07-01-2013 July 1, 2013 Mayor and Council Minutes t s t } SPOYR N FRI i f 2800 King Street City of Smyrna Smyrna, Georgia 30080 Meeting Minutes — Final City Council Council Chambers Monday, July 1, 2013 7:30 PM Call to Order Present: 5- Councilmember Ten Anulewicz, Councilmember Charles Welch, Councilmember Susan Wilkinson, Councilmember Wade Lnenicka and Councilmember Ron Fennel Absent: 2 - Councilmember Melleny Pritchett and Councilmember Andrea Blustein Also Present: 5- Dan Campbell, Terri Graham, Scott Cochran, Samantha Kasraie and Tammi Saddler Jones 1. Invocation and Pledge: The Mayor introduced Pastor Pam McCurdy of Bethany United Methodist Church,who delivered the invocation and led all in the pledge to the flag. 2. Agenda Changes: The Mayor stated that there were none. . . Mayoral Report: A. Proclamation in Recognition of Becky Jones School of Dance - j Celebrating 40 Years I Soonsors: Welch 1 Councilman Welch delivered the proclamation in recognition of Becky Jones School of Dance. Mrs.Jones expressed her appreciation and introduced those in attendance with her.The Mayor noted that he had recently attended a show at her studio. The Mayor advised that Councilwoman Pritchett was in the hospital and that Councilwoman Blustein was out of town due to the passing of her father. r 4. Land Issues/Zonings/Annexations: The Mayor stated that there were none. 1 City of Smyrna 7/1/2013 5. Privilege Licenses: The Mayor stated that there were none. 6. Formal business: The Mayor stated that on the recommendation of the City Attorney that item 8(B) be moved to Formal Business. Award RFP 13-015 for Outdoor Digital Signage to Masstar Signs for an amount not to exceed $100,000 and authorize the Mayor to sign and execute all related documents A motion was made by Councilmember Lnenicka for approval to move item 8(B)from the consent agenda -award RFP 13-015 for an amount not to exceed $100,000 -to be heard as item 6(A) under Formal business.The motion was seconded by Councilmember Fennel and carried by the following vote: Aye: 5- Councilmember Anulewicz, Councilmember Welch, Councilmember Wilkinson, Councilmember Lnenicka and Councilmember Fennel Mrs. Saddler-Jones advised that on June 12, 2013 six bids were received for signage to be located at 5 locations throughout the City of Smyrna. She explained the process of selecting the finalists and stated that staff recommended that the bid be awarded to Masstar Signs. Councilwoman Anulewicz made a motion to remove the item from the agenda. Councilman Lnenicka inquired of the City Attorney if the motion should be to remove or to reject the bid. Mr. Cochran informed all present that if the intent was to reject the bids and rebid then the motion should be to reject the bid. Councilmember Anulewicz moved to reject the bid award for RFP 13-015 for Outdoor Digital Signage to Masstar Signs for an amount not to exceed $100,000 and authorize the Mayor to sign and execute all related documents. Motion was seconded by Councilman Welch and carried by the following vote: Aye: 5- Councilmember Anulewicz, Councilmember Welch, Councilmember Wilkinson, Councilmember Lnenicka and Councilmember Fennel 7. Commercial Building Permits: The Mayor stated that there were none. 8. Consent Agenda: A. Approval of June 17, 2013 Mayor and Council Meeting Minutes A motion was made by Councilmember Lnenicka to approve consent agenda. The motion was seconded by Councilmember Fennel. The motion carried by the following vote: Aye: 5- Councilmember Anulewicz, Councilmember Welch, Councilmember Wilkinson, Councilmember Lnenicka and Councilmember Fennel 2 City of Smyrna 7/1/2013 9. Committee Reports: Councilwoman Anulewicz wished Councilmember Pritchett a speedy recovery and extended her sympathies to Councilwoman Blustein. She advised all that the next summer concert would take place on July 13th. Councilman Welch yielded with no report. 1 { 1 Councilwoman Wilkinson yielded with no report. Councilman Lnenicka extended his well wishes to Councilmember Pritchett and his deepest sympathies to Councilmember Blustein on the loss of her father. He wished all a great Independence Day. Councilman Fennel echoed his colleagues sentiments and reminded all to maintain safety protocols during the 4th of July holiday.The Councilman thanked Chief Lee for attending the Bennett Woods Garden Club meeting; providing information about the neighborhood watch program. Councilman Lnenicka shared the loss of long time Smyrna resident, Dr. Donald Marshall. He noted that Dr. Marshall had been his personal dentist from the time his family moved to Smyrna. The Councilman remarked on Dr. Marshall's contributions to the community and his active participation in overseas mission work; providing dentistry services around the world. There were no further reports 10. Show Cause Hearings: The Mayor stated that there were none. 11. Citizen Input: Alex Backry of 3459 Shawnee Trl. commented on the profits from the water department being transferred back to the general fund and requested a detailed accounting. He opined that surplus could have been used to defer water rate increases. Mr.Backry remarked on the amount of time the Mayor's commitment to Bob Barr's campaign would require and questioned the Mayor's ability to fulfill both obligations. Larissa Edwards of 304 Hickory Springs stated that she was the Messiah and that she was there to prove it. She inquired how many present believed Jesus was the Messiah and informed them that he was not. She displayed a paper showing what she called God's math formula, summarizing that what was mostly in favor of many was also positive and right. Ms. Edwards referenced section 8 of the MuniCode, and she states, "Mr. Mayor I'm going to bring your attention to section 8 of the MuniCode and it says in the event the office of Mayor or City Council should become vacant by death, resignation or removal from City or otherwise the Mayor and Council should yada yada yada. As God's representative, only true representative, Mr. Mayor, I want to make sure you're not violating God's formula. We already know that you guys voted publicly already for satanic formula—few over many—by wanting a gym for just yourselves and to hell with everybody else in Form...uh...Smyrna. That's ..• Satanic. Few over many is wrong and I'm sorry, ok. So, Mr. Mayor, I gave you an opportunity to step down before. I'm going to say that you have an opportunity to still voluntarily step down. My name is Larissa Edwards- Peacemaker for President." 3 ^'*y of Smyrna 7/1/2013 Mary Kirkendoll of 1078 Lakview Dr. seconded Ms. Edwards remarks. She advised on projects throughout the Atlanta area that were progressing and commented on businesses locating to other cities. Ms.Kirkendoll questioned plans for the former Hickory Lakes apartments parcel and raised the matter of depressed home values, stating that she would have to give her house away to sell it. Ms. Kirkendoll expressed her support of Barry Laudermilk in the upcoming senate seat election. She requested that Councilman Welch provide reports on the status of Concord Rd. and that the project manager place informational signs about the construction. 12.
