11-02-2009 November 2, 2009November 2, 2009 The regular scheduled meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called to order by presiding officer Mayor A. Max Bacon at 7:30 o'clock p.m. All council members were present. Also present were City Administrator Eric Taylor, City Clerk Susan Hiott, City Attorney Scott Cochran, and representatives of the press. Invocation was given by Council Member McNabb, followed by the pledge to the flag. AGENDA CHANGES: There were none. MAYOR'S REPORT: (A) Presentation of Character Education Word with Imagine School Council Member McNabb provided details to those present concerning Imagine School. Students from the school presented this month's character education word. Mayor Bacon recognized faculty members Ms. Blocker and Ms. Campbell, and commended the students on their presentation. (B) Proclamation in Recognition of Concord Body Shop for 50 Years of Business in Smyrna Council Member McNabb recognized Cecil and Jim Pickens, and read a Proclamation in Recognition of Concord Body Shop to those present. Mr. Cecil Pickens thanked the council members and his many customers in Cobb County for their support over the years. (C) Proclamation in Recognition of Poppy Day Council Member Wood read a Proclamation in Recognition of Poppy Day to those present. Ms. Turley and other representatives of the American Legion Auxiliary thanked the officials for their support, and provided information to everyone concerning the upcoming Shop with a Hero program. LAND ISSUES/ZONINGS/ANNEXATIONS: There were none. PRIVILEGE LICENSE: (A) Public Hearing -privilege license request -retail pouring of beer and wine - Li Yong Su, Inc. dba Chef Chen - 4924 South Cobb Drive # D-E - Qi Li Chen, applicant Mr. Taylor stated the applicant has received a copy of the City's alcoholic beverage sales regulations and has completed the mandatory alcoholic beverage sales and service class. Mr. Taylor stated that inquiry by the City police department disclosed no information which would preclude issuance of the requested license. ""~ Mayor Bacon stated this is a public hearing and asked for public comment. There was none. November 2. 2009 Council Member Wood recognized Mr. Chen and advised him that, from time to time, local authorities will conduct undercover inquiries at businesses licensed to sell alcoholic beverages to help gauge their compliance with pertinent regulations. MOTION: Council Member Wood made a motion to approve the privilege license request for retail pouring of beer and wine for Li Yong Su, Inc. dba Chef Chen at 4924 South Cobb Drive # D-E for Qi Li Chen as agent. The motion was seconded by Council Member Smith. Motion was approved 7 - 0. FORMAL BUSINESS: There was none. COMMERCIAL BUILDING PERMITS: There were none. CONSENT AGENDA: (A) Approval of October 19, 2009 minutes (B) Approval to use Council Chambers on November 4, 2009 from 7:00-5:00 pm for a Ward 4 Town Hall Meeting for residents of Dunn Street to discuss right of way plans for a potential sidewalk (C) Approval of appointment of Deputy Fire Chief Roy Acree as an alternate member to the License and Variance Board (D) Approval of Employment Agreement between City Administrator and City of Smyrna and authorize Mayor to execute the agreement MOTION: Council Member Wood made a motion to approve the consent agenda. The motion was seconded by Council Member Smith. Motion was approved 7 - 0. COMMITTEE REPORTS: Council Member Pritchett stated power pole installation on Spring Road is progressing gradually. Council Member Newcomb yielded the floor with no report. Council Member Anulewicz encouraged everyone to get outdoors and enjoy the City's parks. Council Member McNabb reminded everyone about the upcoming meeting regarding the possible installation of a sidewalk in the area of Dunn Street. Council Member Smith reminded everyone that daylight savings time changed over the weekend and that this is a good time to check smoke detector batteries. Council Member Smith provided details to those present concerning an upcoming reception at Brawner Hall. Council Member Smith expressed sadness at the recent loss of his mother-in-law, Mrs. Surface, and provided details to those present concerning Mrs. November 2. 2009 3 Surface's background. Council Member Smith thanked the many members of the community for their kindness during this difficult time for his family. Council Member Smith stated Mrs. Surface will be greatly missed. Council Member Lnenicka expressed condolences to Mrs. Surface's family. Council Member Lnenicka thanked the members of the Public Safety Foundation for the banquet they organized recently for local public safety personnel. Council Member Lnenicka reminded everyone that there will be a ceremony at Brinkley Park on Veterans Day and provided details concerning the planned proceedings. Council Member Wood expressed condolences to Mrs. Surface's family and stated she will be missed. Mr. Taylor commented favorably on Mr. Lamar King's 49 years of service with the City of Smyrna. Mayor Bacon wished Council Member Lnenicka a happy belated birthday. Mayor Bacon commented on the passing of Mrs. Surface and stated she will be greatly missed. Mayor Bacon stated Mr. Lamar King served the City long and well. CITIZENS INPUT: Mayor Bacon recognized Mr. Alex Backry, residing at 3459 Shawnee Trail, and Mr. Backry expressed ,,, views regarding the city council's performance and made suggestions regarding the way he believes public meetings should be conducted.
