11-15-1948 Special Meeting155i November 27, 1948. A Special meeting was held on November 27, 1948 at 7;30 P. M. for the purpose of passing and adopting a zoning law -on Sunset Avenue. The meeting was called to order by Mayor Lorena P Pruitt with the following councilmen present; M. L. Collins, H. L. McEntyre, P. P. Shaw, H. D. Durham and H. P. McCollum. Motion was made by H. D. Durham and seconded by H. P. McCollum that the zoning law attached and made a part of the se minutes be passed, Voted unanimous. The firm of Charles P. Bagley & Company was given the conttact to audit the books of the City of Smyrna for the year 1948. There being no further business the meeting was adjourned. Noiv'ember 15, 1948. A Special meering was held by the Mayor and Council to pass the assessment notices for the paving of the following dtreets; Church Street, Flemming Street, Powder Springs Street, Walker Street and Highland Avenue. Mayor Lorena P. Pruitt called the meeting to order with the following present; Councilmen P. P. Shaw, H. P. McCollum, M. L. Collins and H. L. McEntyre and Attorney Harold Willingham. Motion was made by P. P. Shaw, seconded by H. P. McCollum thet the Tax Assessors be paid an additional $45.00 Each , or a total of $75.00 each, Voted unanimous. The following ordinancq,f or Church Street, was introduced by Councilman P. P. Shaw and seconded by H. P. McCollum and voted unanimous, (see ordinance attached. The following ordinance , for Flemming Street was introduced by H. P. McCollum and seconded by M. L. Collins and voted unanimous. ( see ordinance attached) The following ordinance, for Powder Springs Street was introduced by M.L. C&Ilins, Councilman and seconded by Councilman H. L. McEntyre and voted unanimous. ( See ordinance for Powder Springs Street Attached) The following ordinance, for Walker Street was introduced by P. P. Shaw and seconded by Councilman H. L. McEntyre and voted• unanimous.(See ordinance for Walker Street attached). The following ordinance, for Highland Avenue was introduced by Councilman H. L. McEntyre and seconded by Councilman H. P. McCollum and voted unanimous. ( see ordinance for Highland Avenue attached). Motion was made by Councilman M. L. Collins and seconded by H. L. McEntyre and voted unanimous that Attorneys prepare proposed changes in the City Charter and advertise that these changes will be YaNA introduced or that legislation will be introduced that changes will be made in the Legislature. ( OVER ) 3 `156 Motion was.made by H. P. McCollum amd seconded by H. L. McEntyre and.voted unanimous that the painter be paid for painting the City Hall. Motion made by H. P. McCo-Ilum and seconded by P. P. Shaw that the meeting adjourn. t - U A CHURCH STREET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of a portion of Church Street in the City of Smyrna, being a distance of approximately 388 lineal feet from the eastern inter- section of Church Street and Atlanta Street in the City of Smyrna, to the intersection of Concord Road with Church Street in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 270 1931 (Georgia Laws 1931,,pagesn955-988), and under and by virtue of the adoption of an -ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $803.95. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the au- thority of,the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the -pro rata part of such owner of said sum of $803.95, to be determined by the amount of the frontage of,such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement, and said lien is hereby declared from the date of said ordinance which was passed on the 3rd day of May, 1948. FLEMING STREET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of a_portion of Fleming Street in the City of Smyrna, being a distance of approximately 650 lineal feet from the eastern inter- section of Fleming Street and Atlanta Street in the City of Smyrna, and running in a westerly direction to and in- cluding part of the property now owned by J. C. Johnson in the City of Smyrna, has been completed pursuant to the Act of the General ,Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988), and under and by virtue of the adoption of an _ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies, and corporations subject to assess- ment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $1,024.98. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the au- thority of the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of $1,024.98, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement; and said lien is hereby declared from the date of said ordinance which was passed on the 18th day of June, 1948. I POWDER SPRINGS STREET - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of the whole of Powder Springs Street in the City of Smyrna, being a distance of approximately 2410 lineal feet from the eastern intersection of Powder Springs Street and Atlanta° Street in the City of Smyrna, to the intersection of G Powder Springs Street with the City Limits in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988), and under and by virtue of the adoption of an ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, com- panies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $5,815.75. "-' THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the au- thority of the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of $5,815.75, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement, and said lien is hereby declared from the date of said ordinance which was passed on the 3rd day of May, 1948. WALKER STREET - PAVING AS:SESSMENT,ORDINANCE WHEREAS, the paving and improving of the whols of Walker Street in the City of Smyrna, being a distance of 1920 lineal feet from the intersection of Walker Street and Roswell Street in the City of Smyrna, to the intersection of Walker Street with City Limits in the City of Smyrna, has been.com- pleted pursuant to the Act of the General Assembly of 1931, _embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988) and under and by virtue of the adoption of an ordi- nance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $3,396.13. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the au- thority of the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of $3,396.13, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessmen4 determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement, and said lien is hereby declared from the date of said ordinance which.was passed on the 3rd day of May, 1948. HIGHLAND AVENUE - PAVING ASSESSMENT ORDINANCE WHEREAS, the paving and improving of the whole of Highland Avenue in the City of Smyrna, being a distance of 979 lineal feet from the southern intersection of Highland Avenue and Roswell Street in the City of Smyrna, to the intersection of Highland Avenue and Hawthorne Street in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988), and under and by virtue of the adoption of an ordinance intro- duced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assess- ment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said ,Act, is $1,838.07. THEREFORE, be it'ordained by -the Mayor and Council of the City of Smyrna, and it is hereby ordained by the authority of the same; That each abutting owner, subject to the cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of $1,836.07, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement,, and said lien is hereby declared from the date of said ordinance which was passed on the 3rd day of. TO ALL PERSONS CONCERNED: WHEREAS the Mayor and Council of Smyrna, Georgia have been petitioned in writing to zone all that portion of Sunset Avenue in said city on the North side of the said street from the property now owned by Dr. W. C. Mitchell to the intersec- tion of said Sunset Avenue with Hamby Street and including all property North of said Sunset Avenue to Powder Springs Street in said City, and on the South side of Sunset Avenue for a depth of 150 feet from the property now owned by Leonard Bradscome to the intersection of Sunset Avenue with Hamby Street for residential purposes only and prohibits the use of said described area for business purposes or business structures, except that Mrs. W. tl. Day shall have the right to continue the operation of her present beauty shop on the north side of said street, and that Mr. S. B. Harbin shall have the right to continue the operation of his present Grocery Store on the South side of said street, and WHEREAS, after said petition was presented and read, pursuant to Act number 336 of the General Assembly approved March 15, 1943, for the purpose of giving all parties and citizens an opportunity to be heard for or against passage of said Ordinance at a public hearing therein.
