follows:

4" of top soil or stone base with 12" to 2" #2 stone shot with .75
gallons of asphalt per sq. yd. choked with #1 stone and shot again t,=�
with .25 gal of asphalt per sq yd and sealed with #1 stone and pro-
perly rolled throughout operations. Minimum of 18t of paving, min.
40, right of way and deed street to city. Voted unanimous.
Motion by C. M. Hamby seconded by Glenn Yarbrough to authorize -
Mayor to excute agreement with the following additions; streets
paved according to ordinance to be adopted, written by City Attorney
and provided funds available. Voted unanimous.
Motion by Eugene Rice seconded by Glenn Yarbrough to instruct
Mr. Brown to put necessary pipe for three additional lots on
property of Cannon. Voted unanimous.
Motion by Eugene Rice seconded by Glenn Yarbrough to refund Mr.
Cannon $25,00 on sewer tap fee. Voted unanimous.
Motion by C. M. Hamby seconded by Glenn Yarbrough, Jr. to purchase
maps for Chamber of Commerce costing .?�4.50. Voted unanimous.
Bob Taylor, building inspector reported that Professor I! E.
Saporta, Consultant, Georgia Tech Architecture Department would
make a 12L month -survey of the City expansion program with his
graduating class including areal map of city, model locating all
existing schools, churches and recommendation for further build-
ings, a.t no cost with the exception of research book, 300.c6f)ies,
app... 350.00 provided book is wanted by City.
Motion by C. M. Hamby seconded by Harry Mitchell, that old building
inspector and new building inspector work out between each other
plan regarding to§b..fee, subject to council approval..Voted unan-
imous,
Motion by C. C. Terrell seconded by Harry_Mitchell, Jr. that Plumb-
ing Inspector, Electrical Inspector and Building Inspector be -
paid in full on completion of work finished or final inspection.
- one-half to be paid when permit is taken out and•one-half on com-
pletion of work. Voted unanimous.
Motion by C. M. Hamby seconded by Harry Mitchell, to elect Ernest
Jones, chairman of Tax Assessors at a fee of $150.00, A. C. Shep-
herd at a fee of $75.00 and Charles Dobbs at a fee of $75.00 for
the year of 1952. Voted unanimous.
Motion by Mayes Hamby seconded by Eugene Rice to authorize mayor
to write Professor Saporta accepting proposition described by Bob
Taylor. Voted unanimous.
Motion by C. M. Hamby seconded by C. C. Terrell that exam papers
of electrical and plumbing examinations which failed be sealed -
and kept on file in the city hall and not to be opened only by
court suit. Voted unanimous.
Motion by C. M. Hamby seconded by Eugene Rice to have Mayor appoint
committee of two to investigate zone for meters used by taxi cabs.
Voted unanimous. Mayor Gibson appointed Glenn Yarbrough and C. M.
Hamby to investigate.
Motion by Eugene Rice seconded by,@. M. Hamby not to permit skat-
ing rink to be located on Marston Street. Voted unanimous.

Gentlemen;
Pursuant to previous negotiations between the Art
Prichard Construction Co. and the Honorable Mayor and
council of the City of Smyrna, the Art Prichard Construction
Co. as owner of the following described property, namely
Beginning at apoint on the South side of Powder
Springs Road found by measuring 310' West from the
Southwest corner of the intersection of Bank Street
and Powder Springs Road, Running thence 331' West
along the South side of Powder Springs Road to an
iron pin, Running thence 1184' South to an iron pin,
Running thence 331' East to an iron.pin, and thence
1184' North to the point of beginning

And being known as the Fraser Property,
Agrees as follows: That for and in consideration of the
mutual promises of the parties, the Art Prichard Constr-
uction Co. will
1. Allow the City of Smyrna to proceed with it's plan to
incorporate the above property into the city limits of
Smyrna.
2. Construct 33 houses for residential purposes, each
house to contain not less than 4 rooms and not less than
750 square feet of floor space; Duplex units shall con-
tain not less than 1350 square feet.

3. Maintain a City of Smyrna business license.
4. Require plumbing sub -contractor, if not already licensed
to do work in -the City of Smyrna, to purchase city plumbing
licenses at a' ost of 50.00.
5. Require electrical sub -contractor, if not already
licensed to do work in the City of Smyrna, to purchase a
City of Smyrna electrical contractors license for 50.00.

6. Pay to the City of Smyrna the sum of 4900 per house for
a building permit for each house constructed.
7. Require plumbing contractor to pay to the City of Smyrna
a total of 4.00 per house for all plumbing inspections made
by the City during construction.
8. Require the electrical contractor to pay to the City of Smyrna
a total of 4.00 per house for all electrical inspections made
by the city during construction.
9. To guarantee payment of the above fees to the City of
Smyrna if the sub -contractors should fail to pay them.
In consideration of the above promises by the Art Prichard
Construction Co., the City of Smyrna agrees that it will
furnish immediately when needed the following;
1. Adequate sewerage mains and facilities leading to all
houses constructed so that sewerage will drain there -from.
2. Adequate water supply to all houses.
3. Adequate police and fire protection to all houses.
4. Culverts for driveways leading to each house to be
installed by the City, but shall be supplied by the builder.
5. Adequate street lighting for all houses built.
Time is the essence of the agreement of all parties hereto.

TO THE HONORABLE MAYOR AND COUNCIL OF THE CITY OF SMYRNA:
Gentlemen:
Pursuant to previous negotiations between the under-
signed Mrs. Ruth C. Dunton, of Cobb County, Georgia, and the
Honorable Mayor and Council of the City of Smyrna, Cobb County,
Georgia, the said Mrs. Ruth C. Dunton as the owner of the follow-
ing described property, namely:
ALL THAT TRACT OR PARCEL OF LAND lying and being
in Land Lot No. 485 of the 17th District, 2nd
Section, Cobb County, Georgia, shown by plat of
same prepared by J. B. Carey,,C.E., October 31,
1951, and more particularly described as follows:
BEGINNING at a point on the South Side of Concord
Road in said State and County where the South
side of said road intersects the East side of
Hollis Street; running thence in an Easterly
direction along the South side of said Concord
Road a distance of 400 Feet to a point; thence in
a Southerly and slightly Southwesterly direction
a distance of 425 Feet, more or less, to a point;
thence in a Westerly and slightly Northwesterly
direction a distance of 400 Feet to a point on
the East side of said Hollis Street; thence along
the East side of Hollis Street in a Northerly
direction a distance of 300 Feet to Concord Road
and the point of beginning.
SAID TRACT contains three building lots as shown
on the aforesaid plat Dlus an additional 25 Feet
fronting on Concord Road on the Eastern side of
said lots) and of uniform width the entire depth
of said lots.
For and in consideration of the mutual promises of the
parties and the mutual benefits and advantages which will flow to
both parties to this agreement, the said Mrs. Ruth C. Dunton agrees
to pay to the City of Smyrna, Georgia, the usual fee or price for
sewer tap and water meter which said City will install, and the
City of Smyrna agrees to admit said property as above described
and agrees to furnish immediately when needed the following:
