02-01-2010 February 1, 2010February 1, 2010 The regular scheduled meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called to order by presiding officer Mayor A. Max Bacon at 7:30 o'clock p.m. All council members were present except Council Member McNabb. Also present were City Administrator Eric Taylor, City Clerk Susan Hiott, City Attorney Scott Cochran, Assistant City Administrator Tammi Saddler and representatives of the press. Mayor Bacon stated former Council Member Bill Scoggins passed away yesterday. Mayor Bacon stated Mr. Scoggins was first elected in 1988 and was alife-long Smyrna resident. Mayor Bacon stated Mr. Scoggins worked for Fouts Brothers for over 25 years. Mayor Bacon stated Mr. Scoggins was active in the Moose Lodge and many other organizations. Mayor Bacon commented favorably about Mr. Scoggins' many contributions to the community and stated he will be greatly missed. Invocation was given by Associate Pastor Mike Metzger from King Springs Baptist Church, followed by the pledge to the flag led by local Boy Scouts. MAYOR' S REPORT: (A) Proclamation in Recognition of the 100th Anniversary of the Boy Scouts Council Member Smith read a Proclamation in Recognition of the 100th Anniversary of the Boy Scouts to those present. A local Boy Scouts representative provided additional information concerning the organization and its anniversary. AGENDA CHANGES: There were none. Mayor Bacon provided details to those present concerning local artist Zac Brown, whose band recently won a Grammy Award. MAYOR' S REPORT (continued): (B) Presentation of Character Education Word with Argyle Elementary Mayor Bacon recognized school board representative Ms. Holli Cash, Mr. Dale Gaddis, Ms. Dawn Robinson and students from Argyle Elementary School, and the students presented this month's character education word. (C) Recognition of Brown Elementary and King Springs Elementary for winners of the Single Statewide Accountability System Award Mayor Bacon recognized school board representative Ms. Holli Cash, Mr. Dale Gaddis and Principals Brett Ward from Brown Elementary School and Linda Keeney from Argyle Elementary School. Council Member McNabb commented favorably about the local schools, and read a Proclamation In Recognition of Brown Elementary School for winning the Single Statewide Accountability System Award to those present. Council Member Wood read a Proclamation In Recognition of King Springs Elementary School for winning the Single Statewide Accountability System Award to those present. Principal Keeney February 1, 2010 thanked the teachers, staff and parents who are active in the school for their role in this accomplishment. Principal Keeney thanked the City's leadership for their support. Principal Ward thanked the present officials, and stated it is honor to be recognized. Ms. Cash commented favorably on the efforts of the principals, emphasized the importance of their leadership in the education process and thanked them for their diligence. Mr. Gaddis stated there is much to be happy about with the local schools, and thanked the school staff and the community for their support. (D) Proclamation in Recognition of Black History Month Council Members Newcomb and Anulewicz recognized Ms Lisa Castleberry and other representatives of the Rose Garden -Davenport Community. Council Member Newcomb read a Proclamation in Recognition of Black History Month to those present. Council Members Newcomb and Anulewicz presented the Proclamation, and Ms. Castleberry thanked the present officials for this recognition. Ms. Castleberry provided additional information to those present concerning other activities planned in connection with Black History Month. Ms. Castleberry expressed appreciation for some street numbers painted on curbs near Gordon Circle by City staff, and expressed concerns about debris in the area of Pasadena Boulevard. LAND ISSUES/ZONINGS/ANNEXATIONS: There were none. PRIVILEGE LICENSE: There were none. FORMAL BUSINESS: (A) Approval of Hybrid Defined Benefit/Defined Contribution Retirement Plan Mr. Taylor provided a summary of plan provisions for those present, and stated the new plan will be effective on April 1, 2010. Mr. Taylor stated staff recommends approval of the new plan. MOTION: Council Member Anulewicz made a motion to approve the Hybrid Defined Benefit/Defined Contribution Retirement Plan. The motion was seconded by Council Member McNabb. Motion was approved 6 - 1, with Council Member Lnenicka in opposition. (B) Approval of New Retirement Plan for future elected officials Mr. Taylor provided a summary of plan provisions for those present, and stated this new plan will not have a defined benefit component. Mr. Taylor stated staff recommends approval of the new plan with an effective date of April 1, 2010. MOTION: Council Member Anulewicz made a motion to approve the New Retirement Plan for future elected officials. The motion was seconded by Council Member McNabb. Motion was approved 6 - 1, with Council Member Lnenicka in opposition. February 1, 2010 3 (C) Selection/Award of new Hybrid Retirement Plan administrators Mr. Taylor stated staff recommends selection of the Georgia Municipal Employee Benefits System as administrator of the new defined benefit plan, and the Hartford Company as administrator for the new defined contribution plans. MOTION: Council Member Anulewicz made a motion to approve the Georgia Municipal Employee Benefits System as administrator of the new defined benefit plan and the Hartford Company as administrators for the new defined contribution plans. The motion was seconded by Council Member McNabb. Motion was approved 7 - 0. COMMERCIAL BUILDING PERMITS: There were none. CONSENT AGENDA: (A) Approval of January 19, 2010 minutes (B) Appointment of Assistant City Administrator Tammi Saddler as alternate member of License and Variance Board (C) Approval of the Community Development Block Grant Recovery Program (CDBG-R) and Authorization for Mayor to Sign the Subrecipient Agreements MOTION: Council Member Wood made a motion to approve the consent agenda. The motion was seconded by Council Member Smith. Motion was approved 7 - 0. COMMITTEE REPORTS: Council Member Pritchett expressed condolences to Mr. Scoggins' family. Council Member Newcomb expressed condolences to Mr. Scoggins' family, and commented favorably about Bill's commitment to the citizens. Council Member Anulewicz expressed condolences to Mr. Scoggins' family, and commented favorably about his dedication to the City. Council Member McNabb stated Mr. Scoggins enjoyed life and lived it with real passion, and that he enjoyed working with him on the city council. Council Member McNabb expressed condolences to Mr. Scoggins' family. Council Member Smith expressed condolences to Mr. Scoggins' family, and recounted the times he listened to Mr. Scoggins' stories about earlier years in Smyrna. Council Member Lnenicka expressed condolences to Mr. Scoggins' family and the family of Mr. Lamar Kuhler, who also recently passed away. February 1, 2010 4 Council Member Wood stated Mr. Scoggins was a close friend of his, and that Mr. Scoggins was forthright in his views. Council Member Wood stated Mr. Scoggins was a strong proponent of progress and redevelopment in Smyrna, and that he and others in the community will miss Bill very much. Mr. Taylor expressed condolences to Mr. Scoggins' family. Mr. Cochran expressed condolences to Mr. Scoggins' family. Mr. Cochran recounted discussions he had with Mr. Scoggins, and stated he enjoyed working with him. Ms. Hiott stated Mr. Scoggins always provided encouragement and positive reinforcement to her, and that he clearly enjoyed his association with all the officials, staff and citizens he was in contact with. Ms. Hiott stated she will miss him very much, and expressed condolences to Mr. Scoggins' family. CITIZENS INPUT: Mayor Bacon recognized Mr. Alex Backry, residing at 3459 Shawnee Trail, and Mr. Backry expressed views regarding the importance of town hall meetings. Mr. Backry commented favorably about a town hall meeting he recently attended which was conducted by Representative Rich Golick. Mayor Bacon recognized Ms. Judy Ussing, residing at 1005 Mill Pond Drive, and Ms. Using expressed concerns about comments she heard and actions she observed at the last council meeting. Ms. Using expressed the view that the behavior she observed is unacceptable, and that she would not like to see it again.
