01-28-2002 Special Called MeetingJanuary 28, 2002 The Special Called meeting of Mayor and Council was held in the 2"d floor conference room at Smyrna City Hall. The meeting was called to order by presiding officer Mayor A. Max Bacon at 7:00 o'clock p.m. All council members were present except for Councilman Scoggins who was absent due to family illness. Also present was Interim City Administrator Chris Corey, City Clerk Kellie Barber and City Attorney Scott Cochran. FORMAL BUSINESS: (A) Approval of Formal Abandonment of a Portion of West Spring Street Mr. Cochran stated that West Spring Street had been temporarily closed in order to begin construction on the Village Market Parcel, but that is necessary to formally abandon a portion of West Spring Street in order to facilitate the closing. Councilman Hawkins made a motion to formally abandon a portion of West Spring Street, and Councilman Cramer seconded the motion. Motion was approved 6-0. Councilman Hawkins made a motion to suspend the rules in order to add an item to the agenda on the recommendation of the City Attorney. Councilman Cramer seconded the motion. Motion to suspend the rules was approved 6-0. Councilman Hawkins made a motion to add item (B) Authorize the Mayor to sign a resolution conveying the Village Market property to the DDA. Councilman Cramer seconded the motion. Motion to add item B was approved 6-0. Councilman Hawkins made a motion to authorize the Mayor to sign a resolution conveying the Village Market property to the DDA. Councilman Cramer seconded the motion. LNE ICKA, WARD 6 4 & C/ZA CHARLES PETE WOOD, WARD 7 I RESOLUTION It is hereby resolved that the City of Smyrna is authorized to enter into any and all agreements and execute any and all documents incident to the development of Smyrna Market Village. Such authority shall include but not be limited to the following: 1. Executing a document entitled Amendment to Purchase Agreement. 2. Entering into a master Declaration of Covenants, Conditions, Easements and Restrictions for Smyrna Market Village, LLC conveying the property depicted in Exhibit "A". 3. Conveying and releasing via Quit Claim Deed any and all interest that it has in easements and other interests regarding the property depicted in Exhibit A. 4. All such agreements and documents previously executed are hereby ratified. 5. Indemnifying against loss associated with a deed to secure debt from the City of Smyrna to S. C. Carter dated May 27, 1988. The Mayor and City of Smyrna is authorized to execute any and all documents incident to the development of Smyrna Market Village, including but not limited to those specified above. Box 1226, Smyrna, Georgia 30081 / (770) 434-6600 RESOLUTION OF THE CITY OF SMYRNA It is hereby resolved as follows: The City of Smyrna hereby supports and endorses the homestead exemption bill sponsored by Representative Terry Johnson and Senator Steve Thompson. This bill materially differs from other bills proposed in that it sets the base year for the exemption at 2001. This is a substantial benefit to the citizens of Smyrna. The City of Smyrna further respectfully requests that all members of the Cobb County Delegation sign and support this bill and that the bill be signed into law.
