MYERS, MAYOR CITY CLERK TAX ASSESSORS OATH YEAR 1947, We, the undersigned tax assessors; do swear that we will fairly, justly, and impartially appraise all the real property within the limits of the City of Smyrna, to the best of our ability. r � ' V 1 ✓� �a'C' �f�l� �J r Sworn to before me this the d.�g of Mayor 0 1947 a- ., AN ORDINANCE TO REPEAL AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE THE SALE OF ALCOHOLIC BEVERAGES, TO PROVIDE FOR RETAIL AND 1"WOLESALE LICENSE, AND TO PROVIDE A PENALTY FOR THE VIOLATIONS OF THIS ORDINANCE": AND TO RE-ENACT AN ORDINANCE AS FOLLOTS: AN ORDINANCE TO REGULATE THE SALE OF ALCOHOLIC BEVERAGES, TO PROVIDE FOR RETAIL AND WHOLESALE LICENSE, AND TO PROVIDE A PENALTY FOR THE VIOLATIONS OF THIS ORDINANCE. BE IT ENACTED by the Mayor and Council of the City of Smyrna., Georgia, and it is hereby enacted by authority of same: Section 1. Terms defined. In this Ordinance, the term "alcoholic beverages" means all beverages containing alcohol that may be legally sold in the State of Georgia, exeept.,such beverages as contain malt. "Sale" means the selling by any person, persons, partnership or corporation, of any amount of alcoholic beverages whatsoever to any person, persons, partnership or corporation withiii.the�,corporate limits of the City of Smyrna, whether such selling be retail or wholesale. Section 2. The sale of alcoholic beverages within the corporate limits of the City of Smyrna shall be subject to the terms of this Ordinance and/or any subsequent Ordinance amending ar repealing the same. 'r. Section 3. No sale of alcoholic beverages, whether wholesale or retail, shall be made within the.corporate limits of the City of Smyrna unless the person, persons, partnership or corporation making such sale shall first obtain a license to do so from the Mayor and Council of said City. Section 4. The sale of alcoholic beverages within the corporate limits of said City shall be legal provided the person, persons, partner- ship or corporation making such sale shall first obtain a license to make such sale. Azy person, persons, partnership or corporation may obtain from the Mayor and Council of the City of Smyrna a license for the sale of alcoholic beverages by first paying to the Clerk of said City, a license fee in accordance with the following schedule: For retail sale : •' : s1000.00 r r.- It is expressly understood and a part of the contract of issuing this license that'such license may be revoked and the carrying on of the business as allowed by said license, may be discontinued at any time with or without cause, by the Mayor and Council. Said license shall be for the privilege of the sale of alcoholic beverages for the period of one year, from Februarylst to Januai7- 31st of each year.- 19 Section 5. At`;,the time the license is issued the person, persons, partnership or, corporation obtaining such license must put up and give to the City of Smyrna a bond to the extent of $250.00 for the fuli and faithful per- formance of all the duties imposed upon such license under the terms of this Ordinance. Section 6. The sale,of alcoholic beverages.,within this Ordinance must take place between the hours of -3@ A. M. and 'I, ram P. M., and no sales X ..are allowed on Sundays, or any other day in violation of State laws as set forth in the Code of Georgia. Section 7. The retail sale of alcoholic beverages within this Ordinance, must be from a store -and the same must be located within the corporate limits and business district of the City of Smyrna; must front on Atlanta Street, and be not north of Sunset Avenue nor south of a distance of one hundred yards north' bf .,the'. Methodist Church, nor one hundred yards from any church and two hundred yards from any school grounds. The restric- tion as to location herein contained, shall apply only to the State, Couhtyr City or Church Schools and to such other schools as teach the subjects com- I A' monly taught at common schools and colleges of this State. r 4 Section 8. The store as required by this Ordinance, shall conform to specifications laid down by Council and Council shall have the right to specify where the location of said store or stores shall be located within the City Limits of the City of Smyrna. Section 9. Any person, persons, partnership or corporation guilty of a violation of this Ordinance shall be fined not less than $25.06 nor more than $100.00, or imprisoned in the calaboose 30 days for` each violation, any or all of these penalties in the discretion of the Mayor. S. Section 10. That any Ordinance, or parts of Ordinances, in conflict with this Ordinance, be and the same are hereby repealed. Section 11. That should any section or portion of this Ordinance be declared invalid, the remainder to remain in full force and effect. Unanimously adopted by Mayor and Council this April 1947. CityClerk r 0 April 7, 1947 The regular meeting of the Mayor and Council was held at the City Hall on April 7, 1947 at 7:30 P.M. The meeting was called to order by the Mayor, Mrs. Lorena P. Pruitt, with all Councilmen present: B. H. Hanson, H. D. Durham, F.E. Jackson., H. P. McCollum and W. A. Quarles. Motion was made by Mr. Quarles, -seconded by Mr. Durham, that veterans outside the city not be given business licenses. Motion was unanimously carried. Motion was made .by Mr. Quarles, seconded by Mr. Jackson, that Jeff Crowe be given free business license for the year 1947. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. McCollum, that deposit required for water service be raised to $3.00, to take care of the minimum charge at the new rate, effective April 1. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. Durham, that the Chicago Bridge & Tank Company be paid in lump sum for repair and painting of water tank, this to be paid from Waterworks and Sewerage Construction Fund. Motion was unanimously carried. Upon approval by Merritt and Welker, Engineers, motion was made by Mr. Quarles, seconded by Mr. Jackson, that Grinnell+s bill In the amount of $1048.91, Freight bill in the amount of $259.84, Western Union, $0.45, and Dixie Contractor, $71.00 be paid from Waterworks and Sewerage Construction Fund. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. Hanson, that - Mrs. Pruitt be authorized to sign,for the City of Smyrna, lease agreements or easement agreements with the Nashville,,Chattanooga and St. Louis Railway, with reference to crossing right of way of said railroad with water line and sewer line. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. Hanson, that the Marietta Plumbing Ordinance be adopted by the City of Smyrna, substituting appropriate preamble and making necessary change in names. Copies of this ordinance. may be purchased for $1.00 each. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. Hanson, that a Revised Liquor Ordinance, copy of which is attached hereto, be adopted. Motion was unanimously carried. Minutes of meetings held during the month of March were read by Mrs.Ober P. Hensley. There was a motion by Mr. McCollum, seconded by Mr. Jackson, that the minutes be approved as read. Motion was unanimously carried. Financial report for the month of March was read by Mrs. Ober P. Hensley. Motion was made by Mr. Hanson, seconded by Mr. Durham, that the report be accepted. Motion was unanimously carried. Motion was made by Mr. Quarles, seconded by Mr. Jackson, that Mrs. Ethel I Camp be given permit to have a two -room house built, with the following conditions: It must have asbestos siding, or be finished with stucco, if cement blocks are used; also it must placed in the rear of her house. The fee to be $10.00. Motion was unanimously carried. At the request of the garden Club, April 16,was designated as clean-up day. Motion was made by Mr. Quarles, seconded by Mr. McCollum, that water service be discontinued if bill is not paid the first day of the month following issue of the bill. Motion was unanimously carried. Motion was made by Mr-. Quarles, seconded. by Mr.. Durham,, that the Jeffares Water bills amounting to $10.50 and George Parks water bill amounting to O1:50 be canceled. Motion was unan- imously carried. Following a discussion of water bills unpaid by the Smyrna Cannery, there was a motion .by Pair. Quarles, seconded by Mr. McCollum, that no one be given water service so long as there are bills outstanding against the house, or place of business, to which water has been charged. Motion was unanimously.carried. All unpaid bills incurred during the month'were submitted for approval by the clerk. Motion was made by'Mr. Quarles, seconded by Mr. Hanson, that these bills be paid. Motion was unanimously carried. There being no further business,, there was a motion by Mr. Durham, seconded by Mr. Hanson, that the meeting adjourn. Motion was unanimously carried. Thelma D.
