08-18-1947 Special Called MeetingAt a special called meeting of the Mayor and Council'of the City of Smyr.,na held at 8:00 P. M, on the 18th day of August, 1947, at the City Hall the following ordinance was introduced by Council H. D. Durham and seconded' by Councilman B. H. Hansong WHEREAS, Section 64 of the new charter of the City of Smyrna'(Georgia Laws 1931 - pages 982 and 983) which section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in part, "That no sidewalk, street, alley, or other place shall be -paved, repaved, or improved, until the passage of an ordinance authorizing the same, and no such ordinance shall be passed unless the mayor ana council shall - have first been petitioned in writing to pave, repave, or otherwise improve the same, by a majority of the persons, companies or corporation, "for the owner or owners of a majority of the front footage of abutting propertyt subject to assessment for the cost of paving, repaving, or otherwise improv- ing the sidewalk, street, avenue, public alley, public place or portion thereof proposed to be paved or repaved;11 and VIHEREAS, at a special. called meeting of the- Mayor• and Council of said City held at 8:00 P. M. on the 1 8th d,q of August, 1947, a petition was pre- sented to the- MWor and Council signed by six owners of property in said City, being a majority of the owners of property on King -Street, and owning a majority of the front footage of property in the City abutting on King Street; and WHEREAS, in said petition the Mayor and Council are requested to pass an ordinance requiring the pnvi.ng of King Street in the City of Smyrna, to advertise the introduction of said ordinance and to mail notices of the - same to all persons owning property fronting on either -side of King Street, to set a date for hearing objections to such ordinance, to subsequently pass an assessment ordinance giving the requisite statement to abutting owners on said street and to do any -and all things necessary as required by law and by the charter of said City, to legally accomplish the.paving of said street; NO!7, THEREFORE, be it ordained by the Mayor and Council of the City of SrWrna, and it is hereby ordained by authority of same: 1. That the whole of King Street in the City of Smyrna, being a distance of approximately 950 lineal feet from the Southern intersection of King street with Church Street in theCity of Smyrna, to the northern intersection of King Street with Bank Street in said City, be paved in a' uniform width of eightegn (18) feet of asphalt macadam pavement and stone, compacted four (4) inches thick. It shall be an asphalt penetration pave- ment consisting of 350 pounds of stone and three and one-half gallons of asphalt to the square yard, 2. That the Mayor of said City is authorized and empowered to engage an engineer to prepare the proper plans -and specifications of the above improvements herein proposed to be made, and that said Mayor be authorized after legal and proper advertising of same, to let a contract for and in behalf of theCity for the erection of such proposed improvements. 3. That the Mayor and Council estimate the cost of such improvements from the best information available at this time based on various discussions with contractors, and others having technical knowledge of the cost involved,, to be approximately $2.50 per lineal foot of such improvements, and being as above set out approximately 950 feet of paving to be- erected; the total estimated cost therefor for the complete job being $2,375.00. Such estimated costs as above set forth being estimated to be $1.25 per front foot of property in said City abutting on King Street on the East and Vilest sides thereof. 4, That when said improvements are completed ari,grdinance shall be passed assessing the total cost of same including,engineering and super- vision expenses, against the owners of the property on said street, as pro-. vided •in Section 66, et secj of the new chatter of said City; (Georgia Laws 1931 - pages 983; at segi,) 5. That before the passage of this ordinanee a public heariag regard- ing same shall be held at a meeting of said Mayor and Council; and it is hereby ordered that such said public -hearing shall be held before said May or and Council on the 6th day of October, 1947, at eight o'clock P. M. That all property owners and other persons interested therein are directed and noti- fied -to appear at such hearing and make any objection they may desire to urge against the passage of this ordinance. 6.- That pending the consideration of this ordinance by the Mayor and Council, an advertisement shall be posted in three (3) public places in said city, to -wit, the City Hall, the Post Office and the Bank of Smyrna, all being in the City of Smyrna and all being located on Atlanta Street in said City, giving notice of the introduction and pendency of this ordinance. Such advertisement shall state the name of the street to be improved and paved, the nature of such contemplated improvements and the estimated cost per front foot of same. Such advertisement shall further set forth that the property owners or others interested are notified to appear at -a meeting of said Mayor and Council to be held on the 6th day of October, 1947, in the City Han of said -City at eight o'clock P. M., and make any objection that they may desire to urge against the passage of this ordinance. 7. That a copy of said advertisement described in Section 6 above, shall be mailed to,each person, company or corporation, whose Post Office address is known, that owns any property fronting or abutting on King Street within the City Limits of the City of Smyrna. 43 September 9, 1947 (Cont'd.) Upon reading of the foregoing ordinance it was moved, seconded and unanimously carried that Sections 5, 6, & 7, of said ordinance be adopted pending the consideration of said ordinance and that the clerk be authorized and directed to immediately advertise the introduction and pendency of said ordinance and to give the notices required by same in the manner required by sections 6 and 7 thereof. 44 r r " I . That the whole of West Spring Street in the City of Smyrna, being a distance of approximately 600 lineal feet from the Eastern intersection of 17est Spring Street with Atlanta Street in the City of Smyrna, to the Western intersection of West Spring Street with King Street in said City, he paved in a uniform width of eighteen (18) feet of asphalt macadam pave- ment and stone, compacted four (4) inches thick. It shall be an asphalt penetration pavement consisting of 350 pounds of stone and three and one- half gallons of asphalt to the square yard. 2. Me on the 18th day of August 1947, a petition was presented to the mayor and Council signed by ulevon ovmors of property in said City, being a majority of the ormors of property on Brorm Circle, and orming a majority of the front footage of property in said City abuttin on Brown Circle; and WHEREAS, in said petition the ,*Tlayor and Council are requested to pass an ordinance requiring the paving of Brorm Circle in the City of Smyrna, to advertise the introduction of said ordinance and to mail notices of the same to all persons orming property fronting on either side of Bro%7n Circles to set a data for hearing objections to such ordinance, to subsequently pass an assessment ordinance giving the requisite statement to abutting orraers on said street and to do any and all things necessary as required by law and by the charter of said City, to legally accomplish the paving of said street; NO!-s THEREFORE, be it ordained by the 11ayor and Council of the City of Smyrrna, and it is hereby ordained by authority of same: 1. That the whole of Bro=Cirolc in the City of Smyrna, being a distance of approximately 655 lineal foot from the Northern intersection of Brown Circle with Hill Street in the City of Smyrna* totho testorn Intersection of Brown Circle with Hughes Street in said City, be paved in a uniform width of eighteen (18) foot of asphalt macadam pavement And stone, compacted two and ono-half(o�-� )Z nchcs thick. It shall be an asphalt penetration pavement consisting of two hundred pounds of stono and two gallons of asphalt to the square yard. 2, That the mayor of said City is authorized and omporrorod to on- gago an engineer to proparo the proper plans and specifications of the above improvements herein proposed to be made, and that said Mayor be authorized after legal and proper advertising of same, to lot a contract for and in behalf of the City for the erection of such proposed improvements. 3. That the Mayor and Council estimato the cost of such improve- monts from the boot information available at this timo based on various discussions with contractors and others having technical knowledge of the cost involved, to be approximately 01.70 par lineal foot of such improve- monts, andboing as above set forth approximately 855 foot of paving to be crcetcd,tho total estimtod cost therefor for the complete job being 61453.50. Vla That all property owners and other persons intorostod therein are directed and notified to appear at'such hearing and make any objoction they may desire to urge against the passage of this ordinanoo. 6• That pending the consideration of this ordinance by the xiayor and Council, an advertisement shall be posted in throe (3) public places in said City# to -wits the City Hall, tho Post Office and the Bank of Smyyrnas all being in the City of Smyrna and all being located on Atlanta Street in saidCityi giving notice of the introduction and pendency of this ordinance.
