The regular scheduled meeting of Mayor and Council was held pursuant to
the Charter on March 2, 1992 at Smyrna City Hall. The meeting was called
to order at 7:30 o'clock p.m. by presiding officer Mayor A. Max Bacon.
All council members were present. Also present was City Clerk Melinda
Dameron, City Attorney Charles E. Camp, Fire Chief Larry Williams,
Community Relations Director Kathie Barton, Parks and Recreation Director
Sherry Reavis, Finance Director Emory McHugh, Library Director Laurel
Best, Communications Director Steve Ciaccio, Police Chief Stan Hook, City
Engineer Ken Hildebrandt, Public Works Director Vic Broyles, Personnel
Director Jane Mears, Candis Joiner and representatives of the press.
Invocation was given by Bob Canuette, Pastor of Hurt Road Baptist Church
followed by the pledge to the flag.
CITIZENS INPUT:
(A) Proclamation - "Drug Free" Month
Mayor Bacon asked Councilman Jim Hawkins to read the "Drug Free" Month
Proclamation. Mr. Jerry Robinson, Administrator of Brawner Psychiatric
Institute, was present to accept the proclamation on behalf of Brawner's
Hospital. Mr. Robinson presented the City of Smyrna with a flag printed
with the slogan "Drug Free Student Body" and stated that several schools
in the county would be displaying this flag either on their bulletin
boards or flying them on the flagpoles at their schools.
(B) Proclamation - National Nutrition Month
Mayor Bacon asked Councilman Bill Scoggins to read the "National
Nutrition" Month Proclamation. Ms. Jennifer Kimbrough was present to
accept the proclamation on behalf of the Georgia Dietetic Association and
the Atlanta Dietetic Association. Ms. Kimbrough thanked the Mayor and
Council for the proclamation and offered the assistance of the Atlanta
Dietetic Association to anyone who needed the services her organization
provides.
Mayor Bacon then asked if anyone would like to come forward with any other
citizens input. There was not anyone who wished to come forward at this
time.
PUBLIC HEARINGS:
(A) Ordinance Amendment - City of Smyrna Zoning Ordinance - Section 710
Melinda Dameron stated that the City has extended the advertising period
on this Ordinance Amendment and will come up before Mayor and Council at
the March 16, 1992, Council meeting.
Councilman Newcomb made a motion that the Zoning Ordinance - Section 710 -
be continued until the March 16, 1992, Council meeting. Councilman
Scoggins seconded the motion. Motion was approved 7-0. Mayor Bacon asked
if there was any public comment on the amendment. There was none.
(B) Variance Request - Side Yard Setback - 162 Davenport Street
Ms. Dameron stated that Ms. Gladys Elliott is requesting a variance to
reduce the side yard setback from ten feet to one foot for the addition of
a carport at her home. This is in Mr. Scoggins' ward.
Mayor Bacon asked if Ms. Gladys Elliott who was present to step forward
for this hearing. Mayor Bacon then asked if anyone was present in
opposition to this variance request. There was no one present in
opposition.
Councilman Scoggins stated the carport has already been built and that Ms.
Elliott was not aware a variance was necessary in order to build this
carport. Mr. Scoggins asked Ms. Elliott to explain the letter of hardship
which accompanied the variance request.

Ms. Elliott stated that her neighbor's fence is forty-five percent on her
property line which prevented her from building the carport in the rear of
her yard and rather than ask her neighbor to remove the fence she built
the carport on the side of her house.
Councilman Scoggins made a motion that the variance request to reduce the
side yard setback from ten feet to one foot be approved. Motion was
seconded by Pete Wood. Motion was approved 7-0.
FORMAL BUSINESS:
(A) Bid Opening - Bleachers for Rose Garden Park
Mayor Bacon asked if there were any bids in the audience. There were
none. The City received five bids which were opened and read as follows:

Councilman Cramer made a motion that the bids be turned over to the Parks
and Recreation Committee for their review with a recommendation to be
brought back to the March 16, 1992, Council meeting. Pete Wood seconded
the motion. Motion was approved 7-0.
(B) Bid Opening - Two (2) Police Cars
Mayor Bacon asked if there were any bids in the audience. There were
none. The City received three bids which were opened and read as follows:

Councilman Lnenicka made a motion that the bids be turned over to the
Police Committee for their review and either allow the Committee to accept
the low bid or bring a recommendation back to the March 16, 1992, Council
meeting. Jim Hawkins seconded the motion. Motion was approved 7-0.
COMMERCIAL BUILDING PERMITS:
There were none.
BID AWARDS:
(A) Playground Equipment - Rose Garden Park
Councilman Cramer stated the existing wooden equipment at Rose Garden Park
is unsafe and needs to be replaced. Mr. Cramer made a motion to award the
bid to Game Time, the lowest bidder who met specifications. Bill Scoggins
seconded the motion. Motion was approved 7-0. This is funded by the
Community Development Block Grant program.

CONSENT AGENDA:
(A) Approval of February 17, 1992, minutes
Councilman Scoggins made a motion to approve the consent agenda.
Councilman Lnenicka seconded the motion. Motion was approved 7-0.
COMMITTEE REPORTS:
Each Council member was called on to give a report on the activities of
their respective committees. Council members asked their department heads
for an update on the activities of their departments.
Mr. Newcomb stated he would like to suspend the rules to make a motion to
swap two small parcels of land on Corn Road. Jim Hawkins seconded the
motion. Motion was approved 7-0.
Councilman Newcomb made a motion that the Mayor be authorized to execute
the conveyances required to swap a .175 acre tract of land adjacent to J.
E. Loverne's property on Corn Road for a small triangular tract on Corn
Road adjacent to the City of Smyrna property. Jim Hawkins seconded the
motion. Motion was approved 7-0.
Fire Chief Larry Williams stated the Fire Department should be capable of
doing their own laundry within a month thus saving the City approximately
$12,000 - $15,000 a year. The Fire Department is waiting on the equipment
that is on order.
Councilman Hawkins said he would also like to suspend the rules of order
and discuss an item that was not on the agenda which has to do with a new
fee. Bill Scoggins seconded the motion. Motion was approved 7-0.
Mr. Hawkins stated that although the City had for years been picking up
used and discarded tires from businesses and service stations and taking
them to the dump for no charge, he had recently learned the City is being
charged $2.00 per tire at the landfill for disposal. Councilman Hawkins
made a motion to allow Public Works to charge $3.00 per tire for every old
tire that we pick up and take to the landfill. The extra dollar will be
to cover our cost of gasoline and labor to pick up the tire and take it to
the landfill. Councilman Scoggins seconded the motion. Motion was
approved 7-0.
Councilman Cramer asked Park Rangers Lloyd Platt and Jacky Cheek to come
forward. He commended them for the fine work they do enforcing the Codes
of the City and maintaining proper conduct in the City parks.
With no further business the meeting adjourned at 8:08 p.m.
