Mayor Derek Norton called to order the April 3, 2023 Mayor and Council meeting held at the
Smyrna Community Center in the Magnolia Room at 7:00 PM.

Mayor Norton reminded all that the Jonquil Jog will be on April 15, 2023 in conjunction with the
Campbell High School Education Foundation and Support Smyrna. He also mentioned that there
will be some updates from the Mayor on the water bills soon. And Councilmember Lindley is
absent this evening because he is traveling out of state.

A PROCLAMATION
BY THE MAYOR OF THE CITY OF SMYRNA
In Recognition of Kroger's Positive Contributions to the Smyrna Community
Whereas: The Kroger Co., the nation's largest grocer, opened its store located at 3249
South Cobb Drive in Smyrna in 2012; and
Whereas: the store's team of 190 associates and management are dedicated to
Kroger's purpose: To Feed the Human Spirit®, serving local customers daily by
delivering a seamless shopping experience; and
Whereas: the Smyrna Kroger is an essential member of the community supporting its
school partners: Norton Park Elementary School, Griffin Middle School and Campbell
High School; and
Whereas: the Smyrna Kroger team is committed to the community's first responders,
proudly participating in the grocer's "Standing Together with Our First Responders"
initiative, providing holiday meal gifts to the Smyrna Police Department and Smyrna
Fire Department; and
Whereas: the Smyrna Kroger team has participated in the Smyrna Public Safety
Foundation's "Shop with a Hero" program providing holiday meal bags for students in
Title 1 schools throughout the community; and
Whereas: the Smyrna Kroger team is actively working to create a community free of
hunger and waste through "Zero Hunger I Zero Waste", Kroger's bold social and
environmental impact plan designed to address a fundamental absurdity in our
nation's food system. Nearly 35 percent of all food in the U.S. is unsold or uneaten, yet
nearly 42 million Americans still struggle with hunger; NOW
Therefore: 1, Derek Norton, Mayor of the City of Smyrna, Georgia, do hereby proclaim
Monday, April 3, 2023, as a day of recognition for the SMYRNA KROGER and
encourage all city residents, officials, and staff to acknowledge and celebrate their
many accomplishments and contributions to our community.

8. Privilege License and Show Cause Hearing
A. LIC2023-007 Privilege License Request — Beer, Wine, and Liquor (retail
pouring) — 3315 South Cobb Drive SE, Suite 300 — B & T Restaurant Group
LLC, dba Tonyo's BBQ Experience, with Benjamin Woods, Jr. as registered
agent.
Ward 3 Councilmember - Travis Lindley
Benjamin Woods, Jr., applicant, stated that this restaurant will be a more
upscale barbecue establishment. They will have a soft opening without alcohol

service. This is not his first restaurant. He stated he has taken all of the
necessary classes for responsibly serving alcohol. All servers will take the
online classes, and all management will take all necessary classes. Mr. Woods
presented a document that he has employees sign that indicates expectations
when serving alcohol.
Mayor Pro Tem Gould reminded the applicant that the Smyrna Police
Department does perform compliance checks.
Mayor Pro Tem/Councilmember Tim Gould made a motion to approve item LIC2023-
007, a privilege license request for beer, wine, and liquor (retail pouring) at 3315 South
Cobb Drive SE, Suite 300 by applicant B & T Restaurant Group LLC, dba Tonyo's BBQ
Experience with Benjamin Woods, Jr. as registered agent; seconded by
Councilmember Charles Welch.
The motion to approve carried with the following vote:

A. 2023-074 Authorization to purchase a Peterbilt 520 Chassis with McNeilus high
compaction rear loading 32 yard body sanitation truck in the amount of
$358,090.00 funded in the FY24 Vehicle Replacement Fund and to purchase
through Peterbilt of Atlanta (2395 Old 41 Highway, Kennesaw, Ga 30144)
using the Peterbilt Sourcewell cooperative #060920-PMC / McNeilus source
cooperative #091219MCN.
Citywide
Joe Bennett, City Administrator, presented the following background:
The Public Works Sanitation department has requested early replacement of a
Garbage Truck. The chassis and body will be purchased from Peterbilt of Atlanta
(Peterbilt Sourcewell cooperative #060920-PMC / McNeilus Sourcewell cooperative #
091219-MCN). The vehicle has already been competitively bid through this
cooperative contract. Public Works is requesting approval to order now due to
extended lead time for delivery. Public Works and the Purchasing Department
recommend authorization to purchase.
Councilmember Latonia P. Hines made a motion to approve item 2023-074, to
purchase a Peterbilt 520 Chassis with McNeilus high compaction rear loading 32-yard
7, body sanitation truck in the amount of $358,090.00 funded in the FY24 Vehicle

fulfill role as Project Administrator with Georgia DOT for South Cobb

C. RFP23-018 Authorization to approve RFP23-018 and enter into an agreement
with Match Point Tennis (3736 Upland Dr, Marietta, GA 30066) for resurfacing
of the tennis courts at Tolleson Park and Rose Garden Park in the amount of
$60,400.00 to be paid from ARPA funds and authorize the Mayor to sign and
execute all related documents.

Joe Bennett, City Administrator, presented the following background:
The City of Smyrna requested proposals to resurface six (6) tennis courts at Tolleson
Park and two (2) tennis courts at Rose Garden Park. Three (3) proposals were
received on Monday, March 13, 2023:
Match Point Tennis — $60,400.00
Signature Tennis Courts Inc. — $68,625.00
Court Makers, Inc. — $69,260.00
Based on proposal response and cost, Parks & Recreation and Purchasing
recommend award of this project to Match Point Tennis. 1
Councilmember Latonia P. Hines made a motion to approve item RFP23-018, to
approve RFP23-018 and enter into an agreement with Match Point Tennis (3736
Upland Dr, Marietta, GA 30066) for resurfacing of the tennis courts at Tolleson Park

Ward 4 Councilmember - Charles Welch
Councilmember Welch gave a brief biography on Blake Rogers:
• Georgia native
• Over a decade in leadership roles
• Scholarship to play basketball for Western Kentucky University
• Became basketball coach for Western Kentucky University
• Became Athletic Director for Western Kentucky University
• He and wife have four children and have lived in Smyrna for several years
• Member of Christian Covenant Church
Councilmember Charles Welch made a motion to approve item BCA2023-003, the
appointment of Ward 4 resident Blake Rogers to the Smyrna Parks and Recreation
Commission to fulfill term through December 31, 2023; seconded by
Councilmember Susan Wilkinson.

for the Smyrna is Fabulous Event, on Saturday, June 17, 2023, from 9:00 am —
7:00 pm.

F. 2023-075 Extend the work hours for the Downtown Greenspace Project
beyond those specified in the City's noise ordinance to include daylight hours

Councilmemmber Latonia P. Hines reminded all that Wards 1,2 & 3 are having a Joint
Town Hall on April 11, 2023.
Mayor Pro Tern Tim Gould mentioned the Jonquil Jog again being held on April 15,
2023. The Campbell High School Education Foundation has their golf outing on
Monday, April 24, 2023. And Rebuilding Together Atlanta helped a Smyrna
retired/disabled resident make repairs to his home.
