07-07-14 July 7, 2014 Mayor and Council MinutesMonday, July 7, 2014 City of Smyrna 2800 King Street Smyrna, Georgia 30080 Meeting Minutes - Final City Council 7:30 PM Roll Call Council Chambers Present: 8 - Mayor Max Bacon, Mayor pro tem/Councilmember Melleny Pritchett, Councilmember Andrea Blustein, Councilmember Teri Anulewicz, Councilmember Charles Welch, Councilmember Susan Wilkinson, Councilmember Wade Lnenicka and Councilmember Ron Fennel Also Present: 6 - Eric Taylor, Scott Cochran, Lisa Moore, Ken Suddreth, Dan Campbell and Chelsea Jackson Call to Order Mayor Max Bacon called the meeting to order at 7:30 PM 1. Invocation and Pledge: Mayor Max Bacon called on Mike Parker, Pastor of Hurt Road Baptist Church, 17 Hurt Road, Smyrna to deliver the invocation and lead all in the Pledge of Allegiance. 2. Agenda Changes: Mayoral Report: The Mayor announced that Item 4-A would be tabled to July 21, 2014 at the request of the applicant. The Mayor called Susan Thayer to discuss her candidacy for School Boardmember. The election will be held July 22nd. The Mayor stated that this is a critical position and he encouraged all to vote. Mayor Bacon commented about the Civil War Commemoration at Brawner Hall. It was well attended, had some great speakers and was a success. He thanked those who organized and participated in the event. 4. Land Issues/Zonings/Annexations: A. Public Hearing - Zoning Request Z14-015 - Modification of currently approved site plan and building elevations - 3.13 Acre Tract - Land Lot 519 and 562 - Hawthorne Avenue, Davis Drive and Saint Charles Avenue - Traton Homes, LLC. The Mayor called for a Public hearing and no one came forward to speak. Approval of Annexation request Ordinance # 2014-10 (100% owners requesting annexation) Land Lots 459 and 478 of the 17th District, lying in 4 Parcels being known as, 4300 King Springs Road 18.7 acres, 4240 King Springs Road 2.8 acres, Vacant tract of land Kings Springs Road 1.1 acres and 4217 King Valley Drive 2.4 acres in Smyrna GA , for a total of 19.8 acres, 2nd Section of Cobb County, Georgia City Administrator Eric Taylor gave the background on the annexation. St. Thomas the Apostle Catholic Church wishes to have its 19.8 acres be totally annexed into the City of Smyrna. This is a 100% application and will be effective August 1, 2014. The City has received a non -objection letter from Cobb County. The staff has recommended approval. Councilmember Fennel asked Church Administrator Gus Scannapieco to come forward. The Church is celebrating its 50th anniversary this year. He stated they have 7,156 families and 30,000 parishioners, many of whom live in Smyrna. With the growth of the church, they are looking for improved services they believe will come from Smyrna. The Mayor stated he is excited about having the church in the City. Ms. Anulewicz asked if there are any plans to have a Catholic School, Mr. Scannapieco stated they have a preschool now and would like to expand it in the future. In the fall, the church plans to renovate the property. A motion was made by Councilmember Ron Fennel to approve the Annexation Request Ordinance 2014-10 (100% owners requesting annexation) Land Lots 459 and 478 of the 17th District, lying in 4 Parcels being known as, 4300 King Springs Road, 4240 King Springs Road, Vacant tract of land Kings Springs Road and 4217 King Valley Drive acres in Smyrna GA, for a total of 19.8 acres, 2nd Section of Cobb County, Georgia; seconded by Councilmember Anulewicz. Privilege Licenses: There were no Privilege Licenses. 6. Formal business: A. Approval of a name change for The Village at Lake Park apartment complex - Land Lots 704, 705, 734, 735, 736 and 737 - 2085 Lake Park Drive - Cortland Partners Mr. Taylor stated the background that the new owners, Cortland Partners have City of Smyrna Page 2 Printed on 7/21/2014 City Council Meeting Minutes - Final July 7, 2014 requested a change in the name from The Village at Lake Park to The Village. The staff has reviewed the name change and recommends approval. A motion was made by Councilmember Andrea Blustein to approve 2014-187, a name change for The Village at Lake Park apartment complex - Land Lots 704, 705, 734, 735, 736 and 737 - 2085 Lake Park Drive - Cortland Partners; seconded by Mayor Pro Tem/Councilmember Pritchett. The motion carried by the following vote: Aye: 7 - Mayor pro tem/Councilmember Pritchett, Councilmember Blustein, Councilmember Anulewicz, Councilmember Welch, Councilmember Wilkinson, Councilmember Lnenicka and Councilmember Fennel B. Approve the Renewal of SunTrust Corporate Resolution R2014-09 and Certificate of Incumbency Mr. Taylor stated this item is an annual resolution to update information to identify officials who are responsible for the use of City's credit card. The staff recommended approval. A motion was made by Councilmember Teri Anulewicz to approve RES2014-09, the Renewal of the SunTrust Corporate Resolution and Certificate of Incumbency; seconded by Mayor Pro Tem/Councilmember Melleny Pritchett. The motion carried by the following vote: Aye: 7 - Mayor pro tem/Councilmember Pritchett, Councilmember Blustein, Councilmember Anulewicz, Councilmember Welch, Councilmember Wilkinson, Councilmember Lnenicka and Councilmember Fennel C. Approval of Resolution R2014-10 extending the emergency 911 surcharge Mr. Taylor gave the background on the resolution. During May of 2001, the City Council approved a resolution authorizing the City to collect a $1.50 monthly fee from telephone subscribers within the City to offset the costs of providing 911 telephone service to residents. This resolution must be extended annually to continue the surcharge. Councilmember Fennel stated that the 911 Fund is always short of dollars because there is no state resolution to capture all those people who have 911 service through cell phones, but he hopes the state will resolve that soon. A motion was made by Councilmember Ron Fennel to approve RES2014-10 which extends the emergency 911 surcharge; seconded by Councilmember Charles (Corkey) Welch. Commercial Building Permits: There were no Commercial Building Permits. 8. Consent Agenda: A motion was made by Mayor Pro Tem/Councilmember Melleny Pritchett to approve the Consent Agenda; seconded by Councilmember Ron Fennel. Approval of the June 16, 2014 Mayor and Council Meeting Minutes B. Approval to use Council Chambers July 10, 2014 7 PM - 9 PM for Special Purpose Local Option Sales Tax (SPLOST) 2014 Public Information Meeting. 9. Committee Reports: Mayor Pro Tem Melleny Pritchett said she hopes everyone had a safe and happy 4th of July. She enjoyed the Civil War presentation last Tuesday night. It was very interesting and enlightening. Councilmember Andrea Blustein remarked that the holiday weekend had very wonderful weather. Councilmember Teri Anulewicz reminded that this Saturday night is the second concert of the year. The band will be Chris Stalcup and the Grange. Summer is a busy time in Smyrna, there are many events at the library, the Fresh Produce Market continues and other events are scheduled. Ms. Anulewicz commented on the passing of her grandmother two weeks ago. Councilmember Charles (Corkey) Welch discussed the success of the Civil War Exhibit. He thanked Jennifer Bennett, Mike Terry, Bill Marchione, Brockington & Associates, the speakers and all who helped to make the event successful. Mr. Welch reminded everyone that there is a meeting at the Community Center on July 9th about the Dobbins Land Use plan. Councilmember Susan Wilkinson mentioned that Sunday, July 13 at 3:00 at the Library, there will be a screening of the movie "Kennesaw, One Last Mountain." Councilmember Wade Lnenicka also mentioned the Dobbins Land Use meeting on July 9th at 7:00 PM. It is critically important to the area that Dobbins and Lockheed continue operations at that site. He encouraged citizens to come to the meeting and to show support. Councilmember Ron Fennel echoed the excitement about the Civil War exhibit and recollected about the battles that happened in the area. Mr. Fennel stated the relic collection is remarkable and the speakers were very informative. He acknowledged the SPLOST meeting and stressed the importance of the SPLOST. Mr. Fennel encouraged citizens to attend. He reminded that July 22 is election day and early voting is available. The State of the City address is Thursday at 12:00. Mayor Bacon noted Saturday, July 12 from 9:00 - 2:00, the A.C. Gilbert vintage toy show will be at the Atlanta Marriott Northwest on Windy Hill Road. This will be the first time they have been in Atlanta. The show is free to the public. 10. Show Cause Hearings: There were no Show Cause Hearings. Adjournment: Mayor Bacon called Alex Backry, 3459 Shawnee Trail, for Citizen's Input. Mr. Backry discussed the low voter turnout at the last election in the City and in the County. He expressed the importance of voting. He also requested the City's enforcement of the state fireworks laws. He would like to see anyone who is illegally using fireworks be assessed a fine. The Mayor called Al Graves, 1079 Pinehurst Drive, for Citizen's Input. Mr. Graves expressed his thankfulness for having a new traffic light near his neighborhood on Concord Road. He also expressed his concern that there is no turn lane off of Concord Road on the east side of the traffic light. He stated there does not seem to be enough room for an adequate turn lane. The Mayor informed that a copy of the original City Charter was unveiled at the event last Tuesday and may become a permanent display at the Library. The meeting was adjourned at 8:12 PM.
