Call to Order
Mayor Derek Norton called to order the May 2, 2022 Mayor and Council Meeting held
at A. Max Bacon City Hall in Council Chambers at 7:00 PM.
Invocation and Pledge:
Deacon Michael Garrett of St. Thomas The Apostle Church (4300 King Springs Road)
led the invocation and Pledge of Allegiance.
Agenda Changes:
Mayoral Report:
Mayor Derek Norton asked any candidates who are present who are running for any of
the upcoming elections to come forward.
Melody Bray, a resident of Smyrna, is running for Georgia State Senate, District 38.
There were no agenda changes.
- The Mayor's Education Awards were a successful event to honor teachers, staff,
volunteers, and students.
- The Jonquil Festival was well -attended and successful as was the Jonquil Jog. Mayor
Norton expressed thanks to staff and volunteers who made it all come together.
A. 2022-217 Presentation of the Georgia Law Enforcement Certification Program
(GLECP) Award for Re -Certification from State Certification Coordinator

C. PRC2022-05 Proclamation in Recognition of Memorial Day Poppy Distribution, May
14th, 21 st, 27th, and 30th, 2022
Mayor Pro Tem/Councilmember Tim Gould read and presented the following:
A PROCLAMATION
BY THE MAYOR OF THE CITY OF SMYRNA
In Recognition of Memorial Day Poppy Distribution May2022
WHEREAS, America is the land of freedom, preserved and protected willingly and
freely by citizen soldiers; and
WHEREAS, millions who have answered the call to arms have died on the field of
battle; and
WHEREAS, A nation at peace must be reminded of the price of war and the debt
owed to those who have died in war; and
WHEREAS, the red poppy has been designated as a symbol of sacrifice of lives in all
wars; and
WHEREAS, the American Legion Auxiliary has pledged to remind America annually of
this debt through the distribution of the memorial flower,
NOW, THEREFORE, 1, Derek Norton, Mayor of the City of Smyrna, Georgia, do
hereby proclaim during the month of May in 2022, the 14th, 21st, 27th, and 30th as
MEMORIAL DAY POPPY DISTRIBUTION DAYS and ask that all citizens pay tribute
to those who have made the ultimate sacrifice in the name of freedom by wearing the
Memorial Poppy.
The proclamation was received by American Legion Smyrna Unit 160 members Glen
Crutchfield, Karen Lindgren, and Cindy Monk.
D. PRC2022-08 Proclamation in Recognition of Professional Municipal Clerks Week, May
1-7, 2022
Councilmember Lewis Wheaton read and presented the following:
A PROCLAMATION
BY THE MAYOR OF THE CITY OF SMYRNA
In Recognition of 53rd Annual Professional Municipal Clerks Week May 1-7, 2022
Whereas: The Office of the Professional Municipal Clerk, a time honored and vital part
of local government exists throughout the world; and
Whereas: The Office of the Professional Municipal Clerk is the oldest among public
servants; and

Whereas: Ken's Comer Grill has been a Smyrna landmark for nearly 50 years with a
tradition of serving good homestyle food, at a fair price, in a family atmosphere; and
Whereas: In 1973, Ken Johnston owned four Huddle House franchises when he was
asked if he wanted to open an additional franchise in Smyrna. He agreed, and Ken's
legacy began at 2934 Atlanta Road; and
Whereas: The restaurant, originally a Huddle House, changed its name in 2005 to
Ken's Comer Grill and is truly a family collaboration with Ken's daughter, Vickie Gordon
serving as manager; and
Whereas: Smyrna proudly recognizes significant milestones in the histories of
cherished, family -owned and operated small businesses which help define the face of
the grateful communities they serve; and
Whereas: Ken's has been a part of many Smyrna residents lives as they celebrated
birthdays, anniversaries, reunions, or just being a place to see and visit with friends
and neighbors. Ken's is fortunate to have had so many great, loyal customers, as well
as staff, and we are proud they have called Smyrna home for the past 49 years; now
Therefore: I, Derek Norton, Mayor of the City of Smyrna, do hereby proclaim May 2,
2022, as a day of recognition for Ken's Comer Grill and encourage all city residents,
officials, and staff to congratulate Ken, Vickie, and the entire staff on their many
accomplishments and contributions to the community.
4. Land Issues/Zonings/Annexations:
A. 2022-149 Public Hearing - Zoning Request - Z22-004 - Allow rezoning from R-15
to RDA -Conditional for the development of two -single family homes -
0.35 acres - Land Lot 632 - 2761 Mathews St - McBev One LLC
Ward 3 / Councilmember Lindley
Joe Bennett, City Administrator, presented the following background:
The applicant is requesting a rezoning from R-15 (Residential) to RDA -Conditional
(Residential) for a two lot single-family detached subdivision. The subject property is
zoned R-15 and is occupied with a single-family home. The applicant plans to demolish
the existing structure and build two new single-family detached homes on the two lots.
The Planning & Zoning Board recommended approval by a vote of 6-1 at the March 14,
2022 meeting. Community Development recommends approval of
the rezoning from R-15 to RDA -Conditional with a density of 5.7 units per acre at 2761
Mathews Street.
Russell Martin, Community Development Director, stated that when this item was
tabled last week, Councilmember Lindley wanted the applicant to meet with the
residents of the adjoining addresses of this neighborhood to discuss concerns as well
as determine if the large tree could be saved. After the meetings, two stipulations,
numbers 25 and 26, were added:
25) The developer shall provide a 5' no access easement along the northern property
boundary of the subject property from the rear property line to the Mathews Street
right-of-way. The access easement shall preclude any future driveway connections to
the development.

these raises 4/4/2022 through the end of the fiscal year. This was an unbudgeted item
and will require the use of reserves.
Councilmember Travis Lindley made a motion to approve item 2022-230, an
amendment to the adopted FY 2022 department level budgets to use General Fund
reserves to fund the FY 2022 impact of the previously adopted new pay grade bands
and pay adjustments in the amount of $317,258.00; seconded by Councilmember
Glenn Pickens.
The motion to approve carried with the following vote:
Aye: 6 - Councilmember Pickens, Councilmember Lindley, Councilmember Welch,
Councilmember Wilkinson, Mayor pro tem / Councilmember Gould and
Councilmember Wheaton
B. 2022-235 Action on change order request from Baldwin Paving regarding the
Windy Hill Road Project.

Councilmember Travis Lindley made a motion to deny item 2022-235, a change order
request from Baldwin Paving regarding the Windy Hill Road Project; seconded by
Councilmember Susan Wilkinson.
The motion to deny carried with the following vote:
Aye: 6 - Councilmember Pickens, Councilmember Lindley, Councilmember Welch,
Councilmember Wilkinson, Mayor pro tem / Councilmember Gould and
Councilmember Wheaton
C. 2022-244 Authorization to allow Croy Engineering (200 Cobb Parkway North,
Building 400, Suite 413, Marietta, Ga) to manage the day to day
construction and inspection for the Windy Hill Boulevard Project for a
period of one calendar year, to begin May 2022 and expire April 2023 in
the amount not to exceed $422,920.00, to be funded from SPLOST
2016, which will cover the cost of a Senior Professional 2 and a
Construction Manager for that one year time frame and authorize the
Mayor to sign and execute all related documents.

Joe Bennett, City Administrator, provided the following background
The Windy Hill Boulevard Project has required additional time and resources,
especially the last two years, and City staff is no longer able to provide the dedicated
time and effort the project needs for proper management and inspection. Therefore,
the City would like to enter into a one year contract with Croy Engineering to allow them
to manage the day to day construction and inspection for this project at a cost not to
exceed $422, 920.00 to be funded from SPLOST 2016, and to cover the cost of a
Senior Professional 2 and a Construction Manager.
Councilmember Travis Lindley made a motion to approve item 2022-244, an
authorization to allow Croy Engineering (200 Cobb Parkway North, Building 400, Suite
413, Marietta, Ga) to manage the day-to-day construction and inspection for the Windy
Hill Boulevard Project for a period of one calendar year, to begin May 2022 and expire

F. AGR2022-12 Approval of the proposal for Professional Survey Services with Croy
Engineering (200 Cobb Parkway North, Building 400, Suite 413,
Marietta, Ga 30062.) for Pat Mell Sidewalk Improvements for the area
between Atlanta Road and Gober Avenue in the amount of $13, 650.00
and authorize the Mayor to sign and execute all related documents.

G. AGR2022-13 Approval of the proposal for Traffic Engineering Services for a Signal
Warrant Analysis for Atlanta Road at Millford Trail - Vinings Forest Circle
with Croy Engineering (200 Cobb Parkway North, Building 400, Suite
413, Marietta, Ga 30062.) for the intersection to be analyzed for a traffic
signal in the amount of $3,160.00 and authorize the Mayor to sign and
execute all related documents.

This Agreement was approved.
H. AGR2022-14 Approval of the proposal for Traffic Engineering Services for Left Turn
Phasing Warrant Analysis for Spring Road at Jonquil Drive with Croy
Engineering (200 Cobb Parkway North, Building 400, Suite 413,
Marietta, Ga 30062.) for the intersection to be analyzed for left turn
phasing to the current traffic signal in the amount of $3,160.00 and
authorize the Mayor to sign and execute all related documents.

9. Ward / Committee Reports:
Mayor pro Tem/Councilmember Tim Gould - Expressed thanks for the Mayor's
Education Awards, especially to staff for organizing this special event that recognized
teachers, volunteers, and students.
Councilmember Lewis Wheaton - Dr. Wheaton is mourning the passing of a resident
and remarkable woman who was very active in the community. He expressed that one
great way to honor her would be to attend the Science Day at Riverview Park in
collaboration with the Georgia Tech Research Institute from 10:00 AM - 2:00 PM. Dr.
Wheaton also introduced his mother who was in the audience.
City Administrator Joe Bennett - Stated he echoes the proclamation to honor City
Clerk's Week. He thanked City Clerk Heather Peacon-Corn and Deputy City Clerk Jill
Head.
City Clerk Heather Peacon-Corn - Made a brief announcement about early voting dates
and locations.
