At a r meeting of the Mayor and Council of Smyrna held at

7 :30 P. M. on the -3r4 day of May, 1948, at the City Hall, the following
ordinance was introduced by Councilman H. D. Durham and seconded by Council-
man P. P. Shaw.
WHEREAS, Section 64 of the new charter of the City of Smyrna
(Georgia Laws 1931 - pages 982 and 983) which section has not been altered,
amended or repealed in any manner and is now in full force and effect, pro-
vides in part, "that no sidewalk, street, alley, or other place shall be paved,
repaved, or improved, until the passage of an ordinance authorizing the same,
and no such ordinance shall be passed unless the mayor and council shall have
first been petitioned in writing to pave, repave, or otherwise improve the
same, by a majority of the persons, companies, or corporations, 'or the owner
or owners of a majority of the front footage of abutting property' subject
to assessment for the cost of paving, repaving, or otherwise improving the
sidewalk, street, avenue, public alley, public place or portion thereof
proposed to be paved or repaved;" and

11THERLAS, at a - ar meeting of the Mayor and Council held at 7:30

P. I.T. on the day oi` e 1948, a petition was presented to the Mayor and
Council signed by six (6) property owners of the city residing on Fleming
Street in said city, being a majority of the owners of that portion of property
on Fleming street proposed to be paved, and owning a majority of the front footage
of the property proposed to be paved in the city abutting on Fleming Street; and
1cti 138 , in said petition the Mayor and Council are requested to pass
an ordinance requiring the paving of approximately 650 lineal feet of Fleming
Street in the City of Smyrna, and being more particularly described as follows:
Beginning at the eastern intersection of.Fleming Street and Atlanta Street in
the City of Smyrna, and running in a westerly direction to and including part
of the property now owned by J. C. Johnson in said city ; to advertise the intro-
duction of said ordinance and to mail notices of the same to all persons owning pro-
perty fronting on either side of the above described property on Fleming Street,
to.set a date for hearing objections to such ordinance, to subsequently pass an
assessment ordinance giving the requisite statement to abutting owners on said
street and to do any and all things necessary as required by law and by the
charter of said city to legally accomplish the paving of said street;
1401P1, THEREFORE, be it ordained by the Mayor and Council of the City
o;^ Smyrna, and it is hereby ordained by authority of same:
1.
1. That a portion of Fleming Street in the City of Smyrna, being a
distance of approximately 650 lineal feet from the eastern intersection of
Fleming Street and Atlanta Street in the City of Smyrna and running in a westerly
direction to and including part of the property now owned by J. C. Johnson, in,
the City of Smyrna, be paved in a uniform width of eighteen (18) feet of
bituminous surface treatment and top soil, compacted six (6) inches thick.
2. That the Mayor of said City is authorized and empowered to engage
an engineer to prepare the proper plans and specifications of the above improve-
ments herein proposed to be made, and that said Mayor be euthorixed after legal
and proper advertising of same, let a -contract for and in behalf of the City
for the erection of such proposed improvements.
3. That the Mayor and. Council estimate the cost of such improvements
from the best information available at this time based on various discussions wi+.,h
contractors and others having technical knowledge of the cost involved to be
approximately one dollar and ninety four cents ($1.94) per lineal foot of such
improvements and being as above set forth approximately 650 feet of paving to
be erected, the total estimated cost therefore for the complete job, being
$1261.00. Such estimated costs as above set forth being estimated to be $0.97
per front foot of property above described in said city abutting on Fleming
Street, on the north and south sides thereof.
4. That when said improvements are completed an ordinance shall be
passed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as provided in
ction 66 et seq. of the new charter of said city (Georgia Laws 1931, page
983, et seq. ).
5. That before the passage of this ordinance a public hearing regarding
same shall be held at'a meeting of said Mayor and Council; and it is hereby
ordered that such sad.d public hearing shall be held before said Mayor and Council
on the 18th day of June, 1948, at eight o'clock P. M. That all property owners
and other persons interested therein are directed and notified to appear at
such hearing and make any objection they may desire to urge against the passage
of this ordinance.
6. That pencling_the consideration of this ordinance by the Mayor
and Council, an advertisement shall be posted in three (3) public places

in said City, to -wit, the City Hall, the Post Office and the Bank of Smyrna, all
being in the City of Smyrna and all being located on Atlanta Street in said City,
giving notice of the introduction and pendency of this ordinance. Such advertise-
ment shall state the name of the street to be improved and paved, the nature of
such contemplated improvements and the estimated cost per front foot of same.
Such advertisement shall further set forth that the property ovmers or others
interested are notified to appear at a meeting of said Mayor and Council to be
held on the 18th day of June, 1948, in the City Hall of said city at eight
o'clock P. M., and make any objection_ that they may desire to urge against the
passage of this ordinance.
7. That a copy of said advertisement described in Section 6 above
shall be mailed to each person, company of corporation, whose Post Office address
is known, that owns any property described in this ordinance fronting or abutting
on Fleming Street within the city limits,of the City of Smyrna.

BROWN'CIRCLE - PAVING ASSESSMENT ORDINANCE
WHEREAS, the paving and: improving of the whole of
Brown Circle in the City of Smyrna, being a distance of
approximately 855 lineal feet from the Northern intersection
of Brown Circle with Hill Street in the,City of Smyrna to the
Western,intersection of Brown Circle with Hughes Street in
said city., has been completed pursuant to the Act of the
General Assembly of 1931, embodying a new charter for the City
of Smyrna (formerly Town of Smyrna), approved August 27, 1931
(Georgia Laws 1931, pages 955-988)-,,and under and by virtue of
the adoption of an ordinance introduced after the filing of a
petition with the Mayor and Council for such paving and im-
provement, by 'a majority of the persons, companies and corpora-
tions subject to assessment for the cost of -such paving and
improvement, and
WHEREAS., the cost of such paving and improvement
to the abutters as provided in said Act is $1,444.07.
THEREFORE, be it ordained`by the Mayor and Council.
of the, City of Smyrna, and it is hereby ordained by .the ,au- 4.
thority of the same; That each abutting owner, subject to'the:
cost of such pavement and improvement under the provisions of
said Act, is hereby assessed.the amount of the pro rata part
of such owner of said sum of §1,444.07, to be determined by
the amount of the frontage of such owner on said street,.. and Y

upon each person of the property abutting upon said street

LEE STREET - PAVING ASSESSMENT ORDINANCE
'WHEREAS, the paving and improving of the whole of Lee
Street in the City of Smyrna, being a distance of approximately
1,330 lineal feet fromithe Northern intersecti-on.of Lee Street

DUNN STREET - PAVING ASSESSMENT ORDINANCE
WHEREAS, the paving and improving ,of.the whole
of Dunn Street in the City of Smyrna, being,a distance
of 1340 lineal feet from the northern intersection of ,Dunn_
Street with Love Street -in the City of Smyrna to the southern
intersection of Dunn Street with the city limits of 'said city,
has been completed pursuant to the Act of the General Assembly
of 1931, embodying a new charter for the City of Smyrna
(formerly Town of Smyrna),'approved August 27, 1931 (Georgia
Laws 1931, pages 955-988), and under and by virtue of _the,
adoption of an ordinance introduced after the filing of a
petition with the Mayor and Council for such paving and im-
provement, by a majority of the persons, companies and
corporationssubject to assessment for the cost of such paving
and improvement, and
WHEREAS, the cost of such paving -and improvement to
the abutters as provided in said Act, is 3,263.23.

WHEREAS, the paving and improving of the whole
of West Spring Street in the City of Smyrna, being a
distance of 600 lineal feet from the Eastern intersection
of West Spring Street with Atlanta Street in the City of
Smyrna to the Western intersection of West Spring Street
with King Street in said city, has been completed -pursuant
to the Act of the General Assembly of 1931, embodying a
new charter for the City of Smyrna (formerly Town of Smyrna),
approved August 27, 1931 .(Georgia Laws 1931, pages 955-988),
and under and by virtue of the adoption of an ordinance
introduced after the filing of a petition with the Mayor and
Council for such paving and improvement, by a majority of,
the persons, companies and corporations subject to assessment
for the cost of such paving and improvement, and
WHEREAS, the cost of such paving and improvement
to the abutters as provided in said Act, is $1,681.39.
THEREFORE, be it ordained by. the Mayor and Council
of -the City of Smyrna, and it is hereby ordained by the au-
thority of the same; That each abutting owner, -subject to the w
cost of such pavement and improvementunder the provisions of
said Act', is hereby assessed the amount of=the pro-rata part•
of such owner of said sum of $1,681,39,. to be determined by
the amount of the frontage of such owner on.said street; and

the.northern intersection of King Street with Bank Street in
said. city, has been compieted pursuant to the Act of the
General Assembly of 1931, embodying a new charter for the'
City of Smyrna (formerly Town of Smyrna), approved August 27,
1931 (Georgia Laws 1931, pages 955-988), and under and by
virtue of the adoption of an ordinance introduced after the

paving and improvement, by a majority of the persons, com-
panies and corporations subject to assessment'for the cost of

WHEREAS, the cost of such paving and improvement -

P. P. Shaw made a motion, seconded by M. L. Collins, to install
10 minute parking signs on East side of Atlanta Street from corner,
directly across from City Hall to and including Stonewall Liquor
Store Also 10 Minute Parking signs , on West Side of Atlanta Street,
From City Hall to Shell Filling Station, forth.
Also 30 Minute Parking Signs on West side of Atlanta Street, from
City Hall to Red Light at corner of Junots Grill, Voted unanimous.
There being no further business the meeting was adjourned by
motion of P. P. Shaw and second by M. L. Collins.

ORDINANCE TO PROTECT WATER rTETERS, FIXTURES OR APPURTENANCES OF A WATER NETER
WITHIN THE CITY OF SMYRNA AND BELONGING TO SAME.
No person, persons, firm or corporation shall in any way enter into, damage
or injure any water meter or fixtures or appurtenance of a water meter, for
any reason whatsoever, without first obtaining the written permission of the
Mayor and Council of the City of Sn~yrna.
PENALTY FOR VIOLATION: Any persoh, persons, firm or corporation who shall
violate this ordinance, shall be fined not more than $ 25.00 for each
offense, or confined to the calaboose, or work upon the streets of the
City of Smyrna, not exceeding 10 days.
