12-22-1949 Special Meeting207 A special meeting of the Mayor and Council was held at the City Hall, Decergber 22, 1949 at 6:45 P.M., for the purpose of re -opening Sani- tary Tax on Garbage collections. \ Mayor J. M. Gibson presided with the following Councilmen present; P. P. Shaw, Dr. M. L. Collins, H. L. McEntyre, R. S. Brinson and C. W. Jones. W. H. Hames, City Electrician reported the Four Way, Three Light Traffic light had been purchased and would be installed within the next few days. • Motion made by P. P. Shaw and seconded b4,25 C. W. Jones, to charge $1.00 for residents in the City limits, for residents outside the City limits; to pick up garbage in the rear, once a week for residents and three times a week for business houses. Standard gar- bage cans to be used. Voting for: P. P. Shaw, Dr. M. L. Collins, H,�,. L. McEntyre and C. W. Jones.• Voting against, R. S. Brinson. W. F. Stewart, and B. F. Reed, Jr. presented plans for a Forty Unit �. Apartment house4, consisting of thirteen buildings, to be located on Cri Church, Reed, Davis and Stephens Sts. Project approved by F. H. A. r7-+ planning commission. • Motion made by H. L. McEntyre and seconded -by P. P. Shaw to issue Building permit and Stewart & Reed to pay 125.00 each for three large water meters. Voting for P. P. Shaw, Dr. M. L. Collins, H. L. McEntyre and C. W. Jones: Voting against R. S. Brinson, Mayor Gibson appointed Councilman Shaw and Jones to serve as a Budget Committee, along with Mr. Gibson. Recemmendations to be made at the January concerning the 1950 Budget. Mayor Gibson appointed Councilman McEntyre and Brinson to serve as Business License Committe, along with Mr. Gibson. Recommendations to be made at the ;anuary meeting concerning Business Licenses fees. Motion made by P. P. Shaw and seconded by R. S. SPECIAL TAX ORDINANCE - AN ORDINANCE No. 118 providing for Business License Taxes for business transacted in the' Town of Smyrna for the fiscal year beginning February 1, 19M and ending i January 31, 1959. Section 1. That on and after the first day of February, 19A it shall be unlawful for any person or persons, cor- poration or company, to -begin-or...carry _on any of the oc- cupations or businesses hereinafter mentioned in the Town i of Smyrna without first applying to the Clerk and obtain- ing from him a license for carrying on each said business or occupation for the year 19A Section 2. Be it further, ordained that it shall be the duty of the Clerk of Smyrna to issue said license upon the payment to him of the prescribed fee. Exceptions X. Section 3. Be it further'ordainied'that all licenses shall be issued for the fiscal year beginning February 1st, 1940 and the fees hereinafter_prescribed shall be paid in full by each person, firm, or corporation upon the issuing of the license, provided that all persons commencing business in this Town after February 1st,,.194,% shall pay pro rats of such license fee for the portion of the license year unex- pired at the time of issuance of said license and further, provided that persons commencing business after July 1st shall pay license fee not less than 50% of yearly fee. Section 4. Section 5. Be it further ordained that it shall be unlaw- ful for- any pool room to remain open after 11 o'clock at night, or allow any games played on pool tables, and where pool room is operated in connection with lunch counter or other business, the proprietor or operator of such business shall keep dark and not allow public access to the part of building in which pool tables are located. And all windows and doors facing the streets must be kept clear of all Post- ers, signs, paint or other obstacles that would cut off the view of the passing pedestrians. Section 6. Be it further ordained it shall be unlawful for any person, firm or corporation to sell or offer to sell any alcoholic liquor, wine, beer or malt beverages of in- toxicating nature after 11 o'clock at night. Section 7. Be it further ordained by the authority afore- said that all licenses issued under this ordinance for spe- ficic or special license tax shall be posted conspicuously in the place of business of the person, firm or corporation to whom the licenses are issued, and upon their failure to do so, the license in the discretion of the Mayor, shall be revoked and they shall be punished as_prescribed in Sec-_ tion 55 or the Code of said City. Section 8. Be it further ordained by the authority afore- said that the Mayor of the City shall have the right to re- voke any license issued under this ordinance, whether a person doing business under such license shall violate any law or ordinance of the United States, or of the State of Georgia or of the Town of Smyrna, in pursuance of such business conducted under such license, or when it shall be proven before the Mayor that the health, morals, inter- est and convenience of the public demand the revocation of such license or the person, firm or corporation holding such license was issued, and said Mayor shall report his revocation of such license to the next regular meeting of the City Council for their ratification or rejection and should the action of the Mayor be sustained by the Coun- cil, then the said license shall be permanently revoked, otherwise it shall be restored and remain in full force. Section 9. Be it further ordained by the authority afore- said that the license issued under this ordinance shall be transferred to any other person, firm or corporation doing the same business at the same place or places of business, upon the written approval of such transfer, by the Mayor of this City, who shall have full discretion to approve or disapprove such transfer. Section 10. Be it further ordained by the authority of the aforesaid that any persons who shall begin or carry on any said business or occupations without first obtain- ing said license as prescribed above, shall upon conviction, be fined by the Mayor in a sum not exceeding $100.00 or in default of the payment thereof shall be required to. work on the streets of said City not exceeding fifty days. Section 11. Be it provided• that if any section, para- graph or part of this ordinance shall for any reason be ad- judged by a court to be invalid, such judgement shallnot affect the remainder of the Ordinance.
