12-02-1996 Regular MeetingThe regular scheduled meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called to order by presiding officer Mayor A. Max Bacon at 7:30 o'clock p.m. All council members were present, except for Ron Newcomb, who was out of town on business. Also present was City Administrator Howard Smith, City Clerk Melinda Dameron, City Attorney Charles E. Camp, Fire Chief Larry Williams, Finance Director Claudia Edgar, Assistant Public Works Director Scott Stokes, Police Chief Stan Hook, Library Director Michael Seigler, Parks and Recreation Director Steve Ciaccio, Clean and Beautiful Coordinator Ann Kirk, Personnel Technician Chris Corey, City Engineer Ken Hildebrandt, Chief Building Official Robin Broyles and representatives of the press. Invocation was given by Councilman Pete Wood followed by the pledge to the flag. Mayor Bacon recognized Curt Johnston, candidate for the Post 2 School Board seat recently vacated by Anne Brady. Mr. Johnston asked for the support of the citizens in the March 8 election. Mayor Bacon recognized Frank Bradford, State Representative 30th District. Mr. Bradford thanked everyone for their support recently and stated he would be accessible to his constituents. Mayor Bacon recognized David Casey, representing the Kiwanis Club. Mr. Casey stated he was a member of the Membership Committee and urged anyone interested in joining the Kiwanis to attended the meetings at the Community Center. Mayor Bacon recognized Reverend John Hearst, Rose Garden Hills community. Reverend Hearst stated he felt the Rose Garden Hills community would benefit from the location of a Boys Club in their neighborhood. Reverend Hearst stated the overwhelming majority of persons who attend a recent meeting supported the location of a Boys Club in their neighborhood. Reverend Hearst presented the Mayor and Council with a petition with the names of 87 persons who were in favor of the Boys Club. Reverend Hearst stated he has been a resident of that community since 1969 and has been a pastor for the past 14 years in the, community. He stated he did not speak for everyone in the community but was speaking on behalf of those who signed the petition. Reverend Hearst stated he had visited the Boys Club location in Marietta and learned some things about the Boys Club. He stated the Boys Club is not just centered around athletics, but is concerned about academics as well. Mayor Bacon stated at the last council meeting, questions were raised about the Boys Club. He then stated that he and Councilman Scoggins pledged to the community that before any decision was reached about the location of a Boys Club, there would be a meeting with the community to get the input from the residents of Rose Garden Hills/Davenport Town. He stated a meeting has been scheduled for January 9 at either City Hall or the Community Center for this purpose. Mayor Bacon stated flyers would be mailed out advising of the location and time of the meeting. Mayor Bacon recognized Maggie Williams who spoke in opposition to the Boys Club being located in the Rose Garden Hills/Davenport Town community. She stated she did not think the club was needed and felt the Hands, Feet and Mouth Organization met the needs of the community. Mayor Bacon recognized Lois Fields, 30 Turpin Road, who asked the city to install speed breakers in her neighborhood. She stated she felt the speed breakers were needed to ensure the safety of the children in the neighborhood. Councilman Scoggins advised Ms. Fields if she could present the city with a signed petition from the other residents on her street the city would certainly consider her request. Mr. Scoggins stated after the petition is received, the City Engineer would review the request and make a recommendation. Mayor Bacon recognized Brett McClung and Mindy Maple, Anderson Hunt and Company. Councilman Wood stated the Comprehensive Annual Financial Report (CAFR) has been prepared and asked Mr. McClung to review the findings of the independent firm. Mr. McClung and Ms. Maple stated the city is in excellent financial condition and thanked the Finance Department for their cooperation during the audit. Mr. McClung stated the CAFR is available for the citizens and urged them to pick up a copy and review the document. (A) Variance Request - 6018 Bordeau Walk - Reduce Front Yard Setback from 20 Feet to 15 Feet Mr. Smith stated this item was tabled at the November 18, 1996, meeting. Mr. Smith further stated this lot is located on a cul-de-sac and is a lake lot in Chateau Walk Subdivision. He stated the shape of the lot and the fact that it backs up to a lake make it necessary to request the variance to allow the house to be moved from a 20 foot setback to a 15 foot setback on the front. Mayor Bacon recognized Mr. Charles Jackson, the builder, and asked him to come forward. Mayor Bacon stated this is a public hearing and asked if anyone was present in opposition to the granting of this variance request. There was none. Councilman Cramer stated he had met with some of the residents of the subdivision and answered a lot of questions the homeowners had. He further stated the Homeowner's Association has no problem with the granting of this variance request. Councilman Cramer asked Mr. Jackson to briefly describe why the variance is necessary. Mr. Jackson stated he needs the additional five feet to place the house twenty-five feet from the water line. Councilman Cramer made a motion the variance request at 6018 Bordeau Walk be approved. Councilman Lnenicka seconded the motion. Motion was approved 6-0. (A) Bid Opening (#96029) - 1997 Mini Cargo Van Mayor Bacon asked if there were any bids in the audience. There were none. (A) CCT Bus Stop Shelters Councilman Wood stated the City of Smyrna was previously notified that the Cobb County Department of Transportation, who operates the Cobb Community Transit, planned to put bus shelters in the Smyrna area at designated locations. Mr. Wood stated this is a permit for shelters at these locations. Mayor Bacon recognized Mr. Don Griffith, Cobb County D.O.T. Mr. Griffith stated they are present tonight to request approval for improvements for bus stops along the CCT local routes that are located within the City of Smyrna. He stated they plan to make these improvements all through the county and they have also made a similar request of the City of Marietta. Mr. Griffith stated they would be installing shelters and bench locations. He stated the shelter locations will consist of a concrete pad, a bus loading area, 10' x 4' shelter and an interior bench and a waste receptacle. He stated there would be four shelter locations and six bench locations. He stated this is the first of five phases that will be effected during the next 18 months along the CCT local stops. Mr. Griffith stated installation, cleaning, emptying of the waste receptacles, repair and maintenance of these facilities will be the responsibility of the County. Mr. Griffith stated the shelter locations will have an interior light and exterior lighting where required. Councilman Cramer asked if two waste receptacles could be placed at each location and Mr. Griffith stated they would certainly do that based on demand. Councilman Wood made a motion the building permit for the CCT bus stop shelters be approved. Councilman Lnenicka seconded the motion. Motion was approved 6-0. (B) Choate Construction Company - Office Building at 7100 Highlands Parkway Councilman Wood stated Choate Construction Company is requesting approval to build a 150,676 square foot office building to house an IBM Call Center on a 25-acre site in the Highlands Office Park - Office Distribution Warehouse complex near I-285. He further stated the estimated cost of construction will be $4 million. Councilman Wood made a motion the building permit for Choate Construction Company for an office building at 7100 Highlands Parkway be approved. Councilman Lnenicka seconded the motion. Motion was approved 6-0 (Mr. Newcomb was absent). (A) Bid #96023 - Warren Hydraulic Sand Spreader Councilman Wood stated the Public Works Committee has reviewed the bids. He stated the low bidder meeting specifications was Smyrna Truck Equipment Company for a total delivered price of $6,916. Councilman Wood stated the Public Works Committee recommends the bid be awarded to Smyrna Truck Equipment Company for a Warren Hydraulic Sand Spreader for $6,916.00 and made a motion the bid be awarded to Smyrna Truck Equipment Company for a Warren Hydraulic Sand Spreader. Councilman Lnenicka seconded the motion. Motion was approved 5-1 (Mr. Scoggins abstained). (B) Bid #96024 - Two Meyer Snow Plows Councilman Scoggins stated the Public Works Committee has reviewed the bids. Mr. Scoggins stated the low bidder was SMA Smith Equipment Company, Inc. for a total price of $7,511.14. Mr. Scoggins stated the Public Works Committee recommends the bid be awarded to SMA Smith Equipment Company. Councilman Scoggins made a motion the bid be awarded to SMA Smith Equipment Company for two Meyer Snow Plows. Councilman Lnenicka seconded the motion. Motion was approved 6-0. (C) Bid #96025 - Two EM 120/240V Natural Gas Generators Councilman Scoggins stated these generators are for emergency situations at the pumping stations in the city. Mr. Scoggins stated the Public Works Committee has reviewed the bids and recommends the bid be awarded to Cummings South Inc. Councilman Scoggins made a motion the bid be awarded to Cummings South, Inc. For two EM 120/240V Natural Gas Generators for $36,250.38. Councilman Hawkins seconded the motion. Motion was approved 6-0. (D) Bid #96026 - Concrete Pavers Councilman Wood stated three bids were received and the Finance and Administration Committee reviewed the bids. Councilman Wood made a motion the bid be awarded to Flintstones for concrete pavers in the downtown area for a total price of $46,327. Councilman Lnenicka seconded the motion. Motion was approved 6-0. (E) Bid #96027 - Decorative Light Fixtures Councilman Wood stated the Finance and Administration Committee met and reviewed the bids and recommends the bid be awarded to Ask -Kay Electric. Mr. Wood made a motion the bid for decorative light fixtures be awarded to Ask -Kay Electric for a total price of $20,669.29. Councilman Lnenicka seconded the motion. Motion was approved 6-0. (F) Bid #96028 - Water Main and Service Installation Councilman Wood stated the Finance and Administration Committee met and reviewed the bids and recommends the bid be awarded to Ardito Ditching and Pipeline, the low bidder. Mr. Wood made a motion the bid be awarded to Ardito Ditching and Pipeline for $16,025. for the installation of a parallel main to run down Bank Street form King Street to Hamby Street to accommodate the new housing development being built by Knight Davidson Companies. Councilman Cramer seconded the motion. Motion was approved 6-0. Councilman Cramer seconded the motion. Motion was approved 6-0. (A) Aay Caramba - 3065 South Cobb Drive Mr. Smith stated this show cause hearing is the result of an incident that occurred at the Aay Caramba Restaurant, 3065 South Cobb Drive. He stated the city had received a complaint of alcohol being served to a minor. Mayor Bacon asked if Mr. Victor Manuel Munoz was present, and asked him to come forward. Mayor Bacon then asked Lt. Carlson, Smyrna Police Department, to come forward and present his report. Lt. Carlson stated within an eleven day period, he received information -- two different complaints -- of alcohol being sold to underage persons at 3065 South Cobb Drive. He stated he sent in two people and instructed them to be seated, order an alcoholic beverage and eat lunch and while they were there to observe the servers and any other employees within the business to see if they were serving, selling or delivering any alcohol to anybody who appeared to be underage and if they were, did they ask for any type of identification prior to serving the alcohol. Lt. Carlson stated the persons entered the restaurant and were asked by the waitress, Terri Suits, if they wanted anything to drink. The male order a bottle of beer and the female ordered a Margarita; the waitress took the order, went to the bar, and had the Margarita made and brought it and the beer to the table and served the subjects. No identification was asked for from either person - one being over twenty-one and the other being under twenty-one. Lt. Carlson stated the waitress asked the female, when the drink was ordered, if she wanted alcohol in her Margarita and the female operative responded yes. Lt. Carlson and Officer Durrance went to the establishment, were advised of what had transpired and they then cited two employees - the waitress, Terri Suits, was cited for taking and delivering alcohol. He further stated Ms. Suits is not old enough to perform this service and they also cited Laura Estrada, who claimed she delivered the drinks to the underage person at the table. Lt. Carlson stated January 30, 1997, has been set as the Court date for both these persons. Lt. Carlson advised that on October 20, 1996, the City of Smyrna received a report of a fight in the parking lot of this restaurant. The officers arrived at the scene and spoke December2, 1996 meetinR - continued with the person who was driving a car and there were several other parties in that automobile. During the investigation, it was found that there was a nineteen year old female in the car who had been served and who had been drinking alcohol at this establishment and she was charged with that violation. He further stated the driver of the vehicle was charged also with DUI and there was a third person charged for being out of control - being disorderly at that establishment. Lt. Carlson stated eleven days later he received a call from an employee of the K-Mart Store who had gone to Aay Caramba to have lunch with several other employees. He stated this person informed him they had seen a girl drinking what appeared to be a Margarita, and they knew this girl and knew she was just eighteen. They stated she was seated at a table with several other people, both male and female, and the complainants said no one at the table looked like they were over twenty-one. The complainant said she could not recall if she ever produced any identification or not. The complainant stated she was concerned because the males at the table were drinking a pitcher of beer and they looked like they were in high school. The complainant called Lt. Carlson and he dispatched two uniform officers and he also went to Aay Caramba but the persons had left the restaurant by the time they arrived. He stated these two complaints, received within an eleven -day period, is what prompted him to investigate to see if the complaints were true. Councilman Scoggins asked Lt. Carlson about fighting in the parking lot. Lt. Carlson stated there was a problem with management and apparently the people had been in there drinking and had reached a point where they were drunk and were causing a problem and actually were giving the management and staff of the restaurant a hard time. He stated the restaurant had in fact called the police. Mayor Bacon asked Mr. Munoz to step forward. City Attorney Chuck Camp administered the oath to Mr. Munoz and Ms. Estrada. Mayor Bacon asked Mr. Munoz if he had anything he wanted to say about the report given by Lt. Carlson. Mr. Munoz stated he was very embarrassed that this happened. He stated he was not present when this happened; that he has two companies; a construction company that he owns and his sister runs the restaurant when he is not there. He stated he usually tells all his employees to always ask for identification from everybody who goes in there, including the manager. He stated everyone has their drinking license but he did not know about the girl named Terri (Suits) who just got hired. He stated he did not know how long she had been there but he did not know she was a minor. He stated they are not there to serve minors, they are there to make business and he apologized for what happened. Councilman Hawkins asked Mr. Munoz who is the agent who holds the license for Aay Caramba. Mr. Munoz stated he was not sure, his sister handles all of that. Councilman Hawkins asked if either of the defendants who had been charged by the Police Department were present. Mr. Munoz responded his sister is one of the defendants and she is present. Councilman Hawkins asked Ms. Laura Estrada if she holds the license or is the agent for this establishment. Ms. Estrada responded no, that Mr. Victor Munoz, her brother, actually holds the license and is the agent. She further stated Mr. Munoz is the resident citizen of Georgia. Ms. Estrada stated that what Lt. Carlson reported is exactly what happened and she was not going to deny what happened. She stated the complaints that they have had about the fighting and the minors drinking actually came from their establishment. She also stated that this has happened more than twice that brawls have broken out in their restaurant. She stated they have called upon the City of Smyrna Police Department more than twice to please come and look into their restaurant because not only do they have a problem with high school kids walking in there and wanting to place drinks with fake ID's that somebody has made. She stated she would be the first one to admit that she would not be able to say yes this is a legitimate ID; there are so many false ID's out there that sometimes they do slip by. She stated the date that Lt. Carlson reported on, he is completely correct in stating that they did not check ID's; they did have a minor serve the liquor and that was a complete disregard on her behalf. She stated she is completely brand new to the restaurant business, she did overlook that. She stated she was probably extremely busy and did not think twice and it was one of those things that happens to everyone. She further stated that the brawls that are breaking out, they have a hill next door to their property where many homeless, alcoholic people live. She stated they continuously come into their restaurant, disturb their customers and clientele and they do have a problem with minors coming in there wanting to purchase drinks. She stated they have had their own customers who they have thought were too young to be served and they have checked their ID. Councilman Hawkins asked Ms. Estrada if she was denying the report presented by Lt. Carlson. Ms. Estrada stated no, she could not deny it. It did happen like he said. Councilman Hawkins asked if she took the drink to the patrons and she responded she thought she had but if Lt. Carlson said it happened the way he reported it, then it probably did. She stated their business is booming at Aay Caramba, she would not deny that. She also stated they are getting to the point that they are going to have to double their staff because their business is getting very demanding of their restaurant. Councilman Hawkins stated it has been his experience that usually when you have a place where you constantly are having fights breaking out, is a sign that you are serving people inside that restaurant too much to drink. Ms. Estrada said no, sir, they do cut them off but they have a lot of customers who come from other places already drinking and they do not serve them and that is when the brawls break out. Councilman Hawkins stated one of the problems the city is seeing and they ask the applicants (for agents) is are you going to be on the property to see what is going on. He further stated it was obvious that Mr. Munoz is not. Ms. Estrada said they are both on the property, they alternate from 8:00 a.m. until 1:00 a.m. Councilman Hawkins said the question was for Mr. Munoz. Mr. Munoz stated they are there, they are sometimes in the back doing paper work. Mr. Hawkins said he thought Mr. Munoz had said earlier that he runs a construction company. Mr. Munoz said that is correct but he leaves in the morning to go do that and goes back to the restaurant and helps his sister at the restaurant. Mr. Hawkins said he was going to suggest that if he was not going to be there all the time, he transfer the agents license to someone that was going to be on the property all the time, for instance, his sister. Mr. Munoz stated they had talked about doing that and he thinks that is the best idea. Ms. Estrada asked if that was possible, because she did not think she could hold the license because she has not been a resident for a year. Ms. Estrada stated she has only lived in Cobb County since April. Councilman Hawkins suggested they get a copy of the ordinance and review it and determine if she meets the qualifications to be the agent. He stated the City of Smyrna would be more than willing to explain the ordinance to them and suggested they start a training program for their employees and that they comply with the ordinance requirements. Mr. Hawkins said the City of Smyrna is somewhat unique in that they look at these types of situations very seriously. He then suggested the restaurant card everybody, regardless of who they are. Mr. Munoz apologized for what had happened. Mayor Bacon asked if the waitress, Ms. Suits, actually took the order and was waiting on the table. Ms. Estrada said Ms. Suits did take the order. Mayor Bacon then said it would have been Ms. Suits responsibility to ID the customer and ask for the proper ID. Ms. Estrada said that was correct. Ms. Estrada said since this incident occurred and Lt. Carlson came to them, they now ID everybody even if they look over 90. Mayor Bacon stated he feels very strongly that the person that should receive the harshest penalty is the person that actually takes the order. Mayor Bacon stated everyone at the City of Smyrna is upset that Aay Caramba is here tonight on these charges. Councilman Lnenicka stated there are two separate problems at this location; one is serving underage people and the server, Terri Suits, is seventeen and never have should have been put in the position of checking identification. Ms. Estrada stated she takes full responsibility for this carelessness as it relates to Ms. Suits. Mr. Lnenicka stated the City of Smyrna wants a clean successful business for Mr. Munoz and if they need the city's help, they need to make sure the business is not generating the problem. Ms. Estrada stated they do not want to be a problem, they want to stay in the City of Smyrna. Councilman Hawkins stated if Ms. Suits had come in to be fingerprinted, they would have known immediately she was underage. Councilman Hawkins made a motion that the alcoholic beverage license for Aay Caramba Restaurant at 3065 South Cobb Drive for the violation of sales to an underage person and for allowing an employee under 18 years of age to assist in the sale of service of alcoholic beverages, the license be suspended for a period of five (5) days effective at midnight December 2, 1996, and the business be placed on a five year probation period. He further stated if the business has another violation, the next time the license could be suspended for a period of sixty days and the next time it could be permanently revoked. Councilman Hawkins said he hoped they would take this situation very seriously. He further stated Ms. Estrada and Ms. Suits still have to go to court and they may be fined heavily. Councilman Cramer seconded the motion. Motion was approved 6-0. C'ommiTTEF REPORTS: Councilman Wood stated there was no report from the Finance Department this evening. Councilman Lnenicka stated there is some construction on South Cobb Drive to build sidewalks. He stated there are a number of projects that are happening over the course of the balance of 1996 and 1997 which will end up putting sidewalks on most of South Cobb Drive from Pat Mell Road on the north down to Cooper Lake Drive on the south in Ward 6, mostly on both sides. He stated the City of Smyrna is seeking additional funding from the state through Representative Randy Sauder who has agreed to work with the city. He stated he is very pleased to say there will be some very nice sidewalks on both sides of the road which will make it much safer for pedestrians. He stated he is very pleased with that work and the work that City Engineer Ken Hildebrandt has done in securing funding for this project. Councilman Lnenicka stated he had received a call today from a resident of Vinings North who said the aquatics center is perfect for his rehabilitation from a recent stroke and just wanted to thank the city for the facility. Councilman Cramer asked Chief Williams for a report from the Fire Department. Chief Williams stated this is the time of the year when fire safety is the biggest problem of the year. He stated Christmas decorations, activities of the holidays present fire hazards. He urged everyone to check their Christmas decorations for possible unsafe conditions; check their homes after guests leave especially if the guests have smoked during their visits to be sure no cigarettes or ashes have been left burning; check your smoke detectors and if a resident does not have a smoke detector, he urged them to call the City of Smyrna Fire Department. Councilman Hawkins stated there was no committee report this evening but commended Lt. Carlson for the fine job he had done in the report on Aay Caramba. Councilman Scoggins asked Ann Kirk for a report on the Smyrna Clean and Beautiful. Ms. Kirk announced the holiday schedule for BFI - curbside recycling. Ms. Kirk reported since Christmas and New Year's Day fall on Wednesday this year, the recycling schedule will change as follows. On Wednesday, December 25, that route will be picked up on Thursday, 12-26-96, and Thursday, 12-26, route will be picked up on Friday, 12-27; and Friday, 12-27, route will be picked up on Saturday, 12-28. She reported that the week of New Year's Day, the route will be changed as follows: the Wednesday, 01-01-97, route will be picked up on Thursday, 01-02; the Thursday, 01-02, route will be picked up on Friday, 01-03; and the Friday, 01-03, route will be picked up on Saturday, 01-04-97. She stated Christmas Eve and New Year's Eve schedules will remain unchanged. Ms. Kirk stated telephone books are being recycled now and can be placed in the recycling bins at curbside for single-family residential property; multi -family residential property residents may place their phone books in the bins at the recycling center but not in the newspaper bins located around the city. Christmas trees will be recycled at Home Depot on January 4, 1997, from 9:00 a.m. to 4:00 p.m. Ms. Kirk stated there are still Jonquil bulbs available (in bags of 50 bulbs) for a $10 donation. Councilman Scoggins commended the Mayor and Council for approving the commercial building permit for the IBM Call Center at Highlands Industrial Park. Councilwoman Capilouto asked Steve Ciaccio for a report on the Parks and Recreation Department. Mr. Ciaccio reminded everyone of the Christmas Parade on Tuesday, December 3. He stated the parade will begin at 7:00 p.m. at Nash Middle School and ends at the Community Center on the Village Green. He stated refreshments will be served at the Library and pictures will be made at the Community Center. Councilwoman Capilouto asked Michael Seigler for a report on the Library. Mr. Seigler reported that 12,428 items were checked out of the Library during the month of November, and over 15,000 people came through the Library for the second month in a row. Mr. Seigler reported a new Technical Services Coordinator has been hired and will report to work on Monday, December 9. Mr. Seigler stated the new technical services coordinator is Mr. Guy Leach and the staff is looking forward to his working with them. Mr. Seigler stated on Thursday, December 5, the Library will be hosting the Metro Atlanta Library Association Meeting. Mr. Seigler invited everyone to stop by the Library after the parade tomorrow night for refreshments. Mr. Seigler also reported there will be a senior citizens group performing at the library and Mayor Bacon will read "The Christmas Carol." Mr. Smith asked Robin Broyles to report on the tenant finishes and building permits for the year. Mr. Broyles reported the year to date total for tenant finishes is $61,904,471; the building permit costs for this year is $237,562.78. Mr. Broyles reported the estimated commercial construction cost is $9,350,000 and residential $1,494,982 for the month of November.
