09-09-1947 Called MeetingAt a call meeting of the Mayor and Councii of Smyrna held at 8:00 P.M. on the 9th day of September, 1947j at the City Hall, the following ordinance,was introduced by Councilman H.D. Durham and seconded by Councilman E.E. Jackson. WHEREAS, Section 64 of the new charter of the City of Smyra (Georgia Laws 1931 - pages 982 and 983) which section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in part, "that no Sidewalk, street, alley, or other place shall be paved, repaved, or improved, until the passage of an ordinance authorizing the same, and no such ordi- nance shall be passed unless the mayor and council shall have first been petitioned in writing to pave; repave] or otherwise improve the same; by a majority of the persons,,. companies or corporations, 'or the owner or owners of a majority off' the front footage of abutting property' subject to assessment fort he cost of paving, repaving, or otherwise improving the sidewalk, street, avenue, public allep public place or portion thereof proposed to be paved or repaved;' and WHEREAS, at a eaii meeting of the Council held at 7:30 P.M: bn the 9th day of Septsi6er,, 1947.,. *a petition was presented to the Mayor and Council sf4hed by fifteen (15) property owners of the city residing on Lee.,gtreet in said city, being a majority of the owners of propert' o Lee Street, and owning a majority of the front footage of proper y in the city abutting on Lee Street; and WHEREAS* in sdid:petitioil the Mayo; and Council are re- quested to pass an ordinan6e requiring the paving of the portion of Lee Street in the City of,Smyrna, to advertise the introduction of said ordinance and to mail notices of the same to all persons owning property fronting on either side of Lee Street, to set a date for hearing objectiont to such ordinance, to subsequently pass an assessment -ordinance giving the requisite statement to abutting owners on said street and to do any and all things necessary as required by law and by the charter of s aid city to legally accom- plish the paving of ;raid street; NOW, THEREFORE, be it ordained by the Maxtor and Council of the City of Smyrna) and it'is hereby ordained by authority of same: 1.. That- the. �ihole of Lee Street in the City of Smyrna being a distance of a��roxihiately 1030 lineal feet from the Northern intersection bi Lee Street with Love Street in the City of Smyrna to the Southern intersection of Lee Street with the cit limits of said city be. paved in a uniform width of sixteen (16T feet, more or less; of asphalt macadam pavement and stone, compacted four (4) inches thiok; 21. That the Mayor of said City is authorized and em- powered to engage an engineer to prepare the proper plans and specifications of;the aboire improvements herein proposed to be made, and that said Mayor be authorized after legal and p oper advertising of same let a contract Poi. and in behalf Of t e City for the erection of such proposed improvements. 3; Thdt the Mayor and Council estimate the cost of such improvements from the best information available at this time based on various discussions with contractors and others having technical knowledge of the cost involved to be approximately Two and 70/100 ($2.70) Dollars per lineal foot of such improvements and being as above set forth approximately 1,330 feet of paving to be erected, the total estimated cost therefor for the complete job being $3591.00. Such estimated costs as above set forth being estimated to be $1.35 per front foot of property in sa id city abutting on Lee Street on the East and West sides thereof. 4., That when said improvements are completed an ordinance shall be passed assessing the total cost of same including engineer- ing and supervision expenses against the ovmers of the property on said street.. as provided in Section 66 et seq.-of the ntr charter of said city (Georgia Laws �931),, page 987, et seq.' 54 That before the passage of this -ordinance a public hearing regarding same shall be held at a meeting of said Mayor and Councilf and it is hereby ordered that such said public hear- ing shall be held before said Mayor and Council on the 25th day of September, 1947, at eight o'clock P.M. That all property owners and other persons'interested therein are directed and noti- fied to appear at such hearing and make any objection they may desire to urge against the passage of this ordinance. 6. That pending the consideration of this ordinance by the Mayor and,Council an advertisement shall be posted in three (3) public places in said city; to -wit, the City Hall, the Post Office and the Bank of Smyrna, all being in the City of Smyrna and all being located on Atlanta Street in said -city'., giving notice of the introduction and pendency of this ordinance• Such advertisement snall'state the name of the street to be im- proved and paved, the nature of such contemplated improvements and the estimated cost per front foot of same. Such advertisement shall further set forth that the property owners or others inter- ested are notified to appear at a meeting of said Mayor and Council to be held on the 25th day of September 1947, in the City Hall of said city at eight o'clock P.M., and make any objection that .they may desire to urge against the passage of this ordinance. 7• That a copy of said advertisement described in Sec- tion 6 above shall be mailed to each person, company -or corporation, whose Post Office address is known, that owns any property front- ing or abutting on Lee Street within the city limits of the City - of -Smyrna. 49 T ^1 September 9, 1947 (Conttd.) Upon.readi.ng of the foregoing ordinance it was moved, seconded, and unanimously carried that Sections 5, 60 & 7 of said ordinance be adopted pending the consideration of said ordinance and that the clerk be authorized and directed to immediately advertise the introduction and pendency of said ordinance and to give the notices required by same in the manner required by sections' 6 & 7 thereof. September 25, 1947 was set ad the date of a public hearing for foregoing ordinanced requested for paving of Lee Street, October 6, 1947 was set as the date of a public hearing for foregoing ordinances requested -for paving of King Street, West Spring Street and Brown Circle.
