07-19-1982 Regular Meeting (2)July 6, 1982 - Continued Mayor Bacon advised that Ray Brooks was the Civil Service Board member selected by the other Civil Service Board members. Due to the untimely death of Mr. Brooks, Bob Lynn Davis was selected to fill the unexpired term, effective July 2, 1982. With no further business, meeting adjourned at 9:30 p.m. July 19, 1982 The regular scheduled meeting of Mayor and Council was held July 19, 1982 at Smyrna City Hall. All Council members were present. Also present was. City Attorney Charles Camp, City Clerk Willouise Spivey, Police Chief R. E. Little, Public Works Director Jim David, Parks and Recreation D;[rector Sherry Reavis, Librarian Doris Morris, Civil Defense Director Jim Farley, and representatives of the press. Invocation was given by Councilman Elbert Coalson, followed by the pledge to the flag. Mayor Bacon read a proclamation in honor of Daryl Bedford, proclaiming July 19, 1982 as Daryl Bedford Day, for his outstanding athletic achievements in leading the Campbell High School Boys Basketball team to the State Championship. Citizen Reports: Sue Brissey complained of political signs being posted on utility poles throughout the City and said promises had been made since 1976, with no changes or improvements being made. Mayor Bacon said we are working on the problem, and asked her patience in giving the City a little more time to find a solution. Larry Dunn said a list was being kept in the Inspections Department of signs being illegally posted and these people can be cited into court. Privilege License Transfer: Casa Gallardo Mexican Restaurant, 2728 Spring Road, applied for a wine, beer and liquor pouring license. The applicant, Martha Ann Bunting was not present, and Jack Shinall made a motion the request be tabled to the next meeting. Jim Hawkins seconded the motion which carried by.a 7-0 vote. Rezoning: Paul Argo requested rezoning of property at 1566 Spring Street, Land Lot 59 , from R-15 to Office -Distribution. Mr. Argo was not present and Max Bacon made a motion this request also be tabled to the first meeting in August. Jim Hawkins seconded the motion which carried by a 7-0 vote. Rezoning: John Wieland, President of John Wieland Homes, requested rezoning of property on Woodruff Drive at Spring Road from R-15 to Residential Townhouse District. Mr. Wieland said he would build 24 townhomes on the site. The entrance and exit will be on Woodruff Drive, with no entrances on Spring Road. This property abuts Argyle Elementary School and other commercially zoned property. The Planning and Zoning Board had unanimously recommended the rezoning be approved, and Jim Tolleson made a motion the property be rezoned as requested. Jim Hawkins seconded the motion which carried 7-0. Rezoning: Ivy Ayers requested rezoning of property at 3089 Dunton Street from R-15 to General Commercial to allow him to raise small birds, such as parakeets, canaries, cockatiels. Mr. Ayers sais he did not know how many birds he would begin with, but they are not noisy and should not cause any disturbance to the neighbors. The structure used to house the birds would be built behind his home, which is on a 100'.x 150' lot. Mr. Johnny Watson was spokesman for several in the audience opposed, and also presented a petition from approximately 28 surrounding neighbors opposed to the rezoning (petition to be made a part 11 !of these minutes). Mr. Watson said they were concerned because of the noise disturbance; also the building Mr. Ayers is constructing is not being professionally dAne and is too close to the property line. Jim Hawkins read the minutes from the Planning and Zoning Board meeting where they denied recommendation of the rezoning,fand made a motion the zoning request be denied. Max Bacon seconded the motion which carried by a 7-0 vote. Jim said he felt this would be spot zoning since there is no other commercially zoned property abutting Mr. Ayers'. There were no commercial building permits to bring before council. Sarah Jones said that in many cases, the City is required to enter onto private property to lay pipe or correct drainage problems and recently we have received criticism about also relandscaping the property after the work is completed. Mrs. Jones said she felt we should adopt the same the policy the county uses, and made a motion the following policy be adopted: July 19, 1982 - Continued When the City is required to enter private property to work on an easement, the property should be relandscaped and restored to original condition. However, when pipe is laid at the owners request, the pipe will be paid for by the owner, the City will install it at no cost, but the owner will then be responsible for the cleaning up and relandscaping of the property. Also, any pipe installed by the City must meet specifications. Jim Hawkins seconded the motion to adopt this policy, which carried.by a 7-0 vote. Ordinance Amendment: Sarah Jones read the following proposed amendment which she said would help our park rangers in determining what is lawful and unlawful in carrying out their duties. Section 16-2 (d) It shall be unlawful to create or maintain a nuisance or disturbance or engage in any activity which because of -noise, use of vile language or danger to the health, safety or morals of the citizens of Smyrna or users of a city park interfers with the use and enjoyment of a park. Any person or persons who shall interfere with the use of a park or violate any ordinance of the City of Smyrna, Park Rules or Regulations, or State of Georgia Act may be required to immediately leave a park by any authorized park employee, park ranger or law enforcement officer and thereafter such offender shall not return to the park or use park facilities for a period of 24 hours. Refusal to obey such lawful order or if such offender shall return within 24 hours to the park, shall be unlawful and punishable as a misdemeanor. .It shall be unlawful for any person to drive any vehicle upon or across any part of any public park of the City except upon roadways laid out and main- tained for vehicular travel. This section shall not apply to park employees whose duties require them to drive park maintenance equipment over said park. The parking of automobiles by users of a park shall be permitted in approved parking areas in the public parks of the City as long as such parking is in accordance with traffic laws, rules and regulations of the park department, and provided the occupants of automobiles do not create a disturbance or violate any law or ordinance of the City or the State. It shall be unlawful for any vehicle to be parked on any of the drives, avenues, or parking lots in any public park between the hours of 12:01 a.m. and 7:00 a.m. daily. It shall be unlawful for any person to park any vehicle upon any of the drives, avenues, or pa'r.king lots or at any other place within any park, except by an authorized park user during the period of such persons use of the park and attendance to his or her vehicle. It shall be unlawful for any person operating a motor vehicle upon any road within any of the City of Smyrna Parks to exceed the speed of 15 miles per hour. Sarah Jones made a motion the amendment be approved. Max Bacon seconded the motion which carried by a 7-0 vote. Sarah Jones made a motion that Sherry Reavis be authorized to proceed in applying for a Wells Fargo Gamefield Grant for a gamefield fitness court at North Smyrna Park. _ Jim Hawkins seconded the motion which carried 7-0. Bid Request: James Williams made a motion that bids be requested for two MSA air packs for the Civil Defense Department to be opened the first meeting in August. Mr. Farley said these additional air packs were needed to meet State specifications for equipment used on their rescue vehicles. Max Bacon seconded the motion which carried by a 7-0 vote. Committee Reports: (Water & Sanitation) Jim Tolleson called for a committee meeting on July 26th at 5:30 p.m. Jim Tolleson made a motion the rules be suspended to allow him to place a motion. Jim Hawkins seconded the motion which carried 7-0. Jim Tolleson made a motion that approval be given to purchase 100 underground liners at a cost of $7,310. These liners are needed due to increase of new construction in housing developments. James Williams seconded the motion which carried by a 7-0 vote. Max Bacon asked if property owners failed to replace worn liners if the trash wbuld be picked up. Jim Tolleson said the policy was not to pick up trash unless it is in the proper containers. July 19, 1982 - Continued (Finance) Jim Hawkins said the financial statements would be ready tomorrow. The new computer disk has been delivered and will greatly expand the storage capacity of our computer. (Library) Doris Morris said the library was continuing its summer reading program; Wednesday was music and magic day and July 28th would be clown day. Also, contest entries for the reading program must be submitted by August 3rd. (Privilege License) Jack Shinall asked Willouise Spivey to be sure that a copy of each application fors -liquor, malt beverage or wine license be furnished to each councilman as soon as they are received. (Parks) Sherry Reavis said the City would be hosting the GRPS swimming and diving championship to be held July 30th and 31st. Mayor Bacon said the auction for all surplused equipment would be held July 31st beginning at 9:00 a.m. Announcements: Jonquil Breakfast on July 21st; CMA meeting at Acworth Beach on July 27th and next council meeting August 2nd.
