Recognition of Tierra Renee Faulcon, 2022-2023 Georgia Preschool Educator of the Year (Faulcon Prep Academy) Page 1 of 12 February 20, 2023 City of Smyrna Smyrna Community Center 7:00 PM Mayor and Council Meeting Magnolia Room Mayor Derek Norton introduced the 2022-2023 Georgia Preschool Educator of the Year recipient, Tierra Renee Faulcon. The following was read aloud: Tierra Renee Faulcon is a wife, mom, teacher, and the proud owner/operator of Faulcon Prep Academy, the only licensed in -home preschool in Smyrna. Affectionately called "Ms. Tierra" by her families, she is passionate about influencing her community by ensuring that parents have quality early childhood educational, options that embrace all children. After graduating with honors from Virginia Commonwealth University's School of Social Work, she became a Child Protective Services Investigator for the Virginia Beach Department of Human Services, the entity who once held her custody from birth until her adoption was finalized at 8 years old. Using her personal experience, education, and commitment to the welfare of children she and her husband Michael began to renovate their basement to create a center style preschool in a home that allows parents to place their children in a smaller setting to prepare them academically and socially to enter elementary school. Faulcon Prep Academy received its license to operate in June of 2019 and has since maintained enrollment at capacity, became quality rated, provides summer camps and afternoon tutoring sessions to preschool and school age children. In addition to creating flexible programs to meet the needs of the community, Mrs. Faulcon has now been named the 2022-2023 Georgia Preschool Educator of the Year. As the ambassador of Preschool Family Childcare for the State of Georgia, Faulcon is empowered to use this platform to encourage other providers in Smyrna and surrounding cities to create programs that exceed all licensing standards, are engaging and support the diversity of families and children of all abilities in our community because at Faulcon Prep Academy, "Every child is loved and your family matters". Tierra Renee Faulcon stated she is the proud owner of Faulcon Prep Academy. She is trying to change the face of in -home childcare by creating a place for everyone in a safe space where they are loved. She wanted to be the change in the community that is needed, and she hopes to make a difference. 7. Z21-005 Public Hearing - Zoning Request - Z21-015 - Allow rezoning from R-15 to CBD - Land Lot 522 - 0.52 acres - 2986 King Street - Antiques, Wood, and Rustics LLC Page 2 of 12 February 20, 2023 City of Smyrna Smyrna Community Center 7:00 PM Mayor and Council Meeting Magnolia Room Joe Bennett, City Administrator, read the following brief background: Antique, Woods & Rustics LLC is seeing approval of a rezoning for 2986 King Street from R-15 to CBD for the ability to use the existing structure for antique sales. Joey Staubes, Planner II, presented the following background: Proposed Use: The applicant is requesting a rezoning from R-15 to CBD for the operation of antique sales. The land use will remain Mixed Use (MU) on the Future Land Use Map. Staff Recommendation: Approval of the rezoning from R-15 to CBD for antique sales. Planning & Zoning Board Recommendation: Approval By a vote of 4-2 at the April 11, 2022, meeting. Urban Design Commission Recommendation: Approval at the April 26, 2022, meeting. Mayor & City Council Decision: Denied by a vote of 5-0 at the May 16, 2022, meeting. The court has ordered the city to hold an additional public hearing for settlement of litigation. The zoning conditions have been amended to include additional prohibited uses as well as a deed restriction on 1261 Love Street to maintain a residential zoning category. The proposed rezoning would allow the existing 1,807 sq. ft. structure to be used for antique sales. The subject property is located in an area where the surrounding properties have a future land use designation of Mixed Use. The adjacent properties to the north and west are zoned R15 and are occupied with residential structures, and the adjacent properties to the south and east are occupied with commercial and institutional uses. Community Development has reviewed the proposed rezoning to CBD and found it to be compatible with the adjacent properties and is in compliance with the City's 2040 Comprehensive Plan. Community Development considers the rezoning to be reasonable and compatible with the Mixed Use future land use designation. The proposed rezoning will not require any variances. The subject property is located within the Urban Design District. Therefore, the zoning request is required to go before the Urban Design Commission (UDC). The UDC reviewed the site design and architectural improvements at the April 26, 2022, meeting and recommended approval with the recommendation that the driveway provide decorative brick or stone accents. STAFF RECOMMENDATION Community Development recommends approval of the rezoning from R-15 to CBD to allow antique sales with the following conditions: Standard Conditions Requirements # 2, 3, 4, 5, 8, 9, 10, 12, and 17 from Section 1201 of the Zoning Code are not applicable. The following requirements remain applicable. 1. The developer shall be responsible for any traffic improvements (including additional right-of-way dedications) deemed necessary by either the City or the County during construction plan review. Sidewalks shall be provided by the developer inside the subdivision and outside the subdivision adjacent to any public right-of-way consistent with city's requirements for the extent of the development. A grass buffer with a minimum width of two feet shall be provided between the back of curb and sidewalk. 2. No debris may be buried on any lot or common area. 3. The developer will comply with the City's current tree ordinance. All required tree protection measures shall be adhered to by the developer during construction. 4. All yards and common areas are to be sodded, and landscaped. Irrigate as appropriate. The development shall maintain the CBD setbacks: Front — 12' (King Street) Front — 12' (Concord Road) Side — 0' Rear — 0' 6. All structures will be built to a maximum height of 35' as measured from the sidewalk along the front elevation. 7. The subject property shall provide a 10-foot landscape buffer along the northern and western property lines that adjoin single-family residential zoning. 8. The developer shall meet all fire access requirements deemed necessary by the Fire Marshal during construction plan review. 9. The developer shall be responsible for any water and sewer improvements deemed necessary by the Public Works Director during construction plan review. 10. The developer shall be responsible for any stormwater improvements deemed necessary by the City Engineer. 11. The outside storage of goods or merchandise shall be prohibited. 12. Approval of the subject property for the CBD zoning district shall be conditioned upon the development of the property in substantial compliance with the site plan submitted March 22, 2022, and created by Surveys Plus, Inc. and all zoning stipulations above. 13. The additional stipulations agreed upon by the applicant in the letter submitted and dated on March 22, 2022. If there should be a discrepancy between the stipulations in the March 22, 2022, letter and the stipulations stated above, the stipulations stated above shall apply. 14. The applicant shall provide decorative brick or stone pavers at the entrance subject to approval by the Community Development Director. 15. There shall be a recorded deed restriction for 1251 Love Street that maintains a residential zoning category. The deed restriction shall be recorded prior to the issuance of a land disturbance permit. 16. The following additional uses shall be prohibited: • Motor Vehicle sales, leasing, rental, service, wash, or broker businesses. • Service stations. • Hotels, motels. • Bus passenger stations. • Animal hospitals and veterinary clinics. • Automobile parts or tire stores. • Billiard and pool halls. Mr. Sams stated this establishment is solely to be used as an antique store, period. It will be open Wednesday — Saturday each week. Mediation was assigned to Sr. Superior Court Judge Steve Schuster. As part of the settlement, the applicants would deed restrict the property which can only be changed by the City of Smyrna. Court retains jurisdiction of the case until an agreement is made. He explained that there will be no dumpsters; though, traffic turning models were conducted, and there was maneuverability for sanitation, fire, and police. Councilmember Travis Lindley asked: 1. Does the applicant have a bonifed business plan? It is the Council's responsibility to be mindful of potential success. The concerns he has heard from neighbors is that they are worried about potential future businesses in that space. 2. What has been done to reach out to neighbors to provide a level of comfort? Mr. Lindley has spoken to many, and there is concern about shared parking at the neighboring church. Mr. Sams stated that the applicants have run a successful antique business for over 25 years. He also mentioned that because of the deed restrictions, this can only be operated as an antique store. If in the future another owner wanted to change that, they would have to come before the Council to do so. After mediation, there was to be a meeting with the neighbors to which the applicants were not invited. The owner/applicant was sworn in. She stated that she spoke to several of the immediate neighbors, all of whom have expressed their support for the business. She stated that she spoke to someone named Cheryl at the church across the street, and she said they supported overflow parking. They do not plan to use the property they own behind the subject property. They currently have four booths in Woodstock at an antique mall that is managed by that mall. This will be their first owned business property for this purpose. Councilmember Lindley reiterated that the Sr. Pastor had expressed concern about liability issues being created with parking. Mayor Pro Tern Gould expressed concern that if it ceases to be an antique store, and because of this potential rezoning to CBD, the next owners could open a very different kind of business because of the CBD zoning. Mr. Sams reiterated that they are agreeing to use this property for this use only as an antique store. This property could not be anything else unless it came before the City Planning and Zoning Commission and Mayor and Council. He also clarified that the trees are staying. A public hearing was called, and no one came forward in favor of or in opposition to this item. Councilmember Lindley stated that he would like stipulations added that address the trees so they are not removed, and add vape and cbd shops to the list of prohibited uses. Councilmember Travis Lindley made a motion to approve item Z21-005, a public hearing and zoning request (Z21-015) to allow rezoning from R-15 to CBD on land lot 522 on 0.52 acres located at 2986 King Street by applicant Antiques, Wood, and Rustics LLC; seconded by Councilmember Charles Welch. Kalsang Lama will be the registered agent responsible for the sale of alcohol at the referenced location. Ms. Lama has been given a copy of the Alcoholic Beverage Ordinance and attended the mandatory alcohol awareness workshop. A background investigation conducted by the Smyrna Police Department failed to reveal information that would preclude issuance of this license. Ms. Lama has agreed to abide by the guidelines set forth by the City of Smyrna ordinance governing the sale of alcohol. Kalsang Lama, applicant, came forward. She stated they have been successfully open since December 2019, but many calls have come in asking if they have alcohol, so they believe it would help their business further. Citywide Joe Bennett, City Administrator, read the following background: During December 2022 the City sustained damage to several facilities due to water and irrigation pipes. As staff has been working to rebuild and rehab, it has come to staffs attention that several of these areas were not in compliance and have to be updated. Insurance will not cover the costs to get into compliance. In addition, the fountain at the front of Market Village was damaged beyond repair and must be replaced. Staff is also considering updates to Council Chambers. Staff will come back to Council for approval of additional funds if needed. The budget amendment will increase the transfer out to CIP expense in GF, increase the use of reserves account in the GF, increase the transfers in from GF revenue account in the CIP fund, and add/ increase the expense account for this new project. Finance and Building and Grounds staff recommend approval. Ward 2 Councilmember - Latonia P. Hines Joe Bennett, City Administraotr, read the following background: Ardito Construction was selected by on -call contract for the Terri Meyers Drive storm n work. Unanticipated field conditions, groundwater, necessitates a change order, a copy of which is attached. With the proposed change order in the amount of $455,710.35, the total cost for the project is $132,519.60. The water main feeding Timber Valley Drive had to be removed and replaced in addition to the original work. The existing SDR 21 PVC had major deflection and it was in conflict with the new HDPE install. Additional rock was necessary and Ardito has all rock tickets for review. Additional paving was required to complete the task as well as Thermoplastic Solid Traffic Stripe. Councilmember Latonia P. Additionally, some extents/limits of service are clarified to mitigate excessive costs. Also, while not part of the ordinance, staff would like to confirm the intent to amend the weekly schedule for sanitation and recycling collection to more effectively communicate when alternate collection days are in force due to scheduled holidays. Eric Randall, Public Works Director, stated they want to add to the list of prohibited items, update the schedule for yard waste, strike private collection, etc. He also referenced the attached proposed schedule changes.
