09-07-1949 Regular Meeting19�3 The regular meeting of the Mayor and Council was held at the City Hall, September 7, 1949 at 3: P.M. The following councilmen were present: P. P. Shaw, M. L. Collins, and R. B. Logan. Attorney Harold Willingham present also. Mayor J. M. Gibson presiding. Minutes of previous meeting read and approved. Also minutes of special meeting read and approved. Mrs. R. N. Hughes and Miss Ethel Hughes brought before the Council the need of repair work to be done in order to protect Mrs. Hughes property, located at Hughes and Powder Springs Sts. Mr. Gibson stated this had been investigated and necessary repairs would be made when sufficent funds were availabe to do so.1 Fire Chief Cobb made report on investigation of old house located at 516 Spring St owned by 1,11. D. Anderson, stating that no repairs had been made up to date. Time set at previous meeting for repairs to made were 90 days. Mr. Cobb notified the Council that new arrangements would have to be made for housing the fire truck some time after the middle of November. Dis- cussion as to City building a building for fire truck. Mr. Shaw suggest offering, Mr. Cobb up to,525.00 per month. Mr. Gibson appointed Mr. Shaw and Mr. Logan to contact Mr. Cobb as to an agreement and report at the next Council meeting. i lMr. Hensley, Street Paving Engineer, states all streets are in good shape and reports Ledbetter E.'Joh.nson had promised to give a days work when patrol passing through Smyrna. f Motion made by P. P. Shaw and seconded by M. L. Collins to accept Street Paving,Engineer, TTr. Hensley,report of Street Paving being complete. Voted unanimous. P. P. Shaw moves the adoption of the following aodinance for the paving assessment of Church Sheet, seconded by Y. L. Collins. Voted unanimous. (Ordinance attached to' these minutes) . R. B. Logan moves the adoption of the following ordinance fro the paving I ssessment of Ihitfield,Street, seconded by P. P. Shaw. Voted unanimous. (Ordinance attached to these minutes). M. L. Collins m oves the, adoption of the following ordinance for the paving lassessment of Love Street Extension, seconded by P. P. Shave. Voted unanimous. (Ordinance attached to these minutes). i R. B. Logan moves the adoption of the following ordinance for the paving assessment of Morris Circle , seconded by P. P. Shaw. Voted unanimous. (Ordinance attached to these minutes). One way street around school discussed. Motion made by R. B. Logan and seconded by M. L. Collins to make Reed Street entrance at Church Street to Stephens to Bing Street a one way street. Voted unanimous. Signs to ordered and erected immediately. Motion made by M. L. Collins and seconded by R. B. Logan to give First Bap- tist Church a sewer tap free of charge. Voted unanimous. Zonning committee plans were submitted for approval of the Council. Motion -made by P. P. Shaw and seconded by 14. L. Collins to adopt committees plan, which includes zonning of business area as shown on City ?fag. =Discussion of picking up garbage outside City limits. This matter to be taken up at a later date. .Potion made by P. P. Shaw and seconded by R. B. Logan to run 2" line from "Dunn Street to Collier Drive. Voted unanimous. M1[.. - a ...� 194 MORRIS CIRCLE - PAVING ASSESSI,ENT ORDINANCE WHEREAS, the paving and improving of the whole of Morris Circle in the City of Smyrna, being a distance of approximately 745.3 lineal feet from the northwestern intersection of 1.1orris Circle with Walker Street and around circle to its southwestern intersection with Walker Street, in the City of Smyrna, has been completed pursuant to the,Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955- 988), and under and by virtue of the adoption of an ordinance intro- duced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and11 WHEREAS, the cost of such paving and improvement to the abutters as provided in.said Act, is1,504.69. THEREFORE, be it ordained by the 14yor and Council of the City of Smyrna, and it is hereby ordained by the authority of the same; That each abutting owner, subject to the cost of such pavement and A improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of 01,504-69, to be determined by the amount,of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted.upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof,. to date back to the approval of the passage of the ordinance for said paving and improvement; and said'lien is hereby declared from the date of said ordinance which was passed on the 22nd day of April, 1949- Passed this 7th day of September , 1949. LWER CHURCH STREET - PAVING ASSESSLfENT ORDINANCE WHEREAS, the paving and improving of a portion of Church Street in the City of Smyrna, being a distance of approximately 2000 lineal feet from the eastern intersection of Church Street with King Street and Concord Road in the City of Smyrna,to the intersection of Church Street with the City Limits in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27,,1931 (Georgia Laws 1931, pages -955-988), and under and by virtue of the adoption of an ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies, and corporations subject to assessment for the cost of such paving and improvement, and 111HEREAS, the cost of such paving and improvement to the r abutters as provided in said Act, is ', 4,167.92., THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the authority of the same; That each abutting owner, subject tothe cost of such pavement and improvement under the provisions of said Act, is hereby assessed the amount of the pro rata part of such owner of said sum of f,4,167.92, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the:.passage of the ordinance for'said paving and improvement; and said lien is hereby declared from the date of said ordinance which was passed on the 22nd day of April, 1949. Passed this 7th day of September , 1949• WHITFIELD STREET - PAVING ASSESSMT ORDINANCE WHEREAS, the paving and improving of the whole of Whitfield Street in the City of Smyrna, being a distance of approximately 1,450 lineal feet from the western intersection of Whitfield Street and Roswell Street in the City of Smyrna, to the intersection of Whitfield Street with the City Limits in the City of Smyrna, has been completed pursuant to the Act,of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931, pages 955-988), and under and by virtue of the adoption of an ordinance introduced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons,,companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $2,651.70. THM- FORE, be it ordained by the Mayor and .Council Hof the City of Smyrna, and it is hereby ordained by the authority of the same; That each abutting owner, subject to the cost of -such pavement and improvement under the provisions of said Act, is'hereby assessed the amount of the pro rata part of such owner of*said sum of $2,651.70, to be determined by the amount of the frontage of such owner on said street, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement; and said lien is hereby declared from the date of said•=ordinance which was passed on the 22nd day of April, 1949• Passed this 7th day of September , 1949. LOVE STREET EXTENSION - PAVING ASSESS:TTATT ORDINANCE WHEREAS, the paving and improving of the -whole of Love Street Extension in the City of Smyrna, being a distance of approximately 1,042 lineal feet from the eastern intersection of Love Street Extension and Concord Road in the City of Smyrna, to the terminus of Love Street Extension..in the City of Smyrna, has been completed pursuant to the Act of the General Assembly of 1931, embodying a new charter for the City of Smyrna (formerly Town of Smyrna), approved August 27, 1931 (Georgia Lams 1931, pages 955- 988), and under and by virtue of the adoption of an ordinance intro- duced after the filing of a petition with the Mayor and Council for such paving and improvement, by a majority of the persons, companies and corporations subject to assessment for the cost of such paving and improvement, and WHEREAS, the cost of such paving and improvement to the abutters as provided in said Act, is $1,84o.62. THEREFORE, be it ordained by the Mayor and Council of the City of Smyrna, and it is hereby ordained by the authority of thesame; That each abutting owner,, subject to the cost of,such pavement and improvement under the provisions of said Act, is hereby assessed.the amount of the pro rata part of such owner of said sum of $1,840.62, to be determined by the amount of the frontage of such owner on said's'treet,,, and by the provisions of said Act, and a lien is hereby asserted upon each portion of the property abutting upon said Street for the amount of the assessment, determined under and by the provisions of said Act, against the owner thereof, to date back to the approval of the passage of the ordinance for said paving and improvement; and said lien is hereby declared from the date of said ordinance which was passed on the 22nd day of April, 1949.
