04-13-1948 Called Meeting1100 April 13, 1948 A called meeting of the Mayor and Council was held at The City Hill "on April 13, 1948 at 6.30 P. M.,,f or the purpose of clearing up the status 'of streets being paved and -streets to be paved. The meeting was called'bb order by the Mayor, Mrs. Lorena P. Pruitt with all members present: H. D. Durham, H. P. McCollum, P.T. Shaw, M. L. Collins and _Henry Konigsmark, Jr, Mr. Dewey and -Mr. Robbins of Ledbetter Johnson Co, were present. S.S. Edwards, City Attorney was also present. Building permits for and A. J. Coppenier wege apprgved �nna#imous. Harry B. Mitchhell Jr. A motion was made by P. P. Shaw that any carnival operating within the City Limits of Smyrna be taxed at the rate of $100.00 per day, seconded by M. L. Collins and..p assed unanimous. Motion made by H. D. Durham, seconded by Henry Konigsmark, 9t., that Mrs. Pennington be given a.Beer License provided that Mrs. Pennington operate the place of business hereelf. Voted yea by H. D. Durham, H. P. That a call meeting of the Mayor and Council of the City of Smyrna, held at seven o'clock P. M. on Tuesday; April 13, 1948, at the City Hall, an ordinance was introduced by Councilman H. P.McCollum and seconded by Councilman P. P. Shaw, providing that 'Powder Springs Street in the City of Smyrna, shall be paved. Copy of said proposed ordinance is hereto attached and made a part hereof. 2. That the street proposed to be paved in said proposed ordinance is Powder Springs Street in the City of Smyrna. Said pro- posed ordinance provides that the whole of Powder Springs Street in the City of Smyrna, being a distance of 2410 lineal feet from the eastern intersection of Powder Springs Street and Atlanta Street in the City of Smyrna, to the intersection of Powder Springs Street with City Limits in the City of Smyrna, be paved. 3. That said proposed ordinance provides that Powder Springs Street,-iri said city, as above described, be paved in a uni- form width of twenty one and four tenths (21.4) feet with bituminous surface treatment and top soil compacted six (6) inches thick. 4. That the estimated cost per front foot for such.contemplate improvements as described above, is $1.15 per front foot of property in the City of Smyrna, abutting on Powder Springs Street, on the north and south sides thereof. 5: That if such contemplated improvements as herein described are erected, all persons ovvning property on Powder Springs Street in said city, shall be subject to a pro rats assessment of the cost of said improvements against their properties. 6. That all persons owning property fronting or abutting on said street in the City of Smyrna, and all other persons interested in any way in subject matter, are hereby notified and directed to appear at a meeting of the Mayor and Council of the City of Smyrna, to be held on the 3rd day of May, 1948, at eight o►clock P. M., in the City Hall of said City, then and there to make any objections that they may desire to urge against the passage of the proposed ordinance herein described, copy of which is hereto attached and made a part hereof. M. on the 13th day of April, 1948, at the City Hall, the following ordinance was introduced by Councilman H. P. McCollum and seconded by Councilman P. P. Shaw. WHEREAS, Section 64 of the new charter of the City of Smyrna (Georgia Laws 1931 - pages 982 and 983) which section has not been altered, amended or repealed in any manner and is now in full force and effect, provides in part, "that no sidewalk, street, alley, or other place shall be paved, repaved, or improved, until the passage of an ordinance authorizing the same, and no such ordinance shall be passed unless the mayor and council shall have first been petitioned in writing to pave, repave, or otherwise improve the same, by a majority of the persons, companies, or corporations, 'or the owner or owners of a majority of the front footage of abutting property' sub- ject to assessment for the cost of paving, repaving, or otherwise improving the sidewalk, street, avenue, public alley, public place or portion. thereof proposed to be paved or repaved;," and ,vHEREAS, at a special meeting of the Council held at 7:30 P. M. on the 23rd day of September, 1947, a petition was presented to thb Mayor and Council signed by twenty eight (26) property owners, of the city residing on Powder Springs Street in said city, being a majority of the owners of property on Powder Springs Street, and owninE a majority of the front footage of property in the city abutting on Powder Springs Street; and a4HLREAS, in said petition the Mayor and Council are requested to pass an ordinance requiring the paving of the portion of Powder Springs Street in the City of Smyrna, to advertise the introduction of said ordinance and to mail notices of the same to allrprcnrav owning property fronting'on either side of Powder Springs Street, to set a'date for hearing objections,to such ordinance, to subse- quently pass an assessment ordinance ziving the requisite statement to abutting owners on said street and to do any and all things necessal as required by law and by the charter of said city to legally accom- plish the paving of said street; NOvu THEREFORE, be it ordained by the Mayor and douncil of the City of Smyrna, and it is hereby ordained by authority of same: 1. 1. That the whole of Powder Springs Street in the City of Smyrna, being a distance of approximately 2410 lineal feet from the eastern intersection of Powder Springs Street and Atldnta Street in the City of Smyrna, to the intersection of Powder Springs Street with City Limits in the City of Smyrna, be paved in a uniform width of 21.4 feet of bituminous surface treatment and top soil compacted six (6) inches thick. 2. That the Mayor of said City is authorized and empowered to engage an engineer to prepare the proper plans and specifications of the above improvements herein proposed to be made, and that said Mayor be authorized after legal and proper advertising of same, let a contract for and in behalf of the City for the erection of such proposed improvements. 3. That the Mayor and Council estimate the cost of such improvements from the best information available at this time based on various discussions with contractors and others having technical knowledge of the cost involved .to be approximately Two and 30/100 (,p2.30) Dollars per lineal foot of such improvements and being as above set forth approximately 2410 feet of paving to be erected, the total estimated cost therefore for the complete job, being $ 5543.00. Such estimated costs as above set forth being estimated to be $1-.15 per front foot of property in said city abutting on Powder Springs Street, on the north and south sides thereof. 4. That when said improvements are completed an ordinance shall be passed assessing the total cost of same including engineering and supervision expenses against the owners of the property on said street, as provided in Section 66 et seq. of the new charter of said city (Georgia Laws 1931, page 983, et seq.). 5. That before the passage of this ordinance a public hearing regarding same shall be held at a meeting of said Mayor and Council; and it is hereby ordered that such said public hearing shall be held before said Mayor and Council on•the 3rd day of May, 1948, at eight o'clock P. M. That all property owners and other persons interested therein are directed and notified to appear at such hearing and make any objection they may desire to urge against the passage of this ordinance. 2. 6. That pending the consideration of this ordinance by the Mayor and Council, and advertisement shall be posted in three (3) public places in said City, to -wit, the City Hall, the Post Office and the Bank of Smyrna, all being in the City of Smyrna and all being located on Atlanta -Street in said City, giving notice of the introduction and pendency of this ordinance. Such advertisement shall state the name of the street to be improved and paved, the nature of such contemplated improvements and the estimated cost per front foot of same. Such advertisement shall further set forth that the property owners or others interested are notified to appear at a meeting of said Mayor and Council to be held on the 3rd day of May, 1948, in the City Hall of said city at eight o'clock P. M., and make any objection that they may desire to urge against the passage of this ordinance. 7. Durham and seconded by Councilman P. P. Shaw, providing that Fleming Street in the City of Smyrna, shall be paved. Copy of said proposed ordinance is hereto attached and made a part hereof. 2. That the street proposed to be paved in said proposed ordinance is Fleming Street in the City of Smyrna. Said.proposed ordinance provides that the whole of Fleming Street in the City of Smyrna, being a distance of approximately 900 lineal feet from the eastern intersection of Fleming Street and Atlanta Street in the City of Smyrna, to the intersection of Fleming Street with Hughes Street in the City of Smyrna, be paved. 3. That said proposed ordinance provides that Fleming Street in said ciTy, as above described, be paved in a uniform width of eighteen (18) feet of bituminous surface treatment and top soil compacted six (6) inches thick. 4. That the estimated cost per front foot for such contemplated improvements as above described, is $0.97 per front foot of property in the City of Smyrna, abutting on Fleming Street, on the north and south sides thereof. 5. That if such contemplated improvements as herein described are erected all persons owning property on Fleming Street in said City, shall be subject to a pro rate assessment of the cost of said improvements against their properties. 6.
