03-04-1991 Regular MeetingMarch 4, 1991 The regular scheduled meeting of Mayor and Council was held pursuant to the Charter on March 4, 1991 at Smyrna City Hall. The meeting was called to order at 7:30 o'clock p.m. by presiding officer Mayor A. Max Bacon. All council members were present. Also present was City Administrator John Patterson, City Clerk Melinda Dameron, City Attorney Charles E. Camp, Police Chief Stan Hook, Public Works Director Vic Broyles, Personnel Director Jane Mears, City Engineer Ken Hildebrandt, Fire Chief Larry Williams, Finance Director Emory McHugh, Communications Director Steve Ciaccio, Parks and Recreation Director Sherry Reavis, Community Relations Director Kathy Barton, Library Director Laurel Best and representatives of the press. Invocation was given by Elijah Jones, pastor of Greater Zion Hill Baptist Church, followed by the pledge to the flag. CITIZENS INPUT: Sue Brissey complained of junk cars and banners at a business on Atlanta Road and also stated the dump on No. Cooper Lake Road is still being used on a regular basis, even though she has been told numerous times that it has been closed and should be locked. Mayor Bacon said he would ask the Public Works Committee to look her complaint and determine if the landfill should, in fact, be closed for any use. Mrs. Brissey said the underground garbage cans all over the City are in deplorable condition and in need of repair. Mayor Bacon stated it is up to each individual property owner to call and order repairs or new parts for the containers. PUBLIC HEARINGSā€¢ (A) Privilege license - beer and wine package sales - McFarlands Super Valu, 2957 Atlanta Road John Patterson stated that Troy E. Glass, Sr. has submitted an application as the new agent to hold the beer and wine package license for McFarland Super Valu, formerly Big Boy Food Store. The police investigation was favorable and there was no opposition. Mr. Glass said he was familiar with the ordinance and held the license for two other stores. He was fined several years in Kennesaw when one of his clerks sold to a minor during a sting operation and stated they now have a very strict policy about asking for identification before selling alcoholic beverages. Bill Scoggins made a motion the license be approved as requested. Jack Shinall seconded the motion which carried 7-0. (B) Privilege license - beer and wine package sales - Big Star #5789, 2784 Hargrove Road John Patterson stated that Howard Horne has applied as the new agent to hold the package beer and wine license for Big Star. The police investigation was favorable and there was no opposition. Mr. Horne stated he was a General Manager with Big Star and would be responsible for the two stores in Smyrna. He had received a copy of our ordinance and was familiar with it. Mr. Horne said all their employees are thoroughly trained and then required to sign an affidavit to that effect. Also, they have mystery shoppers who check on them from time to time. Bob Davis made a motion the transfer be approved as requested. Bill Scoggins seconded the motion which carried 7-0. (C) Privilege license - beer and wine package sales - Big Star #5765, 3205 South Cobb Drive. John Patterson stated that Mr. Horne would also be holding the license at the South Cobb Drive location. There was no opposition and Jim Hawkins made a motion the transfer be approved. Jack Shinall seconded the motion which carried 7-0. FORMAL BUSINESS: (A) Bid openings Bids for the renovation of Church Street pool were opened, read and recorded as follows: March 4. 1991 meetina - continued Southern Gunite, Inc. $58,675.00 Wiley & Wiley $52,814.00 Bill Scoggins made a motion the bids be turned over to the Parks Committee for their recommendation back to full council at the next meeting. Kathy Jordan seconded the motion which carried 7-0. Bids for new police cars were opened, read and recorded as follows: Southlake Ford Wade Ford $13,672.00 each $14,185.00 each John Steely made a motion the bids be turned over to the Police Committee for their recommendation back to full council. Wade Lnenicka seconded the motion which carried 7-0. (Opus) $4,843.00 American Indetel $4,956.00 Executone $3,963.75 TIE Communications $4,862.00 AT&T $4,908.75 Kathy Jordan made a motion the bids be turned over to the Fire Committee for their recommendation back to full council at the next meeting. Wade Lnenicka seconded the motion which carried 7-0. (B) Appointment to Parks and Recreation Commission - Ward 2 Wade Lnenicka stated that because of military duty, Peter Correa had resigned from the Parks Commission with 6 months left on his term. Mr. Lnenicka made a motion that Eddie Hellmann be appointed to fill the unexpired term. John Steely seconded the motion which carried 7-0. RTn AWAPnR e (A) Tennis court resurfacing Bill Scoggins made a motion the low bid of $3,400 be awarded to Premiere Coating. Jack Shinall seconded the motion which carried 7-0. COMMERCIAL BUILDING PERMITS: CONSENT AGENDA: Nothing to report. (A) FY91 budget adjustment - Recreation Coordinator (B) Approval of February 18, 1991 minutes Jim Hawkins made a motion that item (A), approval of the position of Recreation Coordinator be approved. Kathy Jordan seconded the motion which carried 7-0. Jim Hawkins made a motion the minutes of February 18, 1991 be approved as submitted. Kathy Jordan seconded the motion which carried 5-0, with Jack Shinall and Bob Davis abstaining. Mayor Bacon announced that the show cause hearing for Oasis Bottle Shop had been removed from the agenda tonight after being tabled several times, pending a final disposition on the State Court charges. Hopefully we will be ready to continue this hearing the first meeting in April and it will be placed on the agenda at that time. COUNCIL INPUT: Wade Lnenicka reported the new Jane Lyle Road has been completed at no cost to the city, including paving, lights, and left turn lane. Mr. Lnenicka said we have had good success in the middle East in the war that has touched us all. It is important now to get all the prisoners of war home quickly and safely. March 4, 1991 meetinq - continued Kathy Barton reported on Community Relations activities and the upcoming Jonquil Festival. Bill Scoggins said this Friday night the Parks Department would sponsor another free concert at Wills High School and encouraged everyone to go because it would be an excellent show. Jim Hawkins said he had been concerned about the image of the city the last 2 or 3 weeks after having the Supreme Court overturn the Cobb Superior Court decision regarding the Platinum Plus nude dance club and the recent prostitution arrests just outside the City. There were also two other articles in the newspaper that he felt made the City look bad, questioning the ward residency of Councilman Bob Davis. Mr. Hawkins said he has told council that he lives in Ward 1 and asked him to state, for the public record, if he lived in Ward 1. Mr. Davis said he did, he lived at 2211-M Lake Park Drive. In response to Mrs. Brissey's earlier complaint about dumping at the old landfill, Vic Broyles said the City uses that property for storage because that is the only space we have available. Jack Shinall asked Mr. Broyles to prepare a breakdown of what is being taken to that location with a projected cost of taking it elsewhere, to have ready by the next meeting. Kathy Jordan stated the fire fighters have an attractive new design for their uniform patches. John Steely said he recently received a letter from MADD commending the efforts of Frank Durrance and Mike Brown in our STEP division of the Police Department. Mr. Steely said he also appreciated the good job they are doing. With no further business, meeting adjourned at 8:20 p.m. A.
