10-02-2017 October 2, 2017 Mayor and Council Meeting Minutes - SIGNED - LFMonday, October 2, 2017 City of Smyrna Meeting Minutes - Final City Council 7:00 PM Roll Call 2800 King Street Smyrna, Georgia 30080 Council Chambers Present: 7- Mayor Max Bacon, Councilmember Derek Norton, Councilmember Andrea Blustein, Councilmember Charles Welch, Councilmember Susan Wilkinson, Councilmember Doug Stoner and Councilmember Ron Fennel Also Present: 7- Tammi Saddler Jones, Scott Cochran, Scott Andrews, Terri Graham, Ken Suddreth, Ashley Youmans and Maxwell Ruppersburg Call to Order Mayor Bacon called the meeting of the Mayor and Council to order at 7:00 PM Invocation and Pledge: Associate Pastor Dyke Verkerk of Life Church Smyrna Assembly of God, located at 4100 King Springs Rd. gave the invocation and led all in the Pledge of Allegiance Agenda Changes: There were no agenda changes. 3. Mayoral Report: A. Proclamation in Recognition of Public Safety Appreciation Week, October 2-8, 2017 Sponsors: Norton Councilmember Derek Norton read aloud a proclamation in recognition for Public Safety Appreciation Week, October 2-8, 2017. Major Terry McCormick accepted the proclamation for Public Safety, thanking the Mayor and Council. Mayor Bacon asked if there were any candidates in the audience running for once that would like to come forward to introduce themselves. He announced that there would be a Special Election, November 7, 2017. Candidate Leah Aldridge introduced herself as a candidate for the District 6, State Senate seat. Candidate Adam Taylor introduced himself as a candidate for City Council Ward 3 for the City of Smyrna, . Land Issues/Zonings/Annexations: There were no land issues, zonings, or annexations. 5. Privilege Licenses: There were no privilege licenses. 6. Formal Business: A. Approval of an apartment complex name change 2017-376 from The Jasmine at the Galleria to Alder Park. Sponsors: Norton City Administrator Tammi Saddler Jones provided the background on item 2017-376 for an apartment complex name change. The Jasmine at the Gallerta, LLC located at 8 Cumberland Way has requested a name change; the new name will be Alder Park. The proper name change application has been reviewed and approved by the Fire Marshall, Building Inspector, City Engineer, 911 Communications, as well as reported to the Business License Officer. Staff recommended approval A motion was made by Councilmember Derek Norton to approve item 2017-376 for an apartment complex name change from The Jasmine at the Galleria to Alder Park, seconded by Councilmember Susan Wilkinson. The motion carried by the following motion: Aye: 6- Councilmember Norton, Councilmember Blustein, Councilmember Welch, Councilmember Wilkinson, Councilmember Stoner and Councilmember Fennel B. Approval to amend the FY2017 Budget Fee Schedule to add a Cigar Speciality Shop License fee in the amount of $3,100 with a prorated amount by month for any new Cigar Speciality Shop licensee's. Sponsors: Fennel Tammi Saddler Jones provided the background to amend FY2017 Budget Fee Schedule for Cigar Speciality Shops. On September 5, 2017 Mayor 8 Council adopted a text amendment addressing Cigar Speciality Shops. These shops are to have "no more that 25% of its gross revenue from the sale of alcoholic beverages." Since this restriction is half of the normal 50% revenue cap (50% food, 50% alcohol) for alcohol pouring, staff believes that the fee for a Cigar Specialty Shop should be half of the normal fees. Staff recommends that the fee be $3,100.00 and be prorated on a monthly reduction for 2017. New licensee's and any future incoming Cigar Speciality Shop Licensee's. If a business applies for a new license on any day of a current month, the amount will be prorated by $258.33 for each month (Ex: $3,100 divided by 12 months = $258.33/month). The prorated amount will not apply to already established Cigar Speciality Shops for City of Smyrna Page 2 Printed on 1011312017 City Council Meeting Minutes - Final October 2, 2017 the 2018 License Year as well as any renewal of a Cigar Speciality Shop in future years. State Law requires that the pouring of alcohol on Sunday can only occur in association with food. As such, Sunday sales for these types of establishments is not allowed. Staff recommends that the fee associated with a Cigar Specialty Shop be $3,100 as illustrated below: NormallFull Fee 50% of Fee Liquor pouring- $5,000 $2,500 Beerpouring - 600 300 Wine pouring - 600 300 TOTALS $6,200 $3,100 Staff recommends approval of the amendment to the FY18 Fee Schedule. It has been reviewed by Community Development, Finance and the City Attorney. A motion was made by Councilmember Ron Fennel to approve item 2017-385 to amend the FY2017 Budget Fee Schedule to add a Cigar Speciality Shop License fee in the amount of $3,100 with a prorated amount by month for any new Cigar Speciality Shop licensee's, seconded by Councilmember Derek Norton. Approval of the Certification for Extension of Existing Service Delivery Strategy (SDS) with Cobb County and authorize the Mayor to sign all related documents. Sponsors: Stoner City Administrator, Tammi Saddler Jones provided the background on the Service Delivery Strategy Intergovernmental Agreement. The Service Delivery Strategy (SDS) Intergovernmental Agreement was originally signed in 2014. This agreement needs to be recertified by the City because Cobb County is updating their Comprehensive Plan. The SDS is effective for 10 years and the recertification will not extend the agreement beyond 2024. There are three elements that make up the Cobb County SDS: 1.) Millage Intergovernmental Agreement 2.) Land Use Intergovernmental Agreement (IGA) for each respective municipality 3.) 2016 Amendment to the Land Use IGA allowing the use of email in lieu of hand delivery of notifications of local actions goverened by the aforementioned agreement. Community Development Staff recommends the recertification of the Service Delivery Strategy. Consent Agenda: Tammi Saddler Jones read the Consent Agenda aloud for Council approval. A motion was made by Councilmember Charles (Corkey) Welch to approve the consent agenda as read aloud by City Administrator, Tammi Saddler Jones, seconded by Councilmember Derek Norton. The Finance Committee plan to hold a meeting at the end of the month. He expressed appreciation to the Atlanta Braves for a successful first season. Although, the season did not tum out the way the Braves or the fans wanted, they were quite successful in moving their headquarters and operation into Cobb County. He noted how proud he is of what they have done as a partner, neighbor and economic engine. Councilmember Doug Stoner mentioned the proposed rezoning on Atlanta Road between the Bank and the Reed House. The application was withdrawn by John Wielands Homes and Neighborhoods. Councilmember Susan Wilkinson noted that the next event for the Sunday Lecture Series at the Library, is October 8, 2017 from 3:00 - 4:00 PM. The lecture is: The Perils of Partisanship, Georgia Politics 1789 - 1845. A new playground has been installed at Chuck Camp Park on South Cobb Drive. The grand opening for this park is Wednesday, October 4th at noon. Councilmember Charles (Corkey) Welch called for volunteers. He advised that the City has a new Museum Director, the museum needs volunteers for an hour or 2 hours a week to work at the Smyma museum; to assist the Curator to make the museum more of a success than what it is now. If anyone wants to come out and help and has some time to volunteer, send an email or call Councilmember Welch or City Administrator Tammi Saddler Jones. Councilmember Andrea Blustein noted that she will have a Ward 2 Meeting on November 4, 201710:00 AM - Noon at Brawner Hall, she has new things to talk about. Councilmember Derek Norton commented on how the meeting started by bragging and recognizing our Smyma Public Safety, he wants to end the meeting doing the same. He mentioned that, three of Smyrna's public safety staff members were honored at the Cobb Chamber Public Safety Appreciation Breakfast Monday, October 2, 2017. Two firefighters, Firefighter Jason Evangelista and Firefighter John McBrayer were nominated for honors. Master Patrol Officer, Louis Defense who is out in our community and many know him, who is a fantastic staff member, won the Distinguished Achievement Award. The Campbell Spartan Fast Pitch Softball team are gong to State to play East Cowetta. This has never happened before, he and his wife Laura have sponsored this team for a long time and he is very proud and excited for them. 10. Show Cause Hearings: 11. Citizen Input: There were no show cause hearings. Alex Backry would like the council to consider term limits. He made a comment regarding the appointment of the Mayor Pro Tem. Cynthia Lawerence brought up the senior facility in Smyma and how the city could expand the facility, especially the pool area. Ms. Lawerence mentioned possible addition of a road called Braves Blvd., she is not interested in building anymore roads. In the report she read, they would take away part of Jonquil Park to put in this road. Sandy Sands, said thank you to the Mayor and Council for the 43 years she has lived Cay of Smyma Page 5 Printed on 10/13/2017 City Council 12. Adjournment: Meeting Minutes - Final October 2, 2017 in Smyrna. She raised her son here and has enjoyed living in Smyrna immensely. When she first came to Smyrna she lived in an apartment on Atlanta Road and she rode the Greyhound Bus downtown to work everyday. Her son had a great life here and she will be moving, November 1st to Utah where her son lives. Mayor Bacon expressed that he and the city will miss her. He commented that the Mayor and council don't usually engage in citizens input but he wanted her to know that the city will miss her. He doesn't know how Bill will be able to get to the Council meetings without her. They have been coming to the council meetings for many years. He noted that she has given so much to the community. Ms. Sands commented that years ago everyone thought that Smyrna had been jumped over, but now they have found it. She volunteered with Keep Smyma Beautiful and the Taylor Brawner House and enjoyed it. Mayor A.
