The special called meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called
to order by presiding officer Mayor A. Max Bacon at 7:08 o'clock p.m. All council members were
present. Also present was City Administrator Howard Smith, Deputy City Clerk Candis Joiner and City
Attorney Charles E. Camp.
PUBLIC HEARINGS:
(A) Rezoning of Property - Cooper Lake Drive - From R-20 Single Family Residential to RAD
Conditional, Single Family Residential
Mayor Bacon stated this is a public hearing and asked if anyone was present in opposition to the rezoning
of this property. There was none.
Councilman Lnenicka stated the city has a request from Jason Lewis to rezone 3.7732 acres adjoining the
Gates of Vinings fronting on Cooper Lake Drive from R-20, Single Family Residential to RAD
Conditional, single family residential as per the attached plat. Mr. Lnenicka stated this will be Phase II
of the subdivision, The Gates at Vinings. Mr. Lnenicka stated the density will be 2.4 units per acre with
an overall density of the development of 1.8 units per acre.
Councilman Lnenicka made a motion the rezoning of the property at Cooper Lake Drive from R-20 Single
Family Residential to RAD Conditional, Single Family Residential be approved with the following
stipulation that if no building permits are issued within one year of this date, the property reverts to R-20
Single Family Residential zoning. Councilman Wood seconded the motion. Motion was approved 7-0.
(B) Land Use Change - Cooper Lake Drive - From Industrial Compatible to Low Density Residential
Councilman Lnenicka stated the property rezoned above will now require the city land use map be
amended. He further stated the city incorporated by annexation the County Land Use Plan, however, that
now is not in concurrence or congruence with the zoning on the property.
Councilman Lnenicka made a motion to approve the land use change for the property on Cooper Lake
Drive (3.7732 acres) from Industrial Compatible to Low Density. Councilman Wood seconded the motion.
Motion was approved 7-0.
(C) Annexation of Property - Cooper Lake Drive - Land Lot 622, Parcel 1
Councilman Lnenicka stated this is the 3.7732 acres on Cooper Lake Drive, Land Lot 622, Parcel 1. Mr.
Lnenicka stated the petition to annex the property was validated at the November 3, 1997, council meeting
with a public hearing date set for November 24, 1997, at a Special Called Meeting. Councilman Lnenicka
stated all the required legal notices have been advertised legally.
Councilman Lnenicka made a motion to approve the annexation of the property on Cooper Lake Drive
(3.7732 acres) in Land Lot 622, Parcel 1, to become a part of Ward 6 with an effective date of
December 1, 1998. Councilman Wood seconded the motion. Motion was approved 7-0.
Mayor Bacon stated this concludes the Special Called Meeting and announced the Mayor and Council will
adjourn to the Human Resources Training Room for a brief presentation of the Spring Road Linear Park
and then will go to the Conference Room on the 2nd floor for a regularly scheduled Work Session.
With no further business, the meeting adjourned at 7:12 p.m.
