12-06-2010 December 6, 2010Mayor and Council Meeting December 6, 2010 All council members were present. Also present were City Administrator Eric Taylor, City Clerk Susan Hiott, City Attorney Scott Cochran, Assistant City Administrator Tammi Saddler, and representatives of the press. The regular scheduled meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called to order by presiding officer Mayor Max Bacon at 7:32 o'clock p.m. Mayor Bacon recognized Joe Braun of the Cumberland Community Church, who conducted the invocation and pledge to the flag, after which Mayor Bacon shared with all present the location of the Cumberland Community Church. AGENDA CHANGES: Mayor Bacon stated there were no agenda changes. MAYOR'S REPORT: Mayor Bacon mentioned that 11 schools were recognized earlier that evening along with their volunteers, students and teachers at the annual Mayor's Awards ceremony. He commented on the large crowd size and the exceptional students recognized. LAND ISSUES/ZONINGS/ANNEXATIONS: (A) Public Hearing- Adoption of the 2006 International Property Maintenance Code (as amended in January 2009 by the State) and all proposed local amendments -and amending City of Smyrna Code of Ordinances, Section 18-12, Ordinance 2010-12 Mayor Bacon recognized Mr. Taylor, who provided background that the IPMC is the model code published by the International Code Council to establish minimum interior and exterior maintenance standards for existing structures. Currently, the City has the 2000 version and is seeking to update it with the 2006 version. Mr. Taylor informed all present that staff recommended approval as amended by Georgia's Department of Community Affairs. Mayor Bacon recognized Council Member Ron Newcomb, who called for Ken Suddreth to approach. Mr. Suddreth explained that the 2006 version of the IPMC was the molt current available but the process of receiving it through the state and city workflows accounted for the four year discrepancy between its 2006 inception and the City's adaptation of the code. Mr. Suddreth informed all present that the code has been reviewed and endorsed by all necessary city entities including the DCA, City Attorney and Fire Chief and was ready to be updated in the current edition. Mayor Bacon stated this was a public hearing and asked for public comment. There was none. Mayor Bacon recognized Council Member Newcomb, who thanked Mr. Suddreth and commented that the revised IPMC would strengthen the City's code enforcement ordinance. December 6, 2010 MOTION: Council Member Newcomb made a motion to approve the Adoption of the 2006 International Property Maintenance Code (as amended in January 2009 by the State) and all proposed local amendments -and amending City of Smyrna Code of Ordinances, Section 18-12, Ordinance 2010-12. Motion was seconded by Council Member Pritchett. Motion approved 7-0. PRIVILEGE LICENSES: Mayor Bacon stated that there was none. FORMAL BUSINESS: 2 A) Reappointment of Ward 2 Representative to Smyrna Housing Authority Board for a five year term to expire on 5/2/2015 MOTION: Council Member Newcomb made a motion to reappoint Mr. Robert Owens. Motion was seconded by Council Member Pritchett. Motion approved 7-0. COMMERCIAL BUILDING PERMITS: Mayor Bacon stated that there were none. CONSENT AGENDA: Mr. Taylor read the consent agenda items to those present. A) Approval of November 15, 2010 Mayor & Council Minutes B) Adoption of 2011 City of Smyrna Holiday Schedule C) Approval to use Council Chambers on January 25, 2011 from 7:00 - 9:00 p.m. for a Ward 3 Williams Park HOA Meeting D) Approval of Bid Award for RFQ 11-007 for a Storage Area Network to MCPc in the amount of $58,598.30 and authorize the Mayor to execute any associated documents E) Approval of license request by occupant of 4221 North Cooper Lake Road F) Approve award of RFP 11-006 in the amount of $324,953 to the Georgia Municipal Association for the 2011 Renewal of Worker's Compensation Insurance Coverage and authorize the Mayor to execute any related documents G) Approval of Ordinance # 2010-13, removing language in Section 50-26 of Smyrna Code of Ordinances regarding International Property Maintenance Code MOTION: Council Member Wood moved to approve the consent agenda. Motion was seconded by Council Member Pritchett and approved 7-0. COMMITTEE REPORTS: Council Member Wood yielded the floor with no report. Council Member Lnenicka yielded the floor with no report. December 6, 2010 Council Member Smith thanked the members of the community for coming out to participate in the Home for the Holidays tree lighting and extended his appreciation to the Parks and Recreation Department for a job well done. Council Member Smith then yielded the floor with no further report. Council Member McNabb expressed his gratitude to the volunteers involved in the school communities that enhance the quality of the educational system in the City. Council IVlember McNabb then yielded the floor with no further report. Council Member Anulewicz recognized those involved with the Emory Adventist Hospital and their efforts to raise funds for mobile mammography units during their holiday home tour. Council Member Anulewicz then yielded the floor with no further report. Council Member Newcomb yielded with no further report. Council Member Pritchett yielded with no further report. No further reports were given. SHOW CAUSE HEARINGS: Mayor Bacon stated that there were none. CITIZEN INPUT: Mayor Bacon recognized Ms. Judy Ussing of 1005 Mill Pond Dr., who expressed her desire to see the Hwy 41/Spring Rd. gateway into Smyrna developed according to an aesthetic vision. She submitted to all present that apublic/private joint-venture or cross-governmental agency project could optimize visitors' first impressions of the City, increase community interest and encourage business to relocate within the city limits.
