12-20-2010 December 20, 2010Mayor and Council Meeting December 20, 2010 All council members were present. Also present were City Administrator Eric Taylor, City Attorney Scott Cochran, City Clerk Susan Hiott, Deputy City Clerk Samantha Kasraie, Community Development Director Ken Suddreth, Community Relations Director Jennifer Bennett, Keep Smyrna Beautiful Director Ann Kirk, Assistant Director Keep Smyrna Beautiful Virginia Davis, Assistant Public Works Director Frank Martin, Parks and Recreation Director Steve Ciaccio, Fire Chief Jason Lanyon, Deputy Chief Mike Brown, Library Director Michael Seigler, Manager Human Resources Carol Lincoln, Assistant City Administrator Tammi Saddler, Controller Kim Guhman, representatives of the press and several citizens. The regularly scheduled meeting of Mayor and Council was held at Smyrna City Hall. Presiding officer Mayor Max Bacon called the meeting to order at 7:33 o'clock p.m. Mayor Bacon recognized Pastor Jim Moon of Crosspoint Presbyterian Church who conducted the invocation and pledge to the flag, after which Mayor Bacon shared with all present the location of Crosspoint Presbyterian Church. Mayor Bacon stated that item 4A: Public Hearing -Zoning Amendment Request Z 10-016 - Modification of previously approved building elevations - 6.94 Acre Tract -Land Lot 308 -Church Road & Autumn Brook Trail -Ryland Homes Public Hearing would be tabled until January 18, 2011 and inquired if anyone was present for that item. There was no response. Mayor Bacon announced a Proclamation in Recognition of 50 Years for The Center for Family Resources, recognized Mrs. Jerri Barr and invited Council Member Wood to present the proclamation. Mrs. Barr thanked the Council and discussed the work at the Center. Mayor Bacon acknowledged the National and State awards won by Keep Smyrna Beautiful and requested that Director Ann Kirk and all volunteers present approach the podium. Mrs. Kirk introduced the Board members assembled and Chairperson Joe Lucas presented the award before Mayor and Council and thanked them for their support. Mrs. Kirk explained the significance of the award and that it had been received in the population category 50,000 and under for the overall work done in FY 2010, highlighting it was Keep Smyrna Beautiful's third National award and 14`n State award. Mayor Bacon acknowledged the efforts of the organization and Council Member McNabb expressed his gratitude for their leadership efforts and community involvement. December 20, 2010 LAND ISSUES/ZONINGS/ANNEXATIONS: 2 (A) Public Hearing -Zoning Amendment Request Z10-016 -Modification of previously approved building elevations - 6.94 Acre Tract -Land Lot 308 -Church Road & Autumn Brook Trail - Ryland Homes. Mayor Bacon restated that this item would be tabled until January 18th and asked for input. There was none. MOTION: Council Member Smith made a motion to table Z10-016 to January 18th, 2011. Motion was seconded by Council Member Lnenicka. Motion approved 7-0. PRIVILEGE LICENSES: Mayor Bacon stated that there was none. FORMAL BUSINESS: (A) Reappointment of Ward 4 Representative to Planning and Zoning Board fora 2 year term to expire on 12/31/2012 MOTION: Council Member McNabb made a motion to reappoint Mr. Frank Pologruto, Jr. Motion was seconded by Council Member Pritchett. Motion approved 7-0. (B) Reappointment of Ward 4 Representative to Smyrna Downtown Area Development -Smyrna Commons fora 5 year term to expire on 5/2/2015 MOTION: Council Member McNabb made a motion to reappoint Mr. Jim Brooks Motion was seconded by Council Member Pritchett. Motion approved 7-0. (C) Reappointment of Ward 4 Representative to Smyrna Housing Authority fora 5 year term to expire on 5/2/2015 MOTION: Council Member McNabb made a motion to reappoint Mr. Jim Brooks. Motion was seconded by Council Member Pritchett. Motion approved 7-0. (D) Reappointment of Ward 5 Representative to Keep Smyrna Beautiful fora 2 year term to expire on 12/31 /2012 MOTION: Council Member Smith made a motion to reappoint Ms. Stephanie Busch. Motion was seconded by Council Member Pritchett. Motion approved 7-0. (E) Reappointment of Ward 6 Representative to Keep Smyrna Beautiful fora 2 year term to expire on 12/31 /2012 MOTION: Council Member Lnenicka made a motion to reappoint Ms. Nell Robinson. Motion was seconded by Council Member McNabb. Motion approved 7-0. (F) Reappointment of Ward 7 Representative to Keep Smyrna Beautiful fora 2 year term to expire on 12/31 /2012 December 20, 2010 3 MOTION: Council Member Wood made a motion to reappoint Mr. Wayne Waldrip. Motion was seconded. Motion approved 7-0. (G) Reappointment of Ward 7 Representative to Planning & Zoning Board fora 2 year term to expire on 12/31/2012 MOTION: Council Member Wood made a motion to reappoint Mr. Earl Rice. Motion was seconded by Council Member Smith. Motion approved 7-0. Mayor Bacon acknowledged his appreciation for the efforts of the volunteers named. COMMERCIAL BUILDING PERMITS: Mayor Bacon stated that there were none. CONSENT AGENDA: Mr. Taylor read the consent agenda items to those present. (A) Approval of Minutes -Dec. 6, 2010 Mayor and Council meeting (B) Approval of Minutes -Dec. 13, 2010 Special Called Meeting (C) Approval of the 2011 HIPPA Privacy Notice (D) Acceptance of Staffing for Adequate Fire and Emergency Response (SAFER) Grant and authorize Mayor to sign and execute all related documents (E) Bid Award RFP # I 1 009 Residential Municipal Solid Waste Disposal Award to the lowest bidder Advanced Disposal for their unit price bid per ton of $28.25 for MSW $24.25 C & D and $24.25 Yard Waste and authorize Mayor to sign and execute related documents (F) Bid rejection of Bid #RFQ 11 010 Community Center Flat Roof and authorize this project to be re bid (G) Bid rejection of bid #RFQ 11 011 Public Works building addition and authorize this to be re bid (H) Approval of Ordinance 2010-14, Ordinance Amendment to City of Smyrna Code of Ordinances, adding Section 102-14 Restriction on Outdoor Water of Landscape MOTION: Council Member Wood moved to approve the consent agenda. Motion was seconded and approved 7-0. COMMITTEE REPORTS: Council Member Pritchett recognized Susan Hiott who presented current court statistics and Council Member Pritchett yielded with no further report. December 20, 2010 4 Council Member Newcomb recognized Ken Suddreth who presented Community Development statistics and Council Member Newcomb yielded with no further report. Council Member Anulewicz announced that HR had no report and wished everyone happy holidays, advised all to be careful in icy weather and yielded the floor with no further report. Council Member Mcnabb acknowledged Ann Kirk who informed all present of the Christmas tree recycling program and Mayor Bacon mentioned that the event might receive media coverage. Frank Martin made an announcement regarding holiday sanitation schedules and Council member McNabb wished all a Merry Christmas and Happy Holidays, yielding the floor with no further report. Council Member Smith recognized Jennifer Bennett who reminded all that the holiday sanitation schedules were available on the website and Face book feed. Ms. Bennett announced that the Community Center would be open for Smyrna's Radio Disney event. Mike Siegler discussed upcoming events at the Library and success of prior activities. Council Member Smith wished all a Merry Christmas and yielded the floor with no further report. Council Member Lnenicka thanked the Smyrna Public Safety Foundation for their efforts, recognized the Board of Directors and encouraged those present to visit the Foundation's website to join or contribute. He wished all a Merry Christmas and a safe and happy holiday season after which he yielded the floor. Council Member Wood recognized Kim Guhman who presented a status update on the search for updated financial software and the next steps in the selection process. Council Member Wood wished all a Merry Christmas and a safe and happy holiday season and yielded the floor with no further report. Mayor Bacon wished everyone a Merry Christmas and a happy holiday season and encouraged everyone to visit Smyrna's downtown lights display. CITIZEN INPUT: Mayor Bacon recognized Mr. Alex Backry, residing at 3459 Shawnee Trail, and Mr. Backry expressed concerns about the plans for Smyrna Commons. He pointed out that the management team from Hickory Lakes could potentially be assigned to operate other properties. Mr. Backry stated his opposition to the City's decision to purchase Hickory Lakes rather than permit another buyer to renovate it.
