09-17-2012 September 17, 2012 Mayor and Council Meeting September 17, 2012 All Council members were present. Also present were City Assistant Administrator Tammi Saddler, City Attorney Scott Cochran, City Clerk Susan Hiott, Executive Assistant to the Mayor and Council Christy Ullman, Fire Chief Jason Lanyon, Police Chief Stan Hook, Human resources Director Kay Bolick, Public Relations Director Jennifer Bennett, Keep Smyrna Beautiful Virginia Davis, Community Development Director Ken Suddreth, IT Director Chris Addicks, Finance Director Toni Jo Howard, Management Fellow Jessica Melton and representatives of the press. The regular scheduled meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called to order by presiding officer Mayor Max Bacon at 7:30 o'clock p.m. Mayor Bacon acknowledged Pastor Susan Taylor of Bethany United Methodist Church, who conducted the invocation and led all present in the pledge to the flag. 2. AGENDA CHANGES: Mayor Bacon stated that item 6 (A)would be withdrawn 3. MAYOR'S REPORT: The Mayor welcomed Tammi Saddler Jones, congratulated her on her recent nuptials and ,,.,11,11 announced that she would be filling in for City Administrator Eric Taylor. 4. LAND ISSUES/ZONINGS/ANNEXATIONS: The Mayor stated that there were none. 5. PRIVILEGE LICENSES: (A) Public Hearing-change of address of privilege license for retail sale of beer(package)-Cayce Foods LLC - Yvonne Ogbuefi-1680 Roswell St (TA) Mayor Bacon confirmed the presence of the applicant and called on Mrs. Jones, who announced that the application was for a change of address from 1687 Roswell St to 1680 Roswell Street. She shared that Ms. Ogbuefi had completed the mandatory responsible alcohol sales course and that a background check by the Smyrna police department had failed to disclose any information that precluded the issuance of the license. The Mayor announced that this was a public hearing and called for comment. He asked that the applicant approach to be sworn in. Councilwoman Anulewicz confirmed that the applicant had completed the required paperwork and commended her for her for 21 years of operating a well managed and well staffed business. The Councilwoman inquired if the applicant understand the regulations and state laws regarding Sunday sales and hours. Councilwoman Anulewicz noted that the city conducted undercover operations and Ms. Ogbuefi acknowledged. Bud McCullough spoke in support of the applicant Ms. Ogbuefi's long time support of the neighborhood. September 17th,2012 2 MOTION: Councilwoman Anulewicz encouraged all to visit the location and moved to approve change of address of privilege license for retail sale of beer (package)-Cayce Foods LLC - Yvonne Ogbuefi-1680 Roswell St. Motion was seconded by Councilwoman Pritchett and approved 7-0. FORMAL BUSINESS: (A) Award RFQ13-007 City Arborist to B + C Studio, sole bidder, for arborist and landscape plan review services and authorize the Mayor to sign documents related to this service - Tabled from September 4, 2012Meeting- To be withdrawn (AB) The Mayor confirmed with Mr. Cochran that an official vote to withdraw the item was required. MOTION: Councilwoman Blustein moved to withdraw the award of RFQ13-007 City Arborist to B + C Studio, sole bidder, for arborist and landscape plan review services and authorize the Mayor to sign documents related to this service. Motion was seconded by Councilwoman Pritchett and approved 7-0. 7. COMMERCIAL BUILDING PERMITS: The Mayor stated that there were none. 8. CONSENT AGENDA: Mrs. Saddler Jones read aloud the consent agenda. (A)Approval of September 4, 2012 Mayor and Council Meeting Minutes •. (B) Approval to use Council Chambers on October 18, 2012, 7:30 p.m. for Smyrna Historical Society Meeting in conjunction with Williams Park Neighborhood (C) Approval of FY2012 Budget Amendment for General Fund (tabled from September 4, 2012 meeting) (D) Approval of FY2013 Budget Amendment for Contingency Fund MOTION: Councilwoman Pritchett moved to approve the consent agenda as presented. Motion was seconded by Councilman Welch and approved 7-0. 9. COMMITTEE REPORTS: Councilwoman Pritchett commended the staff and all those that worked on putting together the Taste of Smyrna event. She announced that the Vision Committee would meet on September 24th at 7:15 pm. Councilwoman Blustein called on Ken Suddreth who discussed the positive trend in Community Development despite the summer slowdown. He provided statistics on the number of family WNW dwelling units and building permits and noted that everything was up across the board. Councilwoman Blustein wished those celebrating Rosh Hashanah a happy new year. 3 September 17th,2012 Councilwoman Anulewicz introduced Ms. Howard, who noted that the Tyler Munis implementation was progressing and that property tax bills had been mailed out. Ms. Howard made known that the audit field work had been completed and would be available for review in about a month. Ms. Bennett commented on the success of the Taste of Smyrna, highlighting that 70% more business had been conducted this year over last. She reminded all of the upcoming food truck Tuesday and the Banks and Shane concert. Ms. Bennett made known that there would be a concert at Taylor Brawner Hall in October. Mayor Bacon commented that Saturday was great event for Smyrna and Ms. Bennett acknowledged the efforts of Atlanta Pyrotechnics for the fireworks display. There was also discussion about the high quality amenity of an onsite comfort station. Councilwoman Anulewicz commended all of the city staff that worked on the event and commented that the fireworks resulted in a larger crowd. She noted the high attendance and praised the efficiently run event, encouraging all to take advantage of the numerous parks, free concerts and food trucks throughout the City. Councilman Welch called on Virginia Davis, who announced the upcoming document shredding event at the Wolfe Center. She also shared the annual River's Alive event to clean up the Rottenwood Creek area. Ms. Davis noted the importance of this location because all Smyrna area streams flowed into Rottenwood Creek before merging into the Chattahoochee. She thanked all of the volunteers and board members that helped bring together the Work Glove luncheon and shared that over 125 people were served with more than $4000 in contributions and gifts in kind. Scott Stokes from Public Works reminded all about the Belmont Hills connector road construction and the resultant road closures. He announced that there were two open bids and provided details. Councilman Welch inquired about the timeframe for the Concord Rd. project to begin and Mr. Stokes replied that an exact time had yet to be determined. Mayor Bacon asked if the school off Concord Rd. had already been contacted and Mr. Stokes responded in the affirmative. Councilwoman Wilkinson called on Steve Ciaccio, who mentioned the Banks and Shane concert event, noting that table rentals were available at the Wolfe Center and provided ticket pricing and details. He encouraged all to attend the movie in the park and Casper's friendly castle toddler event. Mike Seigler reported on events at the library including a book signing by Mike Terry, author of a historical book on the Taylor Brawner House. He made known that the event was sponsored by the Smyrna Historical and Geneological Society and Friends of the Library. Mr. Seigler announced a children's program on the 29th with Clifford the Big Red Dog and a Star Wars reads day on October 6th. He encouraged all to attend the performance by epidemic theater on October 11th as they reenacted the War of the Worlds broadcast and mentioned the current exhibiting artist. Councilman Lnenicka invited Kay Bolick to provide a report from Human Resources. She reminded all of the job postings available on the city website and the channels through which they could be submitted. Ms. Bolick announced that two key positions were open to replace the city engineer and retiring library director. The Mayor noted that he was in office when Mr. Seigler was hired and commended him on his leadership and passion for his job. He shared that Mr. Williams would be moving to Sanibel Island for his new position and that he would be missed. Councilman WINIO Lnenicka called on Ms. Hiott, who reminded all to register to vote for the upcoming presidential election and provided deadlines. She commented that advanced voting dates and times would be provided when available. 4 September 17th,2012 Councilman Lnenicka mentioned that he had been afforded the opportunity to meet with Ward 6 residents and neighborhoods, including those at Vintage Square. He shared that they were working to establish a neighborhood watch in their community. Councilman Lnenicka announced the public hearing to be held on September 19th regarding the Concord Rd. improvement project. He stated that a number of hearings had been conducted over the past few years but in light of recent questions and concerns this meeting had been scheduled. He relayed that topics to be discussed included the history of the project and most current design. He shared that staff would be available to answer questions and take suggestions. The Councilman thanked residents for their interest in the project and lauded the community involvement. He extended his congratulations to the Assistant City Administrator on her recent marriage. Councilman Fennel, congratulated Mr. Seigler on his retirement and expressed his gratitude to him for his years of service. He called on Chief Hook, thanking his team for navigating traffic at Smyrna celebrations. Chief Hook shared that a memorial service had been held for Mike Moore, who had worked with the City for 25 years and passed away in August. He discussed recent crimes in Smyrna including car break ins and a woman that was hitting mailboxes with a bat. Chief Hook shared that Marietta had captured copper thieves as part of a joint effort with Smyrna officers. He noted that a dispatcher was leaving the city for another position and offered an update on the renovation of the 911 center. The Chief announced that four new officers had been sworn in. Chief Lanyon stated that the City was under a tornado watch and offered his congratulations to Jason Evangelista on the birth of his child. He noted that with the opening of the new fire station that 3 new lieutenants had been promoted and provided details for the grand opening of that now operational facility. Chief Lanyon extended his gratitude to all those that participated in the public 0.0.1101 safety gala and gave special thanks to Jim and Karen Carter. Councilman Fennel expressed his gratitude to the Smyrna Public Safety Foundation and the Smyrna Business Association for their cook out fundraiser. The Councilman announced the upcoming town hall meeting hosted by Bob Ott and wished those celebrating the Jewish new year a happy holiday. Tammi Jones thanked everyone for their support of her marriage. There were no further reports 10. SHOW CAUSE HEARINGS: Mayor Bacon stated that there were none. 11. CITIZEN INPUT: Alex Backry of 3459 Shawnee Trail commented on the City encouraging businesses to use nature colors and inquired why Walmart had not been invited to open in Smyrna. He stated his support of that company and its ability to bring jobs to the area. Mr. Backry questioned why meetings about the Concord Rd. project were not held earlier. Lance Mason of 3104 Nichols St. shared that it was recently revealed that one of his neighbors on "" Medlin St. had signed his home over for use as a recovery center for drug addicts and alcoholics. Mr. Mason claimed this would damage the neighborhood integrity and aesthetics and was not September 17th, 2012 5 suitable for a community with children. He stated that he had spoken with community development and been informed that the home would be in violation of city zoning requirements and covenants. He produced a signed petition and asked that the City assist in keeping this business out of a residential neighborhood. Ms. Hiott requested that the petition be presented for placement in the record. Bud McCullough of 2518 Matthews St. stated that he had been in communication with city representatives regarding including his community in the opportunity zone. He made known the qualification of his area and his knowledge that the City could submit a request at any time to incorporate additional neighborhoods. He requested that the City pursue this option. Mayor Bacon mentioned the upcoming public meeting on the Concord Rd. project and stated that at least three public meetings on this had been conducted over the past few years. Councilman Welch requested that the citizens involved with the matter of the home on Medlin Street meet with him following the meeting.
