06-23-1947 Called MeetingAt a call meeting of the P.4ayor and Council of Smyrna
held at 8:00 F. T:.. on thetvrentn-third day of June, 1947, at the
City Hall, the following ordinance was introduced by Councilman
H. D. Durham and seconded by Councilman H. P. McC01- um
VlIMRIKAS, Section 64 of the new charter of the City f
Smyrna (Georgia Laws 1931 - pages 9II2 and 983) which section has _.
not been altered, amended or repealed in any manner and is now
in full force and effect, provides in part, "t7iat no sidewalk,
street, alley, or other place shall be paved, renaved, or improved,
until the passage of an ordinance authorizing the same, and no
such ordinance shall be passed unless the mayor and council shall
have first been petitioned in writing to pave, repave, or other-
vlise improve the same, by a Majority of t'ne persons, companies or
corporations, for the owner or owners of a majority of the front
footage of abuttinS property) subject to assessment for the cost
of paving, repaving, or othenTise improving the sidewalk, street,
avenue, public alley, public place or portion thereof proposed to
be paved or repaved;" and
VMREAS, at the regular June meeting of the Council
held at 7:30 P. M- on the 10th day of June, 1947, a petition was
presented to the Kayor and Council signed by twenty (20) property
owners of the city residing on Love Street in said city, being a
majority of the owners of property on Love Street, and owning a
majority of the front footage of property in the city abutting on
Love Street; and
%qI ,EAS, in said petition the ya-yor and Council are re-
guested to pass an ordinance requiring the pavir_S of the portion of
Love Street in the City of Smyrna, to advertise the introduction of
said ordinance and to mail notices of the same to all persons owning:
property fronting, on either side of Love Street, to set a date for
hearing; objections to such ordinance, to subsequer_tly pass an
assessment ordinance giving tine requisite statement to abutting owners
on said street and to do any and all thin;-s necessary as required by
law and by the charter of said city to legally accomplish the pavinC;
of said street;
NOVI, TIEREFORE, be it ordained by the Idayor and Council
of the City of Smyrna, and it is hereby ordained by authority of
same:
1. That the whole of Love Street in the City of Smyrna

macadam pavement compacted four (4) inches thick, said pavement tying
into and connecting with existing curb and gutter on tho south side
of said street.
2. That a concrete curb and. ,nutter be installed on the
north side of said street adjacent to said paving. Such newly in-
stalled curb and gutter shoulc, be constructed in sections having a
uniform length of ten (10) feet, except where necessary to alter the
length for closes; such sections to be separated by steel templates,
one -eighth of an inch thick, which shall remain in place until the
concrete ht-s set sufficiently to hold its shape, the face and surface
of such curb and gutter to be floated to a smooth finish.
3. Tba t the Iaayor of said City is authorized and em-
pov,ered to engage an engineer to prepare the proper plans and speci-
fications of the above improvements herein proposed to be made, and
that said iIayor be authorized after legal and proper advertising of
same let a contract for and in behalf of the City for the erection
of such proposed improvements.
4. That the Mayor and Council estimate the cost of such
improvements from the best information available at this time based
on various discussions with contractors and others having technical
knovrlec;%,e of the cost involved to bo approximately Four Dollars
per -lineal foot of such improvements and being; as above set
forth approximately 1,350 foot of paving and concrete curb and gutter
to be erected, L-he total estimated cost therefore for the complete
job being i1 5,400.00, such estimated cost as above set forth being estimated
to be w'$2.00 per front foot of property in said city, abutting on Love Street on
1 the north and south sides thereof.

5. That when said improvements are completed an
ordinance shall be passed assessing the total cost of same in-
cluding engineering and supervision expenses against the ovrners
of the property on said street as provided in Section 66 et sec,:
of the new charter of said city (Georgia Laws 1931, page 983 of
seq.. )
6. That before the passage of this ordinance s:, ��ukJlie
hearing regarding same shall be held at a meeting of scid I:tayor and
Council; and it is hereby ordered that such said public hearing shall
be held before said Mayor and Council on the i th day of
1047, at ei&t _ o'clock P. Ii. (MXK=That all property
odmers and other persons interested therein are directed and noti-
fied to appear at such hearing and male any objection they may desire
to urge against the passage of this ordinance.
7. That pending the consideration of this ordinance by
the Layer and Council an advertisement shall be posted in three (3)
public places in said city; to -wait, the City Ball, the Post Office
and the Bank of Smyrna, all being; in the City of Smyrna and all being
located on Atlanta Street in said City, giving notice of the intro-
duction and pendency of this ordinance. Such advertisement shall state
the name of the street to be improved and paved, the nature of such
contemplated improvements and the estimated cost per front foot of
sa:.ie. Such advertisement shall further set forth that the property
ovmera or others interested are notified to appear at a meeting of
said 1.ayo3., and Council to be held on the 15th _day of July

the passage of this ordinance.
6. That a copy of said advertisement described in
Section 7 above shall be mailed to each person, company or corporation,

or abutting on Love Street within the city limits of the City of
