12-02-2019 December 2, 2019 Mayor and Council Meeting Minutes - SIGNED - LFSMYRNA City of Smyrna Meeting Minutes - Final City Council 2800 King Street Smyrna, Georgia 30080 Monday, December 2, 2019 7:00 PM Council Chambers Roll Call Present: 8 - Mayor Max Bacon, Councilmember Derek Norton, Councilmember Andrea Blustein, Councilmember Maryline Blackburn, Councilmember Charles Welch, Councilmember Susan Wilkinson, Councilmember Tim Gould and Councilmember Lewis Wheaton Also Present: 8 - Tammi Saddler Jones, Scott Cochran, Terri Graham, Scott Andrews, Russell Martin, Landon O'Neal, Tina Monaghan and Tyler Addison Call to Order Mayor A. Max Bacon called the December 2, 2019 Mayor and Council meeting to order at 7:00 PM. 1. Invocation and Pledge: Reverend Claiborne Jones, St. Benedict's Episcopal Church (2160 Cooper Lake Rd) delivered the Invocation and led all in the Pledge of Allegiance. 2. Agenda Changes: 3. A. B. Mayoral Report: There were no agenda changes. Proclamation in Recognition and Honor of Reverend John Calvin Hearst Sponsors: Blackburn Councilmember Maryline Blackburn spoke about Reverend Hearst who recently passed away. She then read the proclamation aloud. Mayor Bacon shared some memories of Reverend Hearst with those in attendance. Mrs. Hearst, the wife of Reverend Hearst, came forward to accept the proclamation from Councilmember Blackburn. Other family members that were in attendance also came forward and pictures were taken. 2019-42 Campbell High School Educational Foundation Report jt onsors: Gould Councilmember Tim Gould provided some background information on the foundation. Four members from the Foundation were present including Campbell High School Principal Dr. Jeanne Walker, Foundation President Susan Carter, Kathy Riggins, Glenn Jardine, and Jim Duelmer. Ms. Carter explained a bit about what the foundation does. They presented Mayor Bacon with a lifelike bobble head of himself as well as a 3D printed Spartan head and photos were taken. Mayor Bacon spoke a bit about being bom and raised in Smyrna, being able to be Mayor of his hometown, and retiring as Post Master in his hometown. He felt that he had the best job in the world. The Mayor is a big supporter of the schools and feels strongly that the schools are what drive the community. Land Issues/Zonings/Annexations: There were no land issues/zonings/annexations. Privilege Licenses: A. LIC2019-21 Public Hearing - Privilege License Request 2019-21 - Brewery - 6255 River View Road STE A, Mableton, GA 30126 - Reformation Brewery LLC dba Reformation Brewery with Bryan Spencer Nix as agent. Sponsors: Wheaton City Administrator Tammi Saddler Jones presented the background information for this agenda item. Bryan Spencer Nix will be the registered agent responsible for the manufacturing and tastings of malt beverages at the referenced location. Bryan Nix has been given a copy of the City's Alcoholic Beverage Ordinance and he attended the mandatory alcohol awareness workshop. Bryan Nix has agreed to abide by the guidelines set forth by the City of Smyrna ordinance governing the manufacturing and selling of alcohol. A background investigation conducted by the Smyrna Police Department failed to reveal information that would preclude issuance of this license. Staff recommended approval of a privilege license for the manufacturing and tastings of malt beverages for Reformation Brewery LLC dba Reformation Brewery with Bryan Spencer Nix as the registered agent. The Mayor announced the public hearing, and no one came forward. The applicant, Mr. Bryan Spencer Nix and his attorney, Mr. Terry Bailey came forward and were sworn in by City Attorney Scott Cochran. Councilmember Lewis Wheaton inquired to make sure that all requirements have been met as well as what methods were in place for ensuring that sales were only to the proper demographic. Mr. Nix shared a bit about his business and his hopes for this new location. There are two existing locations with one in downtown Woodstock and one in Canton. The anticipated opening is within a few weeks, but that will depend on when the necessary paperwork and permits from the State is received. They needed to get City approval in order to get what they need from the state. Councilmember Lewis Wheaton made a motion to approve Privilege License Request 2019-21 - Brewery - 6255 River View Road STE A, Mableton, GA 30126 - Reformation Brewery LLC dba Reformation Brewery with Bryan Spencer Nix as agent. Councilmember Maryline Blackburn seconded the motion. Formal Business: A. RES2019. Adopt a Resolution abandoning a portion of Sports Avenue, consisting of 0.479 acres because it is no longer needed and authorizing the City to convey whatever interest it has in the property to the adjacent property owner, Lennar Homes in exchange for Lennar Homes conveying a strip of property to the City that has an equal or greater value. Sponsors: Norton The information on this item was presented by Ms. Saddler Jones. On July 15, 2019, the City Council approved by a vote of 4-2 the rezoning of 12.495 acres at the end of Sports Avenue from GC to RM-12-Conditional for the development of a 108-unit townhome community. The language in this resolution concludes that the section of Sports Avenue consisting of 0.479 acres has ceased to be used by the public, that no substantial public purpose is served by it and that its removal from the municipal street system is in the best interest of the public. The approved site plan reflected the abandonment of the Sports Avenue right-of-way in exchange for new right-of-way along the northern property boundary, which is in line with the roadway improvements recommended in the Spring Road Livable Cities Initiative study. Staff recommends abandoning the property and authorize the mayor to convey it to Lennar Georgia, Inc or its affiliate in exchange for Lennar Georgia, Inc. or its affiliate conveying the property depicted in Exhibit B and described in Exhibit B 1 to the City of Smyrna. Staff recommended approval of the abandonment of a portion of right-of-way consisting of 0.479 acres at the end of Sports Avenue that is no longer needed and convey whatever interest the City has in the property to the adjacent property owner Lennar Homes. Mr. Garvis Sams came forward to represent Lennar Homes. He provided a summary of information regarding the abandonment and dedication that was taking place. Mr. Sams reminded everyone of the rezoning on the property that occurred earlier in the year. Councilmember Derek Norton made a motion to approve the adoption of a Resolution abandoning a portion of Sports Avenue, consisting of 0.479 acres because it is no longer needed and authorizing the City to convey whatever interest it has in the property to the adjacent property owner, Lennar Homes in exchange for Lennar Homes conveying a strip of property to the City that has an equal or greater value. Councilmember Charles "Corkey" Welch seconded the motion. Sponsors: Welch 2019-434 Approval of "The Secrets of Smyrna," an entertaining, historical street theatre tour of Smyrna's most interesting places and the stories of some of Smyrna's citizens of yesteryear - hosted by the Smyrna Arts Council and scripted and performed by Atlanta Theatre -To -Go, a professional theatre company and non-profit 501(c)(3) organization. The Secrets of Smyrna is proposed to take place on Saturday, October 17 and Sunday, October 18, 2020 from 5:00 p.m. to 9:30 p.m. consisting of three 45-minute walking tours of various downtown locations and one street closure - Memorial Place between Church Street and Atlanta Road, adjacent to the Smyrna Cemetery. Sponsors: Blackburn Committee Reports: Councilmember Derek Norton recognized Assistant City Administrator Scott Andrews since it would be his last meeting at the City of Smyrna. He reminded everyone about the election tomorrow. Councilmember Andrea Blustein wished Mr. Scott Andrews well and thanked him for his time with the City. She spoke about it being the time of year to enjoy time with friends and family. Councilmember Charles "Corkey" Welch thanked Mr. Andrews for his hard work and wished him well in his new endeavors. He concluded his report by reminding everyone to come out for the tree lighting set to take place on December 3rd. Councilmember Susan Wilkinson wished Mr. Scott Andrews good luck in his new job. The Friends of the Smyrna Library and the Dixie Lego Users Group are holding their third annual Books and Bricks Lego exhibit in the Library meeting room Saturday, December 7th through Sunday, December 8th. Tickets will be sold at the door for $3.00 per person and proceeds will benefit the Youth Services department at the Library. Councilmember Tim Gould announced that there are 120 seniors in the 1B program at Campbell High School and 75 of them were recently accepted to the University of Georgia. He reminded everyone to get out and vote and then come out to the tree lighting event. Mr. Gould wished Assistant City Administrator Andrews well and thanked him for his contributions to the City. Councilmember Lewis Wheaton thanked Mr. Andrews for being so helpful. He invited everyone to come out to the tree lighting on December 3rd and the second annual Menorah lighting which is set to take place on December 23rd. Mr. Wheaton spoke about the transit survey and encouraged everyone to participate. City Administrator Tammi Saddler Jones congratulated Mr. Scott Andrews and wished him well at his new job with the City of Covington. Mr. Scott Andrews thanked everyone for trusting him and giving him an opportunity to grow. He truly enjoyed his time here in Smyrna. City Attomey Scott Cochran wished Mr. Andrews well in his new City. City Clerk Terri Graham congratulated Mr. Scott Andrews. She then provided runoff election information for the Mayor seat as well as the council seat for Ward 2. Ms. Graham read aloud the polling locations for all seven wards and let everyone know that there will be 47 parking spaces reserved especially for voters from 3-7pm at the Community Center. Mayor Bacon thanked Mr. Scott Andrews for his time here at the City and wished him the best. 10. Show Cause Hearings: 11. Citizen Input: There were no show cause hearings. Ms. Andrea Blustein, 2407 Country Park Drive, she spoke about Election Day on December 3rd and encouraged everyone to come out and vote. Mr. Ryan Campbell, 2004 White Cypress Court, spoke about Election Day and thanked everyone for making his time in Smyrna a wonderful journey. Adjournment: Meeting Minutes - Final December 2, 2019 Ms. Maryline Blackburn, 1034 Huntington Trace, thanked Mayor Bacon for the years he has given to the City. She spoke of how the upcoming election will shape the City for the future. Inclusive govemment, education, environmental stewardship, diversity, and economic growth in the best interest of the City are issues that should not be taken lightly. Great leaders don't set out to be a leader, they set out to make a difference. It is never about the role but rather the goal. Ms. Blackburn asked everyone to get out and exercise their right to vote. Mayor Bacon adjourned the December 2, 2019 Mayor and Council meeting at 7:47 PM. RESOLUTION 2019-06 WHEREAS, in accordance with O.C.G.A.§32-7-2 and O.C.G.A.§ 36-37-6, the City of Smyrna is authorized to dispose of property under certain conditions; THEREFORE, IT IS RESOLVED, as follows: 1.) The City concludes that the section of Sports Avenue consisting of 0.479 acres (20,860 S.F.) depicted on Exhibit A and described on Exhibit A 1, attached hereto and incorporated herein by reference has ceased to be used by the public, that no substantial public purpose is served by it and that its removal from the municipal street system is in the best interest of the public. 2.) The City further concludes that said property is a narrow strip of land so shaped as to be incapable of being used independently and that a conveyance to the abutting property owner would facilitate the highest and best use of the abutting owner's property. 3.) The city further concludes that the property depicted on Exhibit B and described on Exhibit B 1, is of equal or greater value to the property described in Exhibit A. 4.) Therefore, the city abandons the property depicted and described in Exhibit A and Exhibit Al and authorizes the mayor to convey it to Lennar Georgia, Inc or its affiliate in exchange for Lennar Georgia, Inc. or its affiliate conveying the property depicted in Exhibit B and described in Exhibit B 1 to the City of Smyrna.
