06-01-1948 Called Meeting23 June 1, 1948 J A call meeting of the Mayor and Council was held at the City Hall on June 11 1948 at 7;30 Be M. for the purpose of completing arrangements with the City Attorney to pay for streets, previously accepted as completed. The meeting was called to order by Mrs. Lorena P. Pruitt, Mayor with all councilmen present except H. P. McCollum. Present were P. P. Shaw, H. D. Durham, and M. L. Collins (Henry Konigsmark Jr. had retigned in May and his successor has not been appointed as yet) Harold Willingham, City Attorney was also present. Motion was made by P. P. Shaw and seconded by H. D. Durham that any coal yard on the Highway, in the city of Smyrna must get a permit from the City and erect a fence in front of said coal yard so as to hide from the Highway, the piles of coal in said yard. also to keep the fence in such repair as to be an asset to the City of Smyrna Business Section, Voted Unanimous. Motion was made by P. P. Shaw and seconded by M. L. Collins that all Peddlers be charged a license fee of $ 150.00 to peddle from any vehicle or on foot, in the Limits of the City of Smyrna, Peddling is defined as; Selling from house to house in the City of Smyrna, the solicitation of orders by or on behalf of any Individual, Firm or �,. Corporation, either for immediate delivery or for subsequent delivery by the Individual Firm or Corporation through their duly authorized agents. It shall fnclude, but not.limitto, all regular route salesmen taking orderd for, and delivering merchandise.within the City Limits of the City of Smyrna. Any person, Firm or Corporation or duly authorized agent of same, who violates the terms of this ordinance and sells and delivers merchandise or other property within the limits of the City of Smyrna without First obtaining a license to conduct such business in the City of Smyrna, as provided by the within ordinance, shall be fined the sum of $ 50.00 for each violation, that is for each sale and delivery made within the limits of the Cityn.of Smyrna before obtaining license authorizing same as herein provided, Voted unanimous. The following ordinance, for Brown Circle, was introduced by Councilman P. P. Shaw and seconded by Councilman M. L. Collins and voted unanimous ( see ordinance attached) The following ordinance, for Lee Street, was introduced by Councilman P. P. Shaw and seconded by Councilman M. L. Collins and voted unanimous, ( See ordinance for Lee St. attached) the following ordinance, for Dunn Street, was introduced by Councilman H. D. Durham and seconded by Councilman M. L. Collins and voted unanimous. ( See ordinance for Dunn St. attached) The following ordinance, for West Spring Street, was introduced by Houncilman H. D. Durham and seconded by Councilman M. L. Collins and voted Unanimous ( See ordinance for West Spring St. Attached) The following ordinance, for King Street was introduced by Councilman P. P. Shaw and seconded by Councilman R. D. Durham and voted unanimous ( see ordinance for King St. attached) The following ordinance,gf or Love Street was introduced by Councilman P. P. Shaw and seconded by Councilman H. D. Durham and voted unanimous. (See ordinance for Love St. ) Upon reading of the foregoing ordinance it was moved, seconded and unanimously carried that sections 5,6 &70 of said ordinance be adopted pending the consideration of said ordinance and that the clerk be authorised and directed to immediately advertize the Antroduction and pendency of said ordinance and to give the notices required by same in the manner required by sections 6 and 7 thereof. 1-2 4 {j TEORGIA, C OBB C OUNTY. TO THE MAYOR AND COUNCIL OF THE CITY CF SMYRNA: We, the undersigned, being a majority of the owners of and majority of the front footage of abutting property on Flemming Street, -in the City of Smyrna, , Between the inter sections of Atlanta Street and Running West a distance of Six Hundred and Fifty (650) feet more or less and being t 4 described"more specifically as; Beginning at'Atlanta Street and runnAng to and, including part ,pf the property of., J. C. Johnson, in said City.. and also ,be ng subject to assessment fo 11 for the costs of paving within the City Limits on Flemming 0 Street, do herewith respectfully petition the Mayor and Council N to pass or cause to be passed an ordinance requiring the the paving of said portion of Flemming Street in the City of Smyrna. We further desire and petition you to advertise , mail notices, set a date for hearing, pa ss an assessment ordinance gi giving they necessary statement to abutting owners, and to do any and all things necessary as required by law, in order to legally accomplish the paving of said street. 4 We further call your attention to the fact that this pa ving, if done at the same time other streets in the City are: -being paved, the cost will be less than would ordinarily be the case as favorable bids can be had with the contractor paving said streets. Ja E, i �1 +1 k3 4 r� Ei �t t; L NOTICE OF INTRODUCTION AND PENDENCY OF ORDINANCE BEFORE THE MAYOR AND COUNCIL OF THE CITY OF SMYRNA .AUTHORIZING THE PAVING OF FLEMING STREET IN SAID CITY GEORGIA, COBB COUNTY: TO WHOM IT MAY CONCERTI: Notice is hereby given: 1. That at a i.�r meeting of the Mayor and Council of the City of Smyrna, held at seven thirty o'clock P.M. on Monday, q J1948, at the City Hall, an ordinance was introduced by Councilman H. D. Durham and seconded by Councilman P. P. Shaw, providing that a portion of Fleming Street in the City of Smyrna, shall be paved. Copy of said proposed ordinance is hereto attached and made a part hereof.. 2. That a portion of the street proposed to be paved in said proposed ordinance is Fleming Street in the City of Smyrna. Said proposed ordinance provides that a portion of Fleming Street in the City of Smyrna, being a distance of approximately 650 lineal feet from the eastern inter- section of Fleming Street and Atlanta Street in the City of Smyrna, and running in a westerly direction to and including part of the property now owned by J. C. Johnson in the City of Smyrna,. be paved. 3.. That said proposed ordinance provides that a portion of Fleming Street in said city, as above described, -be paved in a uniform width of eighteen (18) feet of bituminous surface treatment and top soil compacted six (6) inches thick. 4. That the estimated cost per front foot for such contemplated improvements as above described, is $0.97 per front foot of property in the City of Smyrna, abutting on Fleming Street, on the north and south sides thereof. S. That if such contemplated improvements as herein described are erected all persons owning property on that portion of property proposed to be paved on Fleming Street in said City, shall be subject to a pro rate assessment of the cost of said improvements against their properties. 6. That all persons owning property fronting or abutting on said portion of said street in the City of Smyrna, and all other persons interested in any way in subject matter, are hereby notified and directed to appear at a meeting of the Mayor and Council of the City of Smyrna, to be held on the 18th day of June, 1948, at eight o'clock P. M., in the City Hall of said City, then and there to make any objections that they may desire to urge against the passage of the proposed ordinance herein described, copy of which is hereto attached and made a part hereof.
