05-29-1979 Regular MeetingMAY 29, 1979 The City of Smyrna Planning Commission held their regularly scheduled meeting at the Smyrna Police Department Court Room on May 29, 1979 and was called to order at 5:30 o'clock P.M. by Chairman Allen Potter. Also present was M. E. Jernigan, Bill Wood, Bill Nall, Jack Strickland, Tom Corso, George Griffin, Charlie McCoy, and Anita Mullins. The first order of business was a request by Sterling Bowen to approve the preliminary Plat for a 20 lot (2 acres ea.) subdivision on West Cooper Lake Drive. Mr. Bowen and Mr. Ross the engineer were both present. Mr. Bowen stated the street would be 24' wide with a 60' right-of-way. Mr. Bowen requested that it be approved to allow the use of rural route street dev- elopment like Cobb County,where no curbing and guttering is required. Mr. Bowen also stated it would be necessary for all lots to be on septic tanks. After further discussion, M. E. Jermigan made a motion the subdivision be approved subject to (1) septic tank approval by Cobb Coutny Health Dept., (2) curbing and guttering as required by our sub -division regulations or a varience approved by Mayor and Council, (3) proper annexation. The motion was seconded by Charlie McCoy and vote for the motion was unanimous. The second order of business was a request by Southern Bell to rezone property located at 1413 and 1419 Mimosa Circle from R-15 to O.I.. Property being described as follows: All that tract or parcel of land lying and being in land lot 560 of the 17th district and 2nd Section of Cobb County, Georgia, and being more particularly described as follows: Beginning at an iron pin located on the westerly side of Mimosa Circle 216 feet from the northwesterly corner of the intersection of Mimosa Circle and Spring Street (said intersection being the intersection of Mimosa Circle and Spring Street nearest the inter- section of Spring Street and Roswell Street); running thence in a northwesterly direction a distance of 156 feet to a point; running thence in a northeasterly direction a distance of 116.5 feet to an iron pin and corner; running thence in a northwesterly direction a distance of 84.4 feet to a point on the adjacent property line 384.7 feet from feet from the northeast corner of the intersection of Spring Street and Roswell Street; running thence north 30 degrees 41 minutes east a distance of 42.0 feet to an iron nin and corner. running thence south 63 degrees 19 minutes east a distance of 84.4 feet to an iron pin; running thence in a northeasterly direction a distance of 40.6 feet to an iron pin; running thence south 36 degrees 10 minutes east a distance of 168 feet to an iron pin located on the northwesterly side of Mimosa Circle; running thence in a southwesterly direction along the northwesterly side of Mimosa Circle a distance of 118.5 feet to an iron pin; the same being the point of beginning. There was no one present to represent Southern Bell,but the letter was self- explanatory. After a period of discussion Tom Corso Made a motion to recommend the zoning be approved but wanted to remind them of the buffer requirement. The motion was seconded by George Griffin, the vote was 6 for the motion with Bill Wood and Charlie McCoy abstaining. There being no other official business Allen Potter read a letter he had received from the Cobb County Board of Education concerning the zoning of the property across from Brown Elem. School. The letter stated they were pleased they had the opportunity to attend the meeting and make - their comments. There being no further business the meeting was adjourned at 6:30 P.M.
