January 26, 1948
A meeting of the Mayor and Council was held at the City Hall on
January 26, 1948, at 7:30 P.M.
The meeting was called to order by the Mayor, Mrs. Lorena P. Pruitt,
with all councilmen present except Henry Konigsmark, Jr.: M. L.
Collins, H. D. Durham, H. P. McCollum and P. P. Shaw.
Attorneys Willingham and Edwards were present and presented a
detailed analysis of the Conatruction Fund Account Showing amount
of funds expended and proposed amounts to be expended.
The attorneys were authorized to settle McDaniel lawsuit up to
fifty cents on the dollar, provided the Engineers, Merritt & Welker,
would waive all right to their share of the penalty claimed. This
the Engineers have agreed to do provided they are relieved of the
responsibility.-tbr the mistake made in the location of the Disposal
Plant. The attorneys were -further authorized to arrange settlement
with Ralph and W. V. Cobb for additional land required by, Feeeen by
reason of the mistake made by the Engineers.
Motion was made by Mr. Durham, seconded by Mr. McCollum that estimate
No. 7, prepared by Engineers Merritt & Welker be paid as made up, the
mistake of $1,000.00 made in carrying forward of figures on the 5th
estimate to be corrected on the next, or 8th, estimate. Motion was
unanimously 'carried.
Motion was made by Dr. Collins, seconded by Mr. McCollum that the
meeting adjourn.

Roy S. Jackson appeared before the Council and Mayor for reconsider-
ation of restaurant license for the Smyrna Cafe. Mr. Jackson was
given permission to continue to run his restaurant through February
16, .1948 without securing 1948 license. This is for restaurant
license only and does not include beer.
There being no further business the meeting adjourned.
