The regular meeting; of the Mayor and Council was held April 4,
1949, at the City Hall 7:30 PT%T. The following Councilmen were
present, P. P. Shaw, M. L. Collins, H. L. TTchntyre, and R. B.
Logan. Mayor J. Y. Gibson, presiding. Harold Willingham, and
Scott Edwards, City Attorneys were present, also Mr. 17elker,�
County Engineer of Merrit & Welker present.

on by the -people, which could be assumed without any additional
taxes. These could be submitted for vote in one lump sum or
separately, so as to vote on either or both. 11r. Gibson, states,
that, one half the ,people of Smyrna have sewerage for which all
the people are paying. Mayor ask each Councilman his views on

1. As to taxes of TTr. . Reed Koni gsmark being due, for the . year
of his death.

At a regular meeting of the i1ayor and Council of Smyrna held at
7130 P. !1. on the lath day of April,.1949, at the City Hall, the following
ordinance was introduced by Councilman P. P. Shaw and seconded by Council-
man R. B. Logan.
NHEREAS, section 64 of the new charter of the City of Smyrna
(Georgia Laws 1931 - pages 982 and 983) which section has not been altered,
amended or repealed in any manner and is now in full force and effect,
provides in part, "that no sidewalk, street, alley, or other place shall be
paved, repaved, or improved, until the passa,•e of an ordinance authorizing
the same, and no such ordinance shall be passed unless the mayor and council
shall have first been petitioned in writing to pave, repave, or otherwise
improve the sane, by a majority of the persons, companies, or corporations,
nor the owner or owners of a majority of the front footage of abutting
propertyt subject to assessment for the cost of paving; repaving or other-
wise improving the sidewalk, street, avenue, public alley, public place or
portion thereof proposed to be paved or repaved;II and
NHEREAS, at a.special Meeting of the Council held at 7a30 P. M.
on the 17th day of March, 1949, a petition was presented to the i,Iayor
and Council signed by sixteen (16) property owners of the city residing on
Church Street in said city, being a majority of the owners of property
on Church Street, and owning a majority of the front footage of property
in the city abutting on Church Street; and
+VHEREAS, in said petition the Mayor and Council are requested to
pass an ordinance requiring the paving of a portion of Church Street in
the City of Smyrna, to advertise the introduction of said ordinance and to
Nail notices of the sane to all persons owning property fronting on either
side of Church Street, to set a date for hearing objections to such ordi-
nance, to subsequently pass an assessment ordinance giving the requisite
statement to abutting owners on said street and to do any and all things
necessary as required by law and by the charter of said city to legally
accomplish the paving of said street;
NOW, THEREFORE, be it ordained by the Yayor and Council of the
City of Smyrna, and it is hereby ordained by authority of same:

1. That a portion of Church Street in the City of Smyrna, being
a distance of approximately 21000 lineal feet fro.n the eastern intersection
of Church Street with Kinr Street and Concord Road in the City of Smyrna,
to the intersection of Church Street with the City Limits of the City of
Siyrna, be paved in a uniform width of eighteen (18) feet of bituminous
surface treatment and top soil, compacted six (6) inches thick.
2. That the i.4ayor of said City is authorized and empowered to
engage an engineer to prepare the proper plans and specifications of the
above improvements herein proposed to be .made, and that said Mayor be
authorized after lenal and proper advertising of same, let a contract for
and in behalf of the City for the erection of such proposed improvements.
3. That the ::iayor and Council estimate the cost of such improve -
gents from the best information available at this time based on various
discussions with contractors and others having technical knowledge of the
cost involved to be approximately Two & 10/100 ($2.10) Dollars per lineal
foot of such iYaprovemnents and being; as above set forth approximately 23000
feet of paving to be erected, the total estimated cost therefore for the
complete job, being $4,200.00. Such estimated costs as above set forth
being estimated to be U,05 per front foot of property in said city abutting
on Church Street, on the north and south sides thereof.
4. That when said improvements are completed an ordinance shall
be passed assessing the total cost of same including engineering and super-
vision expenses against the owners of the property on said street, as
provided in Section 66 et seq. of the new charter of said City (Georgia Laws
1931, pare 983, et seq.).
5. That before the passar,e of this ordinance a public hearing
regarding same shall be held at a meeting of.said Mayor and Council; and
it is hereby ordered that such said public hearinf; shall be held before
said Idayor and Council on the 22nd day of April, 190, at seven -thirty
o1clock P. IJ. That all property owners and other persons interested therein
are directed and notified to appear at such hearing and make any objection
they may desire to urge against the passage of this ordinance.
6. That pending the consideration of this ordinance by the
Mayor and Council, an advertisement shall be posted in three (3) public

places in said City, to -wit, the City Hall, the Post Office and the
Bank of Smyrna, all being in the City of Smyrna and all being located
on !>tlanta Street in said City, giving notice of the introduction and
pendency of this ordinance, Such advertisment shall state the name of
the street to be improved and paved, the nature'of such contemplated
improvements and the estimated cost per front foot of same. Such adver-
tisement shall further set forth that the property owners or others
interested are notified to appear at a meeting of the said mayor and
Council to be held on the 22nd day of April, 1949, in the City Hall of
said city at seven -thirty o'clock P. M., and rake any objection that
they may desire to urge against the passage of this ordinance.
7. That a copy of said advertisement described in Section 6

Notice is hereby given:
1. That at a regular meeting of the Mayor and Council of
the City of Smyrna, held at seven -thirty o'clock P. M. on Monday,
April 4, 1949, at the City Hall, an ordinance was introduced by Coun-
cilman P. P. Shaw and seconded by Councilman R. B. Logan, providing
that Love Street Extension in the City of Smyrna, shall be paved.
Copy of said proposed ordinance is hereto attached and made a part
hereof.
2. That the street proposed to be paved in said proposed
ordinance is Love Street Extension in the City of Smyrna. Said pro-
posed ordinance provides that Love Street Extension in the City of
Smyrna, being a distance of approximately 1,042 lineal feet from the
eastern intersection of Love Street Extension and Concord Road in the
City of Smyrna, to the terminus of Love Street Extension in the City
of Smyrna, be paved. _
3. That the z aid proposed ordinance provides that Love Street
Extension in said city, as above described, be paved in a uniform width
of sixteen (16) feet of'bituminous surface treatment and top soil com-
pacted six (6) inches thick.
4. That the estimated cost per front foot for such contemplated
improvements as above described, is r0.95 pEr front foot of property in
the City of Smyrna, abutting on Love Street Extension, on the north and
south sides thereof.
5. That if such contemplated improvements as herein described
are erectefc all persons owning property on Love Street Extension in said
City shall be subject to a pro rata assessment of the cost of said im-
provements against their properties.
6. That all persons owning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way
in subject matter, are hereby notified and directed to appear at a meeting
of the Mayor and Council of the City of Smyrna, to be held on the 22nd day
of April, 1949 at seven -thirty o'clock P. I& in the City Hall of said City,
then and there to make any objections that they may desire to urge against
the passage of the proposed ordinance herein described, copy of which is
hereto attached and made a part hereof.

ordinance provides that the whole of Whitfield Street in the City of
Smyrna, being a distance of approximately 1,450 lineal feet from the
western intersection of Whitfield Street and Roswell Street in the City
of Smyrna, to the intersection of Whitfield Street with City Limite in
the City of Smyrna, be paved.

1949, at the City Hall, an ordinance was introduced by Councilman P. P.
Shaw and seconded by Councilman R. B. Logan, providing that Dorris Circle
in the City of Smyrna, shall be paved. Copy of said proposed ordinance is
hereto attached and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance
is ';Torris Circle in the City of Smyrna. Said proposed ordinance provides
that the whole of Morris Circle in the City of Smyrna, being a distance of
approximately 745.3 lineal feet from the northwestern intersection of drorris
Circle with Walker Street and around circle to its southwestern intersection
with Walker Street, in the City of Smyrna, be paved.
3. That said proposed ordinance provides that Morris Circle in
said city, as above described, be paved in a uniform width of eighteen
(18) feet of bituminous surface treatment and top soil compacted six (6)
inches thick.
4. -That the estimated cost per front foot for such contemplated
improvements as above described,is 01.05 per front foot of property in the
City of Smyrna, abutting on IIorris Circle. on dither side thereof.
5. That if such contemplated improvements as herein described
are erected all persons owning property on Morris Circle in said City shall
be subject to a pro rata assessment of the cost of said improvements against
their properties.
6. That all persons owning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way

the same, and no such ordinance shall be passed unless the mayor and council
shall have first been petitioned in writing to pave, repave, or otherwise
improve the same, by a majority of the persons, companies, or corporations,
,or the owner or owners of a majority of the front footage of abutting
property, subject to assessment for the cost of paving, repaving, or other-
wise improving the sidewalk, street, avenue, public alley, public place or
portion thereof proposed to be paved or repaved;,t and
WMEAS, at a regular meeting of the Council held at 7:30 P. M.
on the lath day of April, 1949, a petition was presented to the Ijayor and
Council signed by six (6) property owners of the city residing on Yorris
Circle in said city, being a majority of the owners of property on �.4orris
Circle, and owning a majority of the front footage of property in the city
abutting on :1orris Circle; and
WHEREAS, in said petition the Mayor and Council are requested to
pass an ordinance requiring the paving of the whole of Morris Circle in
the City of Smyrna, to advertise the introduction of said ordinance and to
mail notices of the same to all persons owning property fronting on either
side of Morris Circle, to set a date for hearing objections to such ordinance,
to subsequently pass an assessment ordinance giving the requisite statement
to abutting owners on said street and to do any and all things necessary as
required by law and by the charter of said city to legally accomplish the
paving of said street;
NOW, THEREFORE, be it ordained by the Mayor and Council of the City
of Smyrna, and it is hereby ordained by authority of same:

1. That the whole of 11%rris Circle in the City of Smyrna, being
a distance of approximately 745.3 lineal feet from the northwestern inter-
section of IUIorris Circle with Walker Street around circle to its erouthwestern
intersection with Walker Street in the City of Smyrna, be paved in a uniform
width of eighteen (18) feet of bituminous surface treatment and top soil,
compacted six (6) inches thick.
2. That the Mayor of said City is authorized and empowered to
engage an engineer to prepare the proper plans and specifications of the
above improvements herein proposed to be made, and that said !Aaayor be
authorized after legal and proper advertieing of same, to let a contract for
and in behalf of the City for the erection of such proposed improvements.
3. That the Llayor and Council estimate the cost of such improve-
ments from the best information available at this time based on various
discussions with contractors and others having technical knowledge of the
cost involved to be approximately Two & 10/100 (�2.10) Dollars per lineal
foot of such improvements and being as above set forth approximately 745.3
feet of paving to be erected, the total estimated cost therefore for the
complete job, being 01,565.13. Such estimated costs as above set forth
being estimated to be $1.05 per front foot of property in said city abutting
on Morris Circle, on either side thereof.
4. That when said improvements are completed an ordinance shall be
passed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as privided
in Section 66 et seq. of the new charter of said city (Georgia Laws 1931,
page 983, et seq.).
5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said Mayor and Council; and
it is hereby ordered that such said public hearing shall be held before
said -ayor and Council on the 22nd day of April, 1949, at seven -thirty
o'clock P. 1. That all property owners and other persons interested therein
are directed and notified to appear at such hearing and :Hake any objection
they may desire to urge against the passage of this ordinance.
6. That pending the consideration of this ordinance by the 1.1ayor
and Council, an advertisement shall be posted in three (3) public

places in said City, to -wit, the. City Hall, the Post Office and the
Bank of Smyrna, all being in the City of Smyrna and all being located
on Ltlanta Street in said City, giving notice of the introduction and
pendency of this ordinance. Such advertisment shall state the name of
the street to be inniproved and paved, the nature of such contemplated
improvements and the estimated cost per front foot of same. Such adver-
tisement shall further set forth that the property owners or others
interested are notified to appear at a :fleeting of the said Mayor and
Council to be held on the 22nd day of April, 1949, in the City Hall of
said city at seven -thirty o'clock P. M., and :-aake any objection that
they may desire to urge against the passage of this ordinance.
7. That a copy of said advertisement described in Section 6
above shall be mailed to each person, company or corporation, whose Post
Office address is known, that owns any property fronting or abutting on
said street -within the city limits of the City of Smyrna.
