01-05-1991 Regular MeetingJanuary 5, 1981 The regular scheduled meeting of Mayor and Council was held pursuant to the Charter on January 5, 1981 at the Smyrna City Hall. The meeting was called to order at 7:30 o'clock"p.m. by presiding officer Mayor Frank Johnson. All Council members were present. Also present was City Attorney Charles Camp, City Clerk Willouise Spivey, Police Chief R."E. Little, Fire Chief Don.Atkinson, Public Works Director Jim.David, Parks and Recreation Director Bill Johnston, Building Inspector. Dan Steely, Civil Defense Director Jim Farley, and representatives of the press. Invocation was given by Jim Hawkins, followed by the pledge to the flag. There were no citizens reports. Presentation: Bill Haber and Bill Neal6n, representatives from Dobbins Air Force Base presented Council with a copy of the Base Air Installation Compatible Use Zone (AICUZ) report. The intent of the program is handling the problem of encroachment of civilian communities around the airfield over the years, in a manner which would be fair to both the Air Force Base and civilian communities. The two basic problems are (1) the accident potential hazards for civilian communities and (2) the problem of noise. This program is an attempt to develop a compatible use development for the civilian community and the Air Force Base. They have hopefully segmented and channel- ized the threats into as small a geographic area as possible and are .informing surround- ing civilian areas so that this plan may fit into future planning and zoning activities, and this report offers their recommendations for future development. They asked that _ Mayor and Council consider adoption of the AICUZ program in all future zoning ordi- nances, building codes, development plans, etc. Hearing Continuation: Mr. James M. Henson, who was heard at the last meeting to protest the payment of two delinquent water account bills was present in the audience. Mr. Henson said he was there as a spectator only; that the bills had been paid. ' Variance request: Mr. Big Yin Cheng, 2665 Gilbert Street, requested a side yard variance to construct an addition to the house;.which would be. 712 feet away from the adjoining property owner. 'Mr. Cheng was not present and Jerry Mills made a motion the request be tabled. John Steely seconded the motion which carried by a 7-0 vote. Variance request: South Downs, Inc. and Minchew Interprises, Inc. requested the following variances to construct fee -simple townhouses, a classification which is r_.M not included in our present zoning ordinance. (1) Reduce the minimum floor area from 1100 square feet to 900 square feet to ` bring the affordable house back into the City. Jim.Tolleson said he thought 900 square feet as entirely too small and suggested 1000 square feet as a minimum, allowing one unit per cluster. Jim Tolleson made a motion the variance be granted, allowing a minimum floor space of 1000 sq. ft. instead of 1100, one -unit per. clusterr. �- John Steely seconded the motion which carried by a 7-0 vote. (2) Parking within the right of way, which would not mean on the street parking, y but parking in the driveway which would be a part of the City right of way. Jim Tolleson made a motion the variance be granted to allow parking on the paved pad of the driveways, which would be within the right of way, provided they do not cross the plane of the curb line. Jerry Mills seconded the motion which carried by a 7-0 vote. w (3) Mr. Minchew requested the 10 foot buffer strip required along property lines be waived. Jim Tolleson made a motion the variance be granted, seconded by Jerry Mills. Vote on the motion carZ6est, 'a 7-0 vote. (4) Mr. Minchew said this r uildings not meeting the required separation distances, had been take are of in his previous variances of 30 foot front set- back, 10 foot side c]earance, and 30 foot back setback. (5) Coverage of the land including paving and drives is approximately 46%. Under Section 801 "Residential Districts", maximum coverage is 35%. Mr. Minchew requested +' a variance to maintain the 46% coverage. Jim Tolleson made a motion the variance be allowed to maintain the 46% coverage as requested. Jim Hawkins seconded the motion which carried by a 6-1 vote. John Steely voted against. (6) Mr. Minchew,requested that the open space land requirement per Section 1013.10 � which creates a common area, be waived. Jim Tolleson made a motion that Section 41, 1013.10 of the ordinance be waived. Jim Hawkins seconded the motion which carried by a 6-1 vote. Jerry Mills voted against. .r Continued - January 5, 1981 (7) Section 707.2 requires 26 foot width of pavement for roads. Mr. Minchew requested a variance for 24 foot wide roads. John Steely made a motion this request be denied. Jerry Mills seconded the motion, which carried by a 7-0 vote. L� (8) This item requesting a variance for fire stops every 8 living units instead of the 4 required by city fire codes was withdrawn. There were no commercial building permits to bring before Council. Elbert Coalson made a motion that Chamber of Commerce dues for 1981 in the amount of $600 be approved. Jim Hawkins seconded the motion which carried by a 7-0 vote. Jim Tolleson made a motion the minutes of December 1, 1980 be approved as submitted. Jack Shinall seconded the motion which carried by a 7-0 vote. Jerry Mills made a motion the minutes of December 15, 1980 be approved as submitted. Max Bacon seconded the motion which carried by a 7-0 vote. Committee Reports: John Steely said he had had quite a bit of vandalism in his ward recently, especially with cars driving through yards. John said he was begging and pleading with those responsible not to do it, because when they were caught, they will find it is a serious offense. (Water) Jack Shinall said he had been requesting information in regards to the cost to developers of water meters and sewer taps and his committee is working on putting this information together. Jim Hawkins said a lot of citizens were putting iron stakes in their yards on the right of way to prevent cars from driving through their yard. He asked Attorney Camp if the City would be liable if a child should fall on one and be injured. Mr. Camp said if the City had actual knowledge of the stakes being on a right of way and did not require the homeowner to remove them, we possibly could be liable. (Sanitation) Jim Tolleson said the Christmas holidays put us behind with trash pickups but we were beginning to catch up. Jim Tolleson reported the Central Dispatch System is moving along slowly but surely and training of the dispatchers begins tomorrow. They are still hoping to implement the system the end of January, but are not pushing themselves for that date. Jerry Mills thanked Attorney Camp for the good job he had done in defending the law suit against the City over the 1,000 acre annexation. Announcements: Next Council meeting on January 19, 1981.
