SEPTEMBER 7, 1965
The regular meeting of Mayor and Council was held at City
Hall, Smyrna, Georgia, and called to order above date at 8:00
P.M. by Mayor G. W. Kreeger. All Council Members were present.
Also, present City Attorney, City Clerk, Department Heads and
Consultant Engineer, Philip J. Sutton.
There were no citizens present tilith reports for Council
action.
On motion by R. J. McCurry, second D. L. Mixon, the building
permit was granted to Ray Newton, Tnc. for 120 apartment units
and commercial structures on Spring Road next east from Jonquil
Park. The issuance of the buildin~* permit includes the request
of the developer in a deviation of the layout from the original
plan submitted and recorded in the December 1963 minutes of Mayor
and Council. The developer agreed to install a fence or buffer
separating the C-1 and R-2 structures; also fencing around a
swimming pool and compliance with right-of-way of the Spring
Street re-location project. Council voted unanimous on the
above.
A permit for an addition at the rear of Reeves Garden Shop,
20 feet by 2t~ feet was, on recommendation of the building in-
spector, granted. Motion by J. C. Porterfield, second by R. J,
McCurry.
Petitions were submitted in Council covering six parcels of
improved property on north side of Hawthorne Street requesting
zoning from R-1 Residential to "C" District classification. On
motion of J. C. Porterfield, second Isomer Kuhl, the hearing date
for rezoning was set at October 18, 1965. The Council also
approved on unanimous vote the display of one zoning sign on
each individual parcel within three days from above meeting date.

The petition of property owners on the north and south side
of Cherokee Road for rezoning to "C" District classification was
deferred to 10-~-~~5.
Mr. Johnson's request to Council covered the sales of produce
from his truck from private property in the area of Johnson's
Trim Shop. On Mayor Kreeger's recommendation and Councilman
Ables' motion the above was referred to the Business License
Committee for study and action,
Specifications for bid proposals covering sewer facilities
to the Waffle Shop on So. Cobb Drive were received and opened as

MEMO: The R. L. Hamby bid was not signed and identified
only by tie envelope, therefore, not considered by Mayor and
Council as a competitive bid.
Council acce ted the bidcf' J. E. Lovern Construction Co.
in the amount of 5,105.50 and referred to committee for dis-
cussion with Mr. Rogers in connection with recovery of 50~ of
installation and repaving cost.

The Council discussed the feasibility of sewerage at the
Waffle Shop then westerly under So. Cobb Drive, thence in a
northly direction to service all commercial properties to Jones
Shaw Road. The estimated project cost would require added depth
of the sewerage on the east side of So. Cobb Drive to the above
mentioned ?~laffle Shop.
Bids requested for drying beds and air conditioner ducts
deferred to 9-20-65.
A letter was read in Council from Wayne's Department Store
requesting permission to collect City of Smyrna water bills on
a daily remittance basis. The letter further states that the
operators of the store and Post Office are bonded. A motion made
by Homer Kuhl authorizes the collection of City of Smyrna water
bills at the above establishment provided that Mr. W. H. Colquitt
furnishes proof of fidelity bond coverage for the City. Motion
seconded by R. H. Wood and voted unanimous.
City Attorney, Mr. Berl T. Tate, called out September 15,
1965 as the completion date for propertyT acquisitions for the
Spring Street project.
The committee assigned for re-alignment and equalization of
malt beverage tax was deferred to January 1966.
Agenda Item ll~ of the above dated meeting referred to blanket
fidelity bond coverage, City Hall, Police and concession personnel.
Councilman R. J. McCurry motioned that with the exception of
?dorkman's Compensation and group hospitalization coverage, all
other insurance would be combined as a packaged policy covering
all liability, bond and equipment coverage. The motion seconded
by C. M. Chapman was voted six to one. D. L. Mixon voting
against.
The Business License Committee submitted a petition signed
by Mr. C. E. Pritchett and Edwin Martin requesting business license
covering taxicab company located next west of Tenneco Service
Station on Jones Shaw Road. R. J. McCurry moved we issue the
permit under the existing privilege license ordinance. Second
by Homer Kuhl and carried.
On motion which carried, City Attorney, Berl T. Tate, was
requested to draw resolution referring to school re-alignment
boundaries and submit in Council September 20, 1965.
In other action, Council:
a. Discussed violations of the clean up ordinance.
b. Authorized a letter to Simpson Realty Company referring
to drainage and clean up of a Stonecreek lot.
c. Discussed 1}-way stop signs, Stonecreek and Bank.
d. Agreed to consider trade of 1962 garbage truck for new
equipment and further to secure cost to overhaul trans-
mission and engine of the 1962 truck.
e. Rejected the rental of duplex properties in the area of
Sharon Circle as a violation to the R-1 Residential
classification.
f. Discussed Metropole agreement and deferred same to
9-20-6 r.
~;. Decided to secure bids for police patrol car and trade
1951 Chevrolet and 1960 Ford.
h. Signed a State Highway contract to re-stripe center and
lane lines of five City streets.
i. Discussed on R. H. 'H'ood's motion City liability in
reference to the water and sewerage studies and set
September 13, 1965 as the date for review of contract
and minutes and cost.
j. Deferred to 9-20-65 approval of relocation of Spring Road
utilities pending ~ eck out by City Attorney.
There being no further business, Council adjourned at 10:00

The rnid-month meeting of Mayor and Council was held at
City Hall, Smyrna, Georgia, above date and called to order by
Mayor G. W. Kreeger at 7:30 o~clock P.M. All Council Members,
Department Heads, City Attorney and City C lerk were present,
also Mr, Frank Dagley, representing Hensley-Schmidt, Inc.
Items No. 1 and Pdo. 2 of the Agenda called out citizens
reports and building permits. No citizens appeared and ro permits
were submitted by the building inspector.
Three bids were received and opened covering the renovation
of sludge drying beds and construction of grit chamber for the
westside sewerage treatment plant per advertised specifications:

Motion by Homer Kuhl to refer to committee for tabulation

approve the Lord & I{irkendoll bid with provision. that specifi-
cations wave been mQt. Second by C. M. Chapman and voted
unanimous.
The Council accepted and approved the one bid received
covering the duct work for the Church Street Recreation building;
air conditioning. The bid covering complete installation of the
duct work was submitted by Sohn FI. Tinnell Heating and Air` Con-

A petitior_ received from the Rev. Clifton C. Duvall requested
Council approval for a mobile home to be placed- on the rear of
Lot No. 3, Block A, Pinehurst Cirele, for temporary occupant;-.

A letter from the housing and Home r finance Agency dated
Septer~.ber 9 was read in. Council requesten.; certain information
and signatures on the Assurance of Compliance Forrns. The lette~~
further stated that Project No. P-GA-3054. (Sewer Facilities)
would be officially terminated on SeP_~tember 21~, 1965 unless the
requested ir~~'ormation was received. The $5,000 set aside for the
plans preparation (sewer facilities) and the $7,500 (water
facilities) was discussed by Mayor and Council ar_d City Attorney
in connection with invoices of record from Heasley-Schmidt, Inc.
in t;he above amaunts. It was brought out that in all proposals
and agreements, the Council never requested or approved t~'ie
sscurance of an interest free loan, and further that no obli-
gation on the part of the City existed in connection with. the
funds set aside for water and sewer study and plans preparation.
On this basis, Councilman R. J. McCurry recommended and motioned
that any request for payment by ?iensley-Schmidt, Inc, be and is
hereby denied. Motion second by Homer Kuhl and voted unanimous.
Public Works Superintendent J. E. David submitted two directional
plans for sewer facilities on the east and west side of South Cobb
Drive and north of the intersection of Powder Springs. ~'Iemo
The J. E. Lovern bid for sewerage to the TrJaffle Shop is recorded in
the amount of $5,105.x0.

To afford sewerage on the west side of South Cobb, it was the
opinion that the sewer installation to the Waffle Shop would require
a deeper cut, thence under South Cobb on the west right-of-way,
thence, north to the commercial structures to Bourne Drive at an
estimated $18,251. An alternate proposal from the above mentioned
?rJaff le Shop, casting $17_,761, directs the sewer line under the highway
to the Winn-Dixie easement, thence, nort'r. to a LL line, thence, west
to the right-o.f-way of Old Concord Road, thence north on Old Concord
right-of-way to Jores Shaw Road. -~
An agreement to approve a contract with Southern Bell Telephone
and Telegraph Company for installation ar~d maintenance of teletype-
writer circuit in the City Police Department was discussed and
approved on motion byT Homer Kuhl, The plan or agreement, known
as Metropol, would cost $30 per month for the teletype system, plus
$2_~ for setting up the radio equipment. The motion to become a part
of Metropol as per agreement submitted was seconded by R. H. ~~rood
and carried. A motion duly seconded by the above Councilman,
recommends threo officers assigned for a 100 hour training program
at the estimated cost of $25 for each assigned trainee covering
supplies, etc.
It was brought out in Council that the cost of preliminary
consultant engineering for the relocation of Spring Road utilities
as submitted b Hensley-Schmidt, Inc, was $x,115. The first relocation
estimate ($551 was called out in a letter to the State Highway
Dexa rtment stating the City was not staffed to make this type of study
and approved Hensley-Schmidt to perform the assignment. In further
discussion, Mayor Kreeger appointed the Street Committee and the
City Attorney to meet with Mr. Sam P. Hensley to resolve any and
all questions pertaining to the above.
Complaints of speeding on Honeysuckle Drive was referred to
Chief of Police, Robert L. Drake.
On R. J. McCurry's motion, seconded by J. C. Porterfield, the
Council approved as written and s~:bmitted the minutes of Mayor and
Council for the months of July and August 1965.
