Mayor A. Max Bacon called the September 3, 2019 Mayor and Council meeting to
order at 7:00 PM.
1. Invocation and Pledge:
Pastor Whit Martin, Smyrna First United Methodist Church (1315 Concord Road)
delivered the Invocation and led all in the Pledge of Allegiance.
2. Agenda Changes:
There were no agenda changes.
3. Mayoral Report:
Mayor Bacon announced that the Vittles Restaurant located on South Cobb Drive will
open Thursday, September 5, 2019.

Each recipient was presented their Certificate by City Administrator Tammi Saddler
Jones and a photo was taken. All of those that were presented with an award took a
moment to say a few words. They thanked Mayor and Council, fellow staff, as well as
all of the citizens of Smyrna. K9 Max was also present with his handler Officer
Sperano.
4. Land Issues/Zonings/Annexations:
There were no land issues/zoning/annexations.
5. Privilege Licenses:
There were no privilege licenses.
6. Formal Business:
A. Approval to purchase a New TB260 2019 Taheuchi Mini Excavator with
Rubber Tracks and Open Cab through Sourcewell Contract #
091615-URI United Rentals Branch 951, 1151 Northpoint Parkway
Acworth, Georgia 30102. Funded by the FY20 Vehicle Replacement
Fund for a total Cost of $55,295.75 and authorize the Mayor to execute
any related documents.

City Administrator Tammi Saddler Jones provided the background information on this
agenda item. The Public Works Department was authorized $58,000.00 in the FY20
vehicle replacement fund to purchase a mini excavator. The equipment will be
purchased using the Sourcewell Contract #091615-URI (United Rentals). The
equipment has already been competitively bid through this cooperative contract. The
Public Works Director and the Purchasing Manager recommended approval of this
purchase in the amount of $55,295.75 from United Rentals Branch 951, 1151
Northpoint Parkway Acworth Georgia 30102 and authorize the Mayor the execute any
related documents.
Councilmember Charles "Corkey" Welch made a motion to approve the purchase of a

The details on this agenda item were read aloud by Ms. Tammi Saddler Jones. The
City of Smyrna requested bids for various resurfacing projects. Three bids were
received. The Public Works Director, Purchasing Manager and Croy Engineering
reviewed the bids and recommended award of RFQ 20-001 Resurfacing to the lowest
bidder Bartow Paving Company Inc. located at 1055 Rowland Springs Road
Cartersville, Georgia 30121 in the amount of $1,399,805.68 funded by LMIG and
SPLOST and authorize the Mayor to execute any related documents.

Jail to the lowest proposer Controlled Access Inc., 1420 Williams Drive,
Marietta, GA 30060 funded by FY20 CIP in the amount of $122,650.00
and authorize the Mayor to execute all related documents.

Ms. Saddler Jones reviewed the pertinent information for this agenda item. The City of
Smyrna Police Department budgeted funds to upgrade and replace the current camera
system. The upgrade will provide the ability to retain video data and provide visual
watch in a/1 areas that the inmates occupy. Staff requested information from Cobb
County Government regarding their request for qualifications bid 17-6243 for enterprise
video surveillance and access controls systems. Controlled Access, Inc is one of the
awarded suppliers and their proposed system is compatible with our network
infrastructure. The Police Chief and Purchasing Manager recommended approval of
this camera system from Controlled Access, Inc. in the amount of $122, 650.00.
Councilmember Derek Norton made a motion to approve to Award RFP 20-005 Video
Surveillance Project for Smyrna Jail to the lowest proposer Controlled Access Inc.,
1420 Williams Drive, Marietta, GA 30060 funded by FY20 CIP in the amount of
$122,650.00 and authorize the Mayor to execute all related documents.

D. Approve the amendment to the City of Smyrna's Code of Ordinances
Chapter 66 entitled Offenses and Miscellaneous Provisions by adding
Section 66-17, prohibiting the sales of tobacco products to persons
under the age of 21 and prohibiting the possession, use and purchase of
tobacco products to person under the age of twenty-one (21).

Mayor Bacon asked Councilmember Gould to provide the background information on
this item as he worked hard alongside the schools to get this ordinance to come
before Council.
Mr. Gould stated that the City had received input from local educators and concerned
citizens about the epidemic among young people who vape and use e-cigarettes.
Some key statistics included the fact that 1 in 4 high school students use e-cigarettes
and vaping devices representing a 900% increase in usage since 2011 and there was a
78% increase in use by high school students from 2017 to 2018 and a 48% increase
by middle school students. Based upon the staggering statistics the city recognizes
that an ordinance aimed at reducing the use of tobacco products by those under the
age of 21 would be suitable to protect the health and wellbeing of our youth and
community. The purpose of the ordinance would be to reduce access of Tobacco
Products, including e-cigarettes, vaping devices among adolescents and improve
health within our community and ultimately save lives.
Councilmember Blackburn thanked Mr. Gould for bringing the ordinance forward. She
went on to say that she looks to State Representatives to take the initiative further so
that everyone will understand the detriment that vaping, and e-cigarettes are having on
our youth.
Councilmember Fennel mentioned how he has been touched by the effects of tobacco
through his father and while he doesn't like to interfere with Constitutional issues, he
feels that the ordinance will raise much needed attention to the vaping epidemic.
Councilmember Norton thanked Mr. Gould for his leadership on the ordinance. He
compared it to the hand's free ordinance from a few years back which ultimately led to
the State passing a hand's free law. He hopes that passing this on a local level will
send a message to those at the state level.
Councilmember Blustein thinks that this is an issue better dealt with on a state or
federal level but feels that something needs to be done so she is going along with
passing the ordinance.
Councilmember Tim Gould made a motion to approve the amendment to the City of
Smyrna's Code of Ordinances Chapter 66 entitled Offenses and Miscellaneous
Provisions by adding Section 66-17, prohibiting the sales of tobacco products to
persons under the age of 21 and prohibiting the possession, use and purchase of
tobacco products to person under the age of twenty-one (21). Councilmember
Maryline Blackburn seconded the motion.

Mayor A. Max Bacon vetoed agenda item 8D. (Approve the closing of the following

St., and entire Village Green Circle from Atlanta Rd. from 4:00 PM. - 10:00 PM on

all members of Council were properly notified via email of the veto.
9. Committee Reports:
Councilmember Maryline Blackburn reminded everyone of the importance of Census
2020 and for everyone to be counted. She offered a big congratulations to her friend
Ms. Charity for the opening of the Vittles Restaurant on Thursday.
Councilmember Susan Wilkinson mentioned Vittles and that she and many of her
constituents are excited for the opening.
Councilmember Ron Fennel called people's attention to the annual report which was
recently published and reminded everyone that it can be found on the City website.
10. Show Cause Hearings:
11. Citizen Input:
Mayor Bacon left the meeting at 7:31 PM.
Mayor Pro-tem Derek Norton stepped in for the Mayor in his absence.
There were no show cause hearings.
Mr. Alex Backry, 3459 Shawnee Trail, commented on the City's spending of taxpayer's
money on real estate. He stated that he was working with Senator Perdue and the
Lieutenant Governor on passing a bill that lobbyists cannot run on the local level due
to it being a conflict of interest.
Ms. Maryline Blackburn, 1034 Huntington Trace, announced that she will be seeking
re-election for Ward 3 representative. She cares about her community, cares about
integrity, and cares about the continued excellence of the City.
Mr. David Monroe, 4952 Ridge Oak Run, announced that he will be running for Ward 7
representative in the upcoming election. He has served on various committees with
the City for over ten years and has lived in Smyrna for over twenty-one years. He
seeks to help with clean air initiatives, promoting local schools, and community
development.
Ms. Andrea Blustein, 2407 Country Park, announced that she will be seeking
re-election for Ward 2 representative. Before serving eight years on City Council, she
served over ten years on the Planning and Zoning Commission. She would like to
serve another term on Council so that she may meet her goals and complete her
projects.
Ms. Susan Wilkinson, 2805 Stone Creek Road, announced that she would be running
for re-election for Ward 5 representative. She has lived in Ward 5 for thirty-three years
and considers it a privilege and an honor to serve the citizens and looks forward to

Mr. Derek Norton, 1000 Afton Way SE, announced that he will be running for Mayor of
Smyrna. He is in his fourth year as Ward 1 Representative and was assigned as
Mayor Pro -tern in 2017 by Mayor Bacon. He and his wife are excited about raising their
family here in the City. Mr. Norton looks forward to carrying on the legacy of Max Bacon
and feels that his experience will allow him to do so without missing a beat.

ORDINANCE 2019-17
AN ORDINANCE OF THE CITY OF SMYRNA, GEORGIA, PROVIDING FOR THE
AMENDMENT OF THE CODE OF ORDINANCES CHAPTER 66, OFFENCES AND
MISCELLANEOUS PROVISIONS, BY ADDING SECTION 66-17 PROHIBITING THE
SALE OF TOBACCO PRODUCTS TO PERSONS UNDER THE AGE OF 21 AND
PROHIBITING THE POSSESSION, USE AND PURCHASE OF TOBACCO PRODUCTS
TO PERSONS UNDER THE AGE OF 21 AND PROVIDING FOR ADDITIONAL
RELATED MATTERS
BE IT ORDANINED BY THE MAYOR AND COUNCIL OF THE
CITY OF SMYRNA, GEORGIA
WHEREAS, State law provides that the governing authority of each municipal
corporation shall have legislative power to adopt clearly reasonable ordinances, resolutions, or
regulations relating to its property, affairs, and local government for which no provision has been
made by general law; and
WHEREAS, the Mayor and Council of the City of Smyrna are charged with the
protection of the public health, safety, and welfare; and
I. PREAMBLE
a. The City of Smyrna received input from local professionals regarding the adverse health and
economic consequences of tobacco use. These professionals include representatives from local
hospitals, representatives of pediatric nurse practitioners and representatives of the American
Heart Association.
b. Based upon the information given by the professionals and other evidence based research,
the city recognizes that tobacco use is the foremost preventable cause of premature death in
America. It causes nearly half a million deaths annually and has been responsible for 20.8
million premature deaths in the U.S. since the first Surgeon General's report on smoking in
1964.
c. The City of Smyrna also received input from local educators. Representatives from Smyrna
schools have reported a significant rise in e-cigarette use.
d. Based upon the input given by the professionals and other evidence based research, the City
of Smyrna recognizes that young people are particularly susceptible to the addictive properties
of tobacco products, and youth that begin using tobacco products are particularly likely to
become lifelong users. The brains of young people are particularly susceptible to the addictive

properties of nicotine. As a result, approximately 3 out of 4 teen smokers end up smoking into
adulthood.
e. Based upon the information given by the local educators; the city recognizes that a
significant percentage of under -aged e-cigarette users get them from peers who are under the
age of 21.
f. National data show that about 95 percent of adults who smoke begin smoking before they
turn 21. The time between ages 18 to 20 is a critical period when many adults who smoke
move from experimental smoking to regular, daily use.
g. The overall use rate of e-cigarettes among youth continues to be higher than other forms of
tobacco and has stymied previous progress in the reduction of the overall tobacco use rate for
youth.
h. In 2015, the Institute of Medicine (now the National Academy of Medicine) concluded that
raising the minimum legal sales age for tobacco products nationwide would reduce tobacco
initiation, particularly among adolescents aged 15 to 17, improve health across the lifespan,
and save lives; and that raising the minimum legal sales age for tobacco products nationwide
to 21 would, over time, lead to a 12 percent decrease in smoking prevalence.
i. The Institute of Medicine also predicted that raising the minimum legal sales age for tobacco
products nationwide to 21 would result in 223,000 fewer premature deaths, 50,000 fewer
deaths from lung cancer, and 4.2 million fewer years of life lost for those born between 2000
and 2019, and would result in near immediate reductions in preterm birth, low birth weight,
and sudden infant death syndrome.
j. The purpose of this ordinance is to reduce the access of Tobacco Products among
adolescents, improve health within the community and save lives.
II. DEFINITIONS
As used in this ordinance:
a. "Distribute" or "Distribution" means to furnish, give, provide, sell, or to attempt to do so,
whether gratuitously or for any type of compensation.
b. "Electronic smoking device" means any device that may be used to deliver any aerosolized
or vaporized substance to the person inhaling from the device, including, but not limited to, an
e-cigarette, e-cigar, e-pipe, vape pen or e-hookah. Electronic smoking device includes any
component, part, or accessory of the device, and includes any substance intended to be
aerosolized or vaporized during the use of the device, whether or not the substance contains
nicotine. Electronic smoking device does not include drugs, devices, or combination products

authorized for sale by the U.S. Food and Drug Administration, as those terms are defined in
the Federal Food, Drug and Cosmetic Act.
c. "Person" means any natural person.
d. "Purchaser" means any person who obtains or attempts to obtain a tobacco product.
e. "Self-service display" means any display from which customers may select a tobacco
product without assistance from the tobacco retailer or the tobacco retailer's agent or employee
and without a direct person -to -person transfer between the purchaser and the tobacco retailer
or tobacco retailer's agent or employee. A vending machine is a form of self-service display.
f. "Tobacco product" means: (1) any product containing, made of, or derived from tobacco
or nicotine that is intended for human consumption or is likely to be consumed, whether
inhaled, absorbed, or ingested by any other means, including, but not limited to, a cigarette, a
cigar, pipe tobacco, chewing tobacco, snuff, or snus; (2) any electronic smoking device and
any substances that may be aerosolized or vaporized by such device, whether or not the
substance contains nicotine; or (3) any component, part, or accessory of (1) or (2), whether or
not any of these contain tobacco or nicotine, including but not limited to filters, rolling papers,
blunt or hemp wraps, and pipes. Tobacco product does not include drugs, devices, or
combination products authorized for sale by the U.S. Food and Drug Administration, as those
terms are defined in the Federal Food, Drug and Cosmetic Act.

"_ g. "Tobacco retailer" means any person, partnership, joint venture, society, club, trustee, trust,
association, organization, or corporation who owns, operates, or manages any tobacco retail
establishment. Tobacco retailer does not mean the non -management employees of any tobacco
retail establishment.

PART 1. MINIMUM LEGAL SALES AGE FOR TOBACCO PRODUCTS
SEC A. MINIMUM AGE
The Distribution of any Tobacco Product to a Person under the age of 21 is prohibited.
SEC B. AGE VERIFICATION
Before distributing any Tobacco Product, the Tobacco Retailer or the Tobacco Retailer's agent
or employee shall verify that the Purchaser is at least 21 years of age. Each Tobacco Retailer
or Tobacco Retailer's agent or employee shall examine the Purchaser's government -issued
photographic identification. It shall be an affirmative defense to a violation of Part 1 of this
ordinance for a Tobacco Retailer or their agent or employee to have reasonably relied on proof
of age as described by the Purchaser's government -issued photographic identification.

SEC C. SELF-SERVICE DISPLAYS
No Tobacco Retailer or their employee or agent shall sell or otherwise Distribute Tobacco
Products by or from a Self -Service Display except in places where persons under the age of
21 are not permitted access at any time.
SEC D. SIGNAGE
No Tobacco Retailer shall sell, permit the sale of, or Distribute Tobacco Products in the City
of Smyrna unless a notice is posted at any location where Tobacco Products are available for
purchase. All notices must be posted in a manner conspicuous to both employees and
consumers, unobstructed from view in their entirety, and within six feet of each register where
Tobacco Products are available for purchase. The City of Smyrna shall provide this notice,
which shall state "UNDER CITY OF SMYRNA ORDINANCE, NO PERSON UNDER THE
AGE OF 21 MAY BE SOLD TOBACCO PRODUCTS, INCLUDING ELECTRONIC
SMOKING DEVICES." The notice must be at least 14" by 11" and the words on the notice
must be legibly printed in a high contrast red color with capitalized letters at least one inch
high. This notice is in addition to any notice required by state law.
SEC E. PENALTIES
Any person found to have violated Part 1 of this ordinance shall be subject to punishment as
provided in Section 1-8 of the Smyrna Code of Ordinances.
PART_2. POSSESSION, USE, AND PURCHASE BY UNDERAGE PERSONS
SEC A. MINIMUM AGE
No person under 21 years of age shall purchase, attempt to purchase, or knowingly possess
any Tobacco Product;
SEC B. AGE MISREPSENTATION
No person under 21 years of age shall misrepresent such person's age in any manner whatever
for the purpose of obtaining illegally any Tobacco Product;
SEC C. AGENT
No person knowingly or intentionally shall act as an agent to purchase or acquire any Tobacco
Product for or on behalf of a person under 21 years of age; or
SEC D. IDENTITY MISREPRESENTATION

No person under 21 years of age shall misrepresent his or her identity or use any false
identification for the purpose of purchasing or obtaining any Tobacco Product.
SEC E. PENALTIES
Any person found to have violated Part 2 of this ordinance shall be subject to community
service not to exceed 20 hours.
III. EXCEPTIONS AND DEFENSES
a. The penalties in this ordinance do not apply to a person younger than 21 years old who
purchases or attempts to purchase Tobacco Products while under the direct supervision of state
or city staff or their authorized appointees for training, education, research, or enforcement
purposes.
b. Nothing in this ordinance prohibits an underage person from handling Tobacco Products in
the course of lawful employment by a Tobacco Retailer.
c. Nothing in this ordinance prevents the provision of Tobacco Products to any person as part
of an indigenous practice or a lawfully recognized religious, spiritual, or cultural ceremony or
practice.
IV. LIBERAL CONSTRUCTION
This ordinance shall be liberally construed so as to further its purposes.
V. SEVERABILITY
If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance or
the application thereof to any person or place, is for any reason held to be invalid or
unconstitutional by the final decision of any court of competent jurisdiction, the remainder of
this ordinance shall be and remain in full force and effect.
VI. EFFECTIVE DATE
This ordinance shall take effect on January 1, 2020.

Chapter 66, Section 66-17
It is the intention of the Mayor and Council, and it is hereby ordained that the
provisions of this Ordinance shall become and be made a part of the Code of Ordinances,
City of Smyrna, Georgia and the sections of this Ordinance may be renumbered to
accomplish such intention.
