The scheduled meeting of the City of Smyrna Planning Commission was held
at City Hall, November 24, 1975 and called to order at 5:30 o'clock P. M.
by Chairman Al Brooke.
R. Lafelle Fuff
The first order of business to come before the Planning Commission was
that of R. Lafelle Ruff, Concord Rd. & Hurt Rd. property. Request to
change zoning from R-20 to Parcel A - 0. I. (Office Institutional) ,
Parcel B - N. S. (Neighborhood Shopping)(Planned Shopping Development),
Parcel C- 0. I. ( Office Institutional). Property being described as follows:
PARCEL A
BEGINNING at a point, marked by an iron pin, at the point
formed by the intersection of the northwest side of Concord
road with the southwest side of Hurt Road; thence running
along the northwest side of the right of way line of
Concord Road, southwest 583.2 feet to a point; thence
running north 610.5 feet more or less to a point on the
south side of Hurt Road; thence running along the South
side of the right-of-way line of Hurt Road, east 607.3
feet to a point and the point of beginning and consisting
of 3.8 acres. Also:
PARCEL B
BEGINNING at a point on the north side of Concord Road
583.2 feet from the point formed by the intersection of
the northwest right-of-way line of Concord Road and
the 'southwest right-of-way line of Hurt Road; thence
running southwest 572.5 feet to a point. on the north
side of Concord Road; thence running northwest 520
feet.to,-a point; thence running northeast 454.8 feet to a
point on the south side of Hurt Road;' thence running
east 517.5 feet to a point on the south side of
Hurt Road; thence running south 610.5 1det more or less
to a point and the point of the beginning and consisting
of 9,7 acres. Also;
PARCEL C
BEGINNING at a point on the northwest.side of Concord
Road 1155.7 feet from the southwest corner of the
intersection of Hurt Road and Concord Road; thence
running northwest 520 feet to a point; thence running
west 566 feet to a point; thence running south 363.6
feet to a point; thence running southeast 683.1 feet
to a point on the northwest side of Concord Road;
thence running along the northwest right-of-way line
of Concord Road, 335.7 feet northeast to a point, and
the point of beginning, said property consisting of
8.6 acres.
Mr. E. G. Wilson,Jr. Real Estate Agent and Mr. Dupree Attorney for
Mr. Ruff, were present to represent Mr. Ruff. After Discussion by the
Planning and Zoning Commission Chuck Camp made the following motion:

By having a concentration of automobiles in a relatively small
area between two thoroughfares (Hurt Rd. & Concord Road) that
presently carry a high volume of traffic for their present width
and construction any further major construction would have a
detrimental impact on the health of the residents of the area.
The property which is the subject of the zoning change is not
contiguous.,to any other property.zoned ,for Commercial use
under the zoning classification of the City of Smyrna. If the
request for change of zoning is approved, the approving body
would in effect be sanctioning strip zoning in an area surrounded
by single family dwellings. Theoonly other contiguous property
is a small portion next to the•apartment complex which is also
zoned residential., There is no commercial property which is
contiguous. The only commercial property near subject property
is a small tract of land up and across Eoncord Rd. . This
property has been zoned for L. C. (Limited Commercial) more
than 15 y_ears and has never been deieloped,`except for the 7-11 Store.,
that in and of its.self shows. the economic.value of rezoning this
property would not be beneficial to ^the community or the owner
of this property, since there is property within that proximity
which is not being used at all. Plans showing the proposed use
of subject property indicated a road will be constructed between
Hurt Rd. and Concord Rd, a few hundred feet from existing intersection.

This would reduce.road capacity and create safety hazards.even with
appropriate traffic signals. The residents that presently live
on Hurt Rd. have considerable difficulty getting out of their.
drives at the present time —There are high quality homes
currently being erected on property adjacent to subject property

giving support to the position of area residents that subject proper
is suitable for residential development or other than Commercial,
Office or N. S,'Development, Several tracts between South Cobb and
the triangle at Concord & North Cooper Lake are zoned for Commercial
use but not developed, The Shoppiing.Center.at the intersection of
S. Cobb Dr, and 'Concord has substantial unleased'space (including the
Grant City Store which is being liquidated) and room for expansion,
Dickson Shopping Center has vacent commercial space also, which'
shows there is no definite need for office or shmpping areas, when
there is so much already vacent and unused in the proximity of the
subject property. The residential character of the neighborhood is well

established and adjacent property owners have found it economically
feasible to develop it for residential use , which includes the property
S. W. belonging to Dr. Manor. On four (4) previous occasions similar
requests for rezoning on the same property have been denied by the
Planning and Zoning boards, of Cobb County Commissioners and City Council .
Only two things have occured relative to this property since the last
request for rezoning was denied (1) a substantial number of high quality
new homes have been built in the area and (2) The owner of subject
property has removed a large number of trees from subject property
leaving considerable debris in the area where trees have been removed.
In closing Mr. Camp moved to recommend to Mayor and Council this
rezoning be denied for reasons so stated above. Vote on the motion was
unanimous.
DON PLOW
The second order of business to come before the Planning and Zoning
Commission was that of Don Plott, 705 Cherokee Rd. . Request to
change zoning from L. C. to N. S. . Property being described as follows:
All that tract or parcel of land lying and being in
Land Lot 374, 17th District, 2nd Section, Cobb County,
Georgia and being Lot 1, Block M, Belmont Hills
Subdivision as per Plot recorded in Plat Book 11,
Page 21, records of Cobb County, Georgia and being more
particularly described as follows:
BEGINNING at the intersection df the north side of
Cherokee Road and the west side of San Fernando Drive;
running thence west along the north side of Cherokee
Road a distance of 115 feet to an iron pin; running
thence north along the line between lots 1 and 2 a
distance of 105 feet to an iron pin; running thence
east a distance of 115 feet to an iron pin on the west
side of San Fernando Drive; running thence south along
the west side of San Fernando Drive a distance of 105 ft. to
an iron pin and the point of beginning.
Jack Miles made a motion to recommend that the property keep its present
zoning classification of L. C. but be granted a varience to use as an
Antique Shop; Vote was 3 for the motion .:with 1 abstaining.
After some discussion by the Zoning Commission Chuck Camp made a
motion to recommend to Mayor and Council that the Future Land Use
Map be changed and reconstructed so as to show the strip of property
running from Hurt Rd. down Concord Rd. presently designated 0. I. to
RT20 (Residential), After proper notice and advertisement. Vote on the
motion was unanimous.
