10-25-1976 Regular Meeting59 OCTOBER 250 1976 The scheduled meeting of the City of Smyrna Planning Commission was held at City Hall, October 25, 1976, and called to order at 5:30 o'clock P.M. by Chairman Al Brooke. Also present was Tom Corso, Sam Owens, Allen Potter, Richard DeBord and Anita Greathouse. Mr. Jack Miles and Mr. Jack Strickland were absent. The first order of business was a request from I.D. & Ellen Moore to rezone 1446 and 1450 Roswell St. located in Land Lot 561 from F. C. to G. C.. Property being described as follows: All that tract or parcel of land lying and being in land lot 561 of the 17th District and 2nd Section of Cobb County, , Georgia, and being part of Lot 1 of Green and Sams Addition as per plat recorded at Plat Book 1, Page 44, Cobb County, Georgia Records, and being more particularly described as follows: BEGINNING at a point on the South east side of Roswell Street 401 feet Northeast as measured along the Southeast side of Roswell Street from the intersection .of the Southeast side of Roswell Street and the Northside of Whitfield Street; running thence North 71 degrees East along the Southeast side of Roswell Street and the North side of Whitfield Street; running thence North 71 degrees East along the Southeast side of Roswell Street 135.6 feet to a point; thence South 14 degrees 24 minutes East, 285.9 feet to a point; thence North 40 degrees 34 minutes West along the property of Mrs. W. P. Cochran 306.5 feet to a point on the Southeast side of Roswell Street being the point of beginning, as per plat by Lane S. Bishop, dated October 15, 1970. Mr. & Mrs. I. D. Moore were present and stated they wanted to use the exist- ing:building for a Lawn Maintenance Office. They also stated they would store their equipment behind the building. After some discussion Tom Corso made a motion to recommend to Mayor and Council the request to rezone the above described property to G. C. be Denied. Reason being that it does not conform to the surrounding neighborhood. Mr. Corso did recommend that the property be rezoned to 0. D. which would still allow them to carry on the business which they requested. The Commission also stated that storage and parking of equipment would not be allowed in front of the building but, parking of equipment should be in the drive and side yard only. There will also be a buffer strip required next to any adjoining residential property. The vote was four for the motion and one against. The second order of business was a request from Glen Robinson III and Thomas L. Fricks to rezone 2365 Spring Street, located in Land Lot 776 from Residential to 0. I. . Property being described as follows: 60 All that tract or Parcel of land lying and being in Land Lot 776 of the 17th District, Second Section of Cobb County, Georgia, and being Lot 27 in Block B of Rolling View Acres, Unit One, as per plat of Watts and Browning, Engineers, dated June 12, 1962, and recorded in Plat Book 24, page 123, Cobb County Records, more particularly described as follows: BEGINNING at the northwest corner of Spring Street and Rolling View Dr. and running thence northerly along the westerly side,Rolling View Drive:95 feet to a point; thence northwesterly 183.5 feet to a point; thence southerly along the easterly line of lot 1 in said block and subdivision 100 feet to the northerly side of Spring Street: thence easterly along the northerly side of Spring Street 180.5 feet to the point of Beginning. LESS AND EXCEPT, however, from the above described property, that portion thereof consisting of.approximately .155 acres, heretofore condemned and acquired by the City of Smyrna for widening the right-of-way of Spring Street to 100 feet in width pursuant to Ga. Highway Project SUS 1383 (1), as is more particularly described in condemnation proceeding know as Civil Action #20983, Cobb County; Georgia Superior Court. Mr. Westbaxter, Attorney for Mr. Robinson and Mr. Pricks was present and stated that they wanted to use the property for a Real Estate Office. After a short period of discussion Allen Potter made a motion to recommend to Mayor and Council this property be rezoned as requested. Mr. Potter also stated that this is a good use for the property and it is contiguous to other commercial property. It was also stated that this was a very good dividing -point for the property west of it and should not be considered a part of that subdivision. Vote on the motion was unanimous. The Commission set a special meeting for November 8, 1976 to discuss proposed changes in the Zoning Ordinance. The meeting was adjourned at 8:00 o'clock P.M. Chairman, Al Brooke
